CARMEL BOARD OF ZONING APPEALS HEARING OFFICER
DEPARTMENT REPORT
MONDAY, JUNE 23, 2025
(V) Fruchte Shed Setback Variance.
The applicant seeks the following variance approval for the location of a 16’x10’ shed on a corner lot:
3. Docket No. PZ-2025-00109 V UDO Section 5.02(B) Accessory Buildings shall be set back
25-ft behind the front line of Principal Building; 56-ft in front of Principal Building requested.
The 1.18-acre site is located at 9610 Deerfield Mall. (Deerfield subdivision, Lot 1). It is zoned S-
1/Residence. Filed by Jonathon & Megan Fruchte, owner.
General Info:
• Petitioner seeks approval to construct a 10’ x 16’ mini barn shed / accessory building along 96th Street.
• Variance approval is requested for shed setback/location.
• The site is located in Deerfield subdivision; Homeowner’s Association (HOA) approval has been granted.
• This is a Corner Lot with two street frontages – Deerfield Mall and West 96th Street, hence, two front yards.
• Surrounding this site are single family residential dwellings.
• Please see the Petitioner’s info packet for more details on the variance request.
Variance Requested:
Accessory Building Setback -
• The UDO states that Accessory Buildings shall be set back 25-ft behind the front line of Principal Building;
and 56-ft in front of Principal Building is requested. (The Unified Development Ordinance also states that,
on Corner Lots, no residential accessory building shall be erected forward of any principal building or in any
required minimum front yard.)
• The mini barn shed will be 8-ft tall and be tan/white in color. It will also have architectural shingles.
• It will be situated at the southwest corner of the lot, with a 32-ft setback from the west property line and a 3-
ft setback from the south property line (96th Street frontage).
• A privacy fence exists along 96th Street, so the view of the shed will be blocked.
• Several easements exist along the south property line of the lot. Easement encroachment approvals have
already been granted by agencies that have rights to them. Hence, a Consent to Encroach approval is not
needed.
Remaining Review Comments:
• The Petitioner addressed all planning/zoning review comments.
Final Comments:
• The Planning Dept. supports the variance request. The detached accessory building will be placed in the
corner of the lot, in what the Petitioner considers to be the “back yard”, out of the way.
• This mini barn shed is also replacing an older, smaller shed that was situated in the same location.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of the variance request, and
with the adoption of the Findings of Facts submitted by the Petitioner.
