The applicant seeks the following development standards variance approval:
Docket No. 08050002 V Section 18.01.01 Lot size smaller than one acre
The site is located at 1021 S. Rangeline Road and is zoned B7, within the Carmel Drive/Rangc1inc Road
Overlay.

General Info: The petitioner is seeking a variance to
legally establish reduced lot size in the B7 District, within
the Carmel DrivelRangeline Road Overlay. The site is
improved with a commercial building, with additional
commercial uses to the north, south, and west, and
residential uses to the east. The B7 district requires a
minimum of one acre, and the lot size is 0.47 acre.
Analysis: The structure is a one-story commercial building,
that is somewhat residential in appearance. The petitioner
intends to use it as a school, which is a pemlirted use in this
district and similar in terms of intensity to adjacent uses.
The underlying zoning requires commercial lot sizes of at
least one acre; the site is 0.47 acre. However, it has been
used in a commercial capacity for many years, and the lot
size has been adequate. No significant changes are
proposed for the building or site. The site size, considering
no changes are anticipated, should be adequate for the
proposed use.
Findings of Fact: Lot size less than one acre
1. The approval of this variance will not be injurious to the public health, safety, morals, and general
welfare of the community because: the site has operated commercially for many years, and the proposed
use is approximately the same as adjacent uses. No significant changes are anticipated to the site.
2. The use and value of the area adjacent to the property included in the variance will be not affected in
a substantially adverse manner because: the site has operated commercially for many years, and the
proposed use is approximately the same as adjacent uses. No significant changes are anticipated to the site.
3. The strict application of the terms of the Zoning Ordinance to the property ",ill result in a hardsWp
in the use of the property because: the petitioner would be unable to operate the proposed, and permitted
use.
Recommendation:
The Dept. of Community Services recommends positive consideration of Docket No. 08050002 V after all
concerns have been addressed.
