The applicant seeks the following development standards variance approval for a pergola: 2. Docket No. PZ-2025-00105 V UDO Section 2.03 Max. 35% lot cover allowed; 43% requested. The 0.32-acre site is located at 2721 Towne Meadow Drive. (Estates at Towne Meadow subdivision, Lot 11). It is zoned S-1/Residence and is within the W. 116th St. Overlay. Filed by Lisa & Nishant Trivedi, owners. General Info: • Petitioner seeks approval to construct an 18.5-ft x 26-ft pergola in the back yard. • Variance approval is required for exceeding allowed maximum lot coverage. • The site is located in the Estates at Towne Meadow subdivision; Homeowner’s Association (HOA) approval has been granted. • Surrounding this site are single family residential dwellings and open space Common Area. • Please see the Petitioner’s Info Packet for more details on the variance request. Variance Requested: Lot Coverage - • The UDO allows for a maximum 35% lot coverage in the S1 zoning district, and 43% is requested. • This is a variance request for an 8% increase in lot coverage. • An overall drainage plan and stormwater detention area exists for the neighborhood. • The pergola will have an asymmetrical sloped roofline and be 11-ft tall at its tallest point. • The roof shingles will match the house’s, and the columns and headers will be wooden and wrapped with Smart Siding. The color will be white to match the house. • It will be located at least 5 feet from the side and rear property lines. Remaining Review Comments: • The Petitioner addressed all planning/zoning review comments. Final Comments: • The Planning Dept. supports the variance request. • The Carmel Engineering Dept. has the following comments: The Dept. recommends advising the homeowner to check with the Hamilton Co. Surveyor’s Office on this project due to a regulated drain existing in their backyard. The homeowner should ask the County to verify if there is an easement over the regulated drain. We do not have issue with the proposed improvements, but we don't want to create a conflict with the county. We also don't have issue with the additional lot coverage due to the subdivision meeting our current standards for stormwater detention. (The Petitioner has contacted the Hamilton County Surveyor's Office and is waiting for a response regarding the easement.) Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of the variance request, with the condition of addressing any Hamilton Co. Surveyor’s Office comments, and with the adoption of the Findings of Facts submitted by the Petitioner.
