Hi, Vikey – I want to say yes, but I am not 100% sure. We will have to just wait and see what the HCSO says. Since it
is a regulated drain easement, they might have jurisdiction about what is being placed/constructed just outside of
that easement area, especially if it affects things like stormwater flow within that easement area...

I just wanted to clarify, since the entire pool project has now been revised to be fully outside of the
drainage easements, am I correct in understanding that it is no longer under the jurisdiction of the
Hamilton County Drainage Board and does not require their approval?

Good morning, Vikey –
Yes, your pool plans for 14211 Beaument Blvd. will be able to be revised according to their feedback.
The biggest thing to prepare ahead of time are the BZA variance public notice items, so the mailings to the
adjacent property owners, the legal ad in the newspaper, and the public notice sign. A Template for the wording for
the mailings and the legal ad are in the Variance Handout, and I just emailed you this morning about that. The
wording for the public notice sign and what it should look like is also within that Handout.
I am not aware of any other items you need to get finalized, except the BZA variance request and the Pool permit.
However, if the pool company will be using heavy equipment during construction, you/they will also need to seek a
Right of Way Permit. That can be created/filed on the online application portal. And, that will be processed by the
Carmel Engineering Dept.

If Gary and Sam have negative comment, may I still revise the plan according to the feedback?
I also requested for adjoining neighbors list and I'm waiting for it.
What else or other documents I can prepare now in the meantime?
What else we need to do (other than the permit application by pool builder and variance application by
me)?
I will have a very busy July for personal matters, so I try to get as much done as possible to be ahead of
the game and meet all those variance process timelines.

The pool builder said "We will need to apply for the permit first and then they will ask for the variance
application at that point. I’ll let you know when we have our permit application submitted." Do you know if I
need to wait for the pool builder to submit permit application first, or can I still go ahead to submit the
variance application to catch the deadline of June 30?

Hi Vikey –
Here is what Jarrod (Carmel Engineering Dept.) wrote me earlier this morning: With the equipment outside of the
easement, I have no questions or concerns.
So, I think your project is headed in the right direction, and could potentially be heard by a hearing officer of the
BZA, if the Hamilton County Surveyor’s Office also has no concerns with the decking/concrete going right up to the
easement boundaries.)
However, if the Hamilton County Surveyor’s Office is not too keen on the pavement/decking going right up to the
easement line, then we would just have your variance item heard by the full 5 member BZA. We would also
probably not be supportive of the variance request, but ultimately, the final decision is up to the BZA, and you or
the property owner would have to make their case to the Board. The timeline is a little bit longer (45 days from a
filing deadline, rather than 28 days), and the filing fee is a little bit more ($423.75, rather than $215.50)... Here is a
link to the BZA webpage that has the Calendar and the applications.
We will just have to wait to hear back from Gary and Sam’s office…

I am weighing a few different factors between Design 1 and Design 2.
I wanted to ask, if we move forward with Design 1, does that mean it can go to the full 5-member Board even
if the Hamilton County Surveyor’s Office and the Carmel Engineering Department are NOT in support of it?
What factors the full Board might consider that could potentially lead to a different decision than the
Hamilton County Surveyor’s Office and the Carmel Engineering Department?
Is that process for the full Board typically longer or more complex than the BZA Hearing Officer?
Appreciate your guidance as we decide how to proceed.

Thank you for making the changes; however, the email that Joe sent you on May 23 still applies to 14211 Beaument
Blvd. A swimming pool, its decking, and the pool equipment need to be located at least 10-ft away from the side or
rear lot line OR at least 3-ft away from any easement (whichever is greater), and that is per UDO Section 5.02
(C)(7).
If the Hamilton County Surveyor’s Office and the Carmel Engineering Dept. are comfortable with your new
proposed site plan showing the concrete decking going right up to the easements, then I think we can have your
BZA variance item heard by the BZA Hearing Officer (and not the full 5-member Board). The next filing deadline is
Noon on June 30, and that is for the July 28 BZA HO meeting. Please let us know what you would like to do, either
way. Thank you.

I wanted to share the updated design and confirm a few things with you:
1. Changes to Original Design: To avoid encroaching into the easement, we have relocated the pool
equipment and plumbing valves to the concrete patio area.
2. Same as Original Design: The north and south edges of the concrete patio remain aligned with the
north and south edges of the house.
3. Same as Original Design: The east edge of the concrete patio still runs up to the edge of the easement
along the RDE line on the east side.

4. Lot Coverage: I have included the plat plan for the entire lot, with red lines marking the area covered
by this project. The pool builder calculated total lot coverage at 57.07%, including both existing
coverage and proposed coverage. Could you please double check to confirm whether this meets the
maximum allowed coverage?
5. Next Steps: Is this revised design acceptable? If so, what additional approvals or steps are required to
move forward?

Understood. I will work with the pool builder to find an alternative location for the pool equipment that
does NOT encroach into the easement.
Regarding the window well, it was approved under a CTE granted by the City of Carmel during original
construction by the home builder, and they relied on the city’s permitting process in good faith.
