DEPARTMENT REPORT
MONDAY, JUNE 23, 2025
(V) Fehsenfeld Accessory Building Setback Variance.
The applicant seeks the following variance approval for an outbuilding at the entrance of the driveway:
7. Docket No. PZ-2025-00114 V UDO Section 5.02(B)(1) Minimum 25’ front setback
behind front line of principal building allowed; 830’ in front of principal building requested. The
63.99-acre site is located at 4415 W. 116th Street. (not located in any subdivision). It is zoned S-1/
Residence and is located within the W. 116th Overlay. Filed by Jennifer Milliken of Ice Miller on behalf of
Fred & Suzanne Fehsenfeld, owners.
General Info:
• Petitioner seeks approval to construct a 9’ x 9’ package drop off building, by the street.
• Variance is requested for accessory building setback/location.
• The site is not located in any subdivision; there is not an active Homeowner’s Association (HOA).
• Surrounding this site are mostly single family residential dwellings.
• Please see the Petitioner’s info packet for more details on the variance request.
Variance Requested:
Accessory Building Setback -
• The UDO states that a minimum 25’ front setback behind the front line of principal building is required for
accessory structures and uses. And, 830’ in front of principal building is requested.
• The accessory structure will be located approximately 5.5 feet back from the street right of way.
• The main house (principal building) is located approximately 855 feet back from 116th Street.
• The overall parcel of land is 64 acres in size.
• The accessory structure will be approximately 10-ft tall, have a flat seamed copper shake finished roof, and
have stucco and stone veneer for the siding materials.
• Additional asphalt is proposed within the street right of way area, so delivery trucks can pull off the street
and get close to the package drop off structure.
• Fence work is also proposed along 116th Street.
Remaining Review Comments:
• The Petitioner addressed all planning/zoning review comments.
Final Comments:
• The Planning Dept. supports the variance request.
• The Carmel Engineering Dept. has no concerns with the proposal, and only requires a Right of Way permit.
• Regarding the fence in future street right of way, Planning Staff would like a Commitment by the Petitioner
to move fence out of the future street right of way, if/when the City ever does improvements to this section of
116th Street.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of the variance request, with
the condition of addressing the remaining minor review comments in ProjectDox, and with the adoption of
the Findings of Facts submitted by the Petitioner.
