6:30 p.m.
The Special Session of the Carmel Plan Commission met at 6:30 PM in the Council Chambers of
City Hall, Carmel, Indiana. The meeting opened with the Pledge of Allegiance.
Members present: Stephanie Blackman, Jerry Chomanczuk, Dan Dutcher, Wayne Haney, Dianna
Knoll, Mark Rattermann, Rick Ripma, Steve Stromquist, Madeleine Torres, Susan Westermeier,
thereby establishing a quomm.
Also present: Mike Hollibaugh, Director of the DepaItment of Community Services, and John
Molitor, legal counsel.
I. Old Business:

The applicant seeks approval for a medical/office building. The site is located
northwest of Old Meridian Street and Meridian Street (US 31). The site is zoned B-3
and B-6/Business, within the US 31 Overlay Zone.
Filed by Tom Eagley of Lauth Property Group.
Mike Cook, attorney with offices at One Indiana Square, Suite 1800, Indianapolis appeared before
the Commission representing the petitioner. Also in attendance: Dan Barkes and Todd Jenkins,
Lauth Property Group.
This petition was presented to the Commission a few months ago and it has been before the Special
Study Committee for several sessions for review. The petitioner seeks to construct a single, three-
story building containing 88,902 square [eet, generally located on a site at 12202 North Meridian
Street, next to the Ritz Charles and east of Williams Creek Farms Subdivision. The site is zoned
partially B-3/Business, partially B-6/Business.
The exterior of the building is architectural, pre-cast glass and architectural metal panels, reddish-
brown and buff-creme in color. The transformers and trash enclosures proposed are located on the
southeast corner-full enclosed-constructed of the same materials as the building. The rooftop
mechanical equipment will be screened as a part of the general design of the building. The parking
lot consists of 378 parking spaces and exceeds the requirements under the Ordinance.

The ingress/egress to this site is currently proposed off the frontage road. There is now a tentative,
final plan for the route of the extension of lllinois Street from 116'h Street and Carmel Drive. The
proposed route for the extension of lilinois Street affects two parcels-one of which is occupied by
Greg Small, the other is occupied by Dr. Spann. Most of the other lots in the Williams Creek Farms
Subdivision are considerably back from the proposed extension of Illinois Street.
Lauth Property controls three of the four lots in the Subdivision that are directly adjacent to where
lllinois Street will be extended. This proposal is the first part of a project that is proposed and
consists of two buildings, each containing the same amount of square footage. That particular part
of the project is coming before the Plan Commission on October 19, 2004 as part of the public
hearings.
This evening, there is only one building before the Plan Commission. The site plan only
encompasses 9.07 acres. The petitioner has worked quite hard and the neighbors have worked very
hard in discussions concerning this matter. Considerable progress has been made in those
discussions, and that is evidenced by the fact that there are no neighbors in attendance this evening
to remonstrate against this proposal. There is an agreement in principal with Mr. Small and Dr.
Spann-the two most affected lots within Williams Creek Farms Subdivision, by two things:
whatever impact the proposed development has and whatever impact the extension of lllinois Street
will have. While those agreements have not been finalized, they are well under way to being
finalized. The petitioner is in discussion with the other neighbors in Williams Creek Farms
Subdivision-represented by an attorney-and the attorney was aware of these proceedings.
Neither the residents from that Subdivision nor the attorney is in attendance this evening, and
progress is being made. Again, there is no final agreement but it is anticipated there will be by
October 19th.

One of the things the petitioner has agreed to do is enter into some_c.QmmitI~ regarding this
development. Those commitments have been presented to the Commission and the Department.
The petitioner agrees that any approval this evening should be subject to formalizing the
commitments and recording them. Those commitments relate to cellular towers, signage permitted
on site, trash pick-up, and part of th;CornmercIaI development that would incorporate Those partial
lots that will be bisected by lllinois Street. Those commitments have been reviewed and approved
by the interested parties; to the extent they are relevant to what is before the Commission this
evening, the residential neighbors are in agreement. ~ -

Jerry Chomanczuk reported for the Special Study Committee. Mr. Cook's summary captures all of
the salient points that have been discussed over the last three meetings. The proposed building will
be a fine-looking building in a great location. Two issues that took some time were working with
the neighborhood, and the alignment and extension of lilinois Street. The Committee voted 4-0 in
favor of this petition.
Department Comments, Jon Dobosiewicz. The Department is recommending approval of the
Development Plan, subject to the recording of the commitments offered at the Committee level. A
special thanks to the Committee members to meet this evening prior to the regularly scheduled

Committee meetings and to the full Commission in their willingness to meet this evening. Once
issues are resolved with all interested parties, we can move forward and not unreasonably delay.
The Commission members were comfortable with the commitments tendered this evening by the
petitioner.
Mark Rattermann echoed thanks to fellow Commissioners and to the petitioner in working with the
neighbors to resolve issues.
Dianna Knoll was especially thankful for the resolution of the lighting issues.
Mike Hollibaugh, Director, commented that the Illinois Street extension is the City's project and
Lauth has been caught in the middle between the neighbors who had one thing in the mind, and the
City who had raised the bar quite a bit. lllinois Street is an important part of the City Thoroughfare
Plan and this proposal is a good opportunity for us to make Illinois Street happen. Throughout the
process, the CiLy's Engineer, American Consulting, has been working closely with the peLiLioner and
the neighbors to try and come up with an alignment thaL meeLs the Thoroughfare Plan and the Plan
Amendment that was adopted in 2001. Weare very closc to having this all nailed down, at least in
concept. The road was pushed farther to the east, the needed right-of-way is lined out at this point,
American Consulting is finalizing a field survey thaL will help us verify all topographic conditions
as well as create the final documents, either for right-of-way, or actual construction drawings.
