hi zeff: we did have a meeting about this with mike h, and that is when he said that this propsal would have to go to
committee because we could not approve the parking area along the side of the building administratively. he never really
said that a variance was needed, and so, it is still up in the air, i think. i will defer my comments to mike.
mike- will they need hearing officer variance approval for the parking lot that is not at the rear of the building for the 116th
and college pud? or will the adls amendment approval be enough?

Dear Ms. COlUl/Ladies-Gentlemen:
In furtherance of the submission of the Final Development Plan in connection with
Docket No. 08040001, attached please find a copy of (i) Ordinance Z-484-05, as passed by the
Carmel Common Council, (ii) the proposed Final Development Plan for 1161h Street Centre II,
(iii) a proposed Screening/Landscape Plan, together with (iv) the Conceptual Site Development
Plan that was attached to and approved in connection with PUD Ordinance No. Z-484-05 on
November 21,2005. You will note that we have highlighted on the attached Final Development
Plan those areas that have been modified. Specifically, the modifications from the Conceptual
Site Plan to the Final Site Plan are as follows:
1. Inclusion of a median at the center entryway along College Avenue;
2. A separation between the buildings located at the corner of College Avenue and
E. 116th Street, creating a pedestrian corridor and seating area between the two
buildings;
3. Establishment of a 12,000 square foot building where the "outlot" was originally
proposed. This new building will have the same elevations, height and
architectural features as the other buildings previously proposed and approved;
and
4. Establishment of a landscaping screen/seating area between the buildings
fronting on the west side of the cntryway along East 116th Street.

This submittal is not intended to address final site development issues such as drainage
and engineering that will be submitted to the appropriate City departments prior to requesting
building pemlits/improvement location permits.

Dear Angie;
During my meeting with Randy and Equicor's planting contractor TMT (Suzie Dubois), I received a copy of the associated
landscape plan for this area. It was done by Brandon Schreeg of Remenschneider Associates, and I called him and a
phone conversation after with him.
What is not readily apparent from the plan (Brandon told me) that there is a 4 foot wall going in (mainly because of grade
change) that will have boxwood shrubs in front of it and trees behind it. In light of that the plant material appears sufficient
for a visual buffer.
They are also putting some areas of structural soil. They seem to be rather limited in size and volume. I have asked
Brandon to expand the limits of structural soil to the parking lot, and then under the pavement (patio and sidewalk) up to
the building, He agreed that could be done. I also asked him to check with Duke Energy (and gave him some contacts _
Shirley Hunter, Thomas Ordway) about the location they are showing the transformer in, and the landscaping around it. I
think Duke will have some objections to that.

This is in follow up to my voice mail message of earlier today. In light of your comments noted
below, we are going to need some more time to fully address the same. We are hopeful that we can
satisfy the City Forester based on our revised landscape plan.. However, Randy Watson of Equicor
has not been able to catch up with him. We would like to see if we can heavily landscape the space
between the buildings along 116th where the space exists between the proposed buildings. We
believe this is consistent with our original concept with the proposed drive-though on the then
contemplated out lot. This may also effect our parking ratio, although we believe that we will still
comply with the PUD Ordinance in that regard.
Thus, we respectfully request that we be tabled tomorrow at the T AC meeting and be
rescheduled as soon as we can satisfy Staff in regard to these issues. Please let me know if you
need a more formal request and/or if we should give notice to a broader group in this regard. As
always, thanks for your time.

There is currently a bicycle "rack" parking area located between tennis court and current bath house. Our
parking lot has approximately 30 automobile parking spaces. The current bicycle rack will accomodate at least
10 bicycles with flow over space for more. This cunent area will not be affected by project.

Hello, Zeff: in looking at the proposed changes, and as I already relayed to Larry Hafetz in November 2007, please note
the following:
1.) Please look at Chapter 2.1 O.A of the PUD ordinance Z -484-05. Parking is only allowed at the rear of buildings.
2.) In addition, chapter 2.10.0 requires 43.6 parking spaces for this proposed 12,000 s.f. building. Please provide Staff
with a parking breakdown chart for the whole site to show that it meets the parking requirements. For this new building, I
only counted 37 new parking spaces. You may need variance approval for the reduced number of parking spaces.
3.) DOCS will also need a revised landscape plan. Scott Brewer, City Forester, will also have to review/approve the
revised landscape plan.

As indicated in your email and pursuant to a recent meeting among Mike Hollibaugh,
Greg Small, Mark Zukerman and Zeff Weiss regarding the ahove-referenced POO, we submit
this'letter on behalf of 1 16th Street Centre II, LLC requesting approval of a Final Development
Plan for the PUD, as defined in the PUD Ordinance No. Z-484~05 (the "Ordinance"). Attached
to this letter are: (1) the Ordinance (with exhibits), as originally approved; and (2) a revised site
plan for the PUD, discussed below. The original Ordinance, along with the revised site plan.
comprise the proposed Final. Development Plan for the project.
The original Ordinance was adopted by the Common Council of the City of Carmel on
November 21,2005. Induded with the approved Ordinance was an approved Conceptual Plan
for the project, defined in the Ordinance, and an original site plan. Section 5 of the Ordinance
set forth the procedures for Final Development Plan approval for the project and provides, in
part, that the Director shall have sole and exclusive authority to approve the Final DeveLopment
Plan for the PUD. This letter is submitted pursuant to Section 5 ofthe Ordinance.
The revised site plan attached to this letter makes three minor changes to the original site
plan. First, the revised site plan shows a median at the southern most access point to the
development from College Avenue, which structure was not previously shown on the site plan.
Second, the revised site plan shows the L-shaped building on the corner of 1 16th Street and
College A venue as separated into two structures, where the original site plan showed this
structure as one, undivided structure, Third, the revised site plan includes a new structure on
116th Street, east of the L-shaped structure, where the original site plan referred to this area as an
"outlot."

For your convenience, we have highlighted the three changes to the site plan on the I
attachment to this letter.
We believe these changes to the site plan should qualify as IIMinar Alterations" under the
PUD and should therefore be entitled to review and approval solely by the Director. See Section
5.l{A) of the Ordinance. Moreover, as discussed in the recent meeting, because the proposed
structure on the "outlot" will have substantially similar elevations and exteriors as the other
structures in the PUD, we believe this change to the site plan should also be approved by the
Director alone and should not be. subject to the Architectural Design, Exterior Lighting,
Landscaping and Signage ("ADLS") process. Accordingly, the approval of this entire Final
Development Plan, in our view, is solely within the discretion of the Director.

TAC (Technical Advisory Committee) and a subcommittee of the plan commission, instead of the full commission, for
approval. This would not involve a public hearing or public notice. We can discuss this further.
Also, look at Chapter 2.1 a.A of the PUD ordinance Z-484-05. Parking is only allowed at the rear of buildings. In addition,
chapter 2.1 G.D requires 43.6 parking spaces for this proposed 12,000 s.f. building. You will have to provide Staff with a
parking breakdown chart for the whole site to show that it meets the parking requirements. For this new building, I only
counted 37 new parking spaces. You may need variance approval for the reduced number of parking spaces...
DOCS will also need a revised landscape plan. Scott Brewer, City Forester, will also have to review/approve the revised
landscape plan.

I spoke to Zeffabout your comments and your assessment of the oul-Iot issue is correct. However, the discussion
you cited from the plan commission rneetlng vlias in tl1e context of developing some form of a drive-thru on the out-lot,
such as a Stal~bucks. We now know, however, that the improvements on the out-lot will not include a drive-thru, and will
be consistent with the desi'gn of the other structures in the PUD. Based on our discussions with Mike Hollibaugh, we
thought that adrninistrative approval for tl1is lype of structure would be appropriate.
In any event if you believe that furtf1er CommisSion review is necessary, we cerialnly would prefer to go through the TAC
process as you mention.. Let's disclIss this further when you have a minute Also. I will get back to you on the parking

The applicant seeks to rezone 12.4 acres from R lIResidential and B6/Business to
POO/Planned Unit Development for the purpose of creating a mixed use development
comprised oftownhol11e, retail, and office uses.
The site is located at NE comer of 116th Street and College Ave.
Filed by Timothy OchsofIce Miller for Equicor Development Irtc.
ZeffWeiss, attorney with Ice Miller appeared before the Committee representing the apphcant.
Also in attendance: Greg Small and Mark Zuckennan, principals of Equicor, Tom Jolley, Don
Guinnup, Engineer.
The petitioner is proposingapproxil11ately 60 tow'nhomes on 12.4 acres with a common access to
1161h Street as well as CollegeAvenue. Since the initial site plan, parking is now provided along
College Avenue, similar to that seen in Clay TelTace-a lane into the parking area and diagonal
parking. The access off 1161h Street will serve the residential as well as the townhol11e cOllllmmity
located to the northeast; there Will also be access onto Guilford. The petitioner wi\] provide for an
extension ofthe intemal road across the property that will wrap around and into the other
development. The petitioner will try to continue the aesthetics approved by the Commission in
connection with 116tl1 Street and Guilford project.
Depattment Report, Matt Griffin. This project is very much in line with future land use plan for the
area. This project is in addition to the approved Townehomes at Guilford and this can be a very
viable, semi-urban node. Access and on-street parking are provided and it seems as if all pieces of
the puzzle exist, we are just trying to finesse them into a more successful project. There are a few
outstanding items. Pedestrian circulation is still in discussion, on-street parking -some parking has
been accommodated on College A vemie. As shown, the parking does not meet the Ordinance but
this proposal is for aPUD and as such, there is some flexibility with how the parking is
acconmlOdated. It would be important to know what use the outlot would transition into so that we
are sure what the parking can accommodate. There is some parallel parking along internal streets.
We have an opportunity now to make sure this project has ample parking.

Jerry Chomanczuk said that parking is a key item, especially behind the townhomes. There is
parking on both sides of the entry for business and retail. It needs to be spelled out, though, where
is the parking short, and how short is the parking?
The petitioner stated that a lot of outdoor seating has been added to this project. Previously, the
majority of entryways were designed to come in off the sidewalk, street, etc. That is why there are
the benches and plants, etc.
Madeleine Torres commeilted about parallel parking on CoIlege Avenue and thought that would be
a mistake. Madeleine would rather see the diagonal parking-so would the Department; the
petitioner said that space would be a detennining factor.

.Teny Chomanczok asked about public notice to Meridian Technology Park. There are certain
covenants and restrictions that apply. The Meridian Technology Park Association probably would
have made fueluembers ofthe Association fully aware of what was going on and how it would
impact the Association. J eITy asked the petitioner to check and see if there were any further
requirements required of Teclmology Center Association with other members.
ZeffWeiss answered in the positive. Meridian Technology Park Association had to consent to
carving out the parcel, but'Zeffwoltld double-check.
J eITY Chomanczuk also asked the petitioner to strongly consider the walkways and to what extent
and how far they are going. There seems to be an emphasis here with cars and parking lots, but less
than 100 yards from the northern-most point, Conseco has abuilding with over 600 employees who
would love to be able to walk during lunch or throllghout the day. We are only talking about
perhaps another 80 yards of walkway, but that requires cooperation and consideration with
Meridian Technology Park. It would be of benefit not only to the City but also to the retail efforts.
Steve Stromquist asked about the west retention pond and said it seems out of place. Steve
suggested putting it up in the comer.
Zeff Weiss responded thatthe retention has been somewhat of a challenge on this site. The
petitioner is trying to landscape around it, dress it up, etc. Weare trying to be sensitive to it.
Ultimately, it is the way the land drains to the east.
Madeleine Torres questioned the outlot area-built at a future date?
ZeffWeiss responded that the petitioner will retum to the Commission for ADLS when the outlots
are brought forward, and that will include the parking. There is a little flexibility to address both
how these are carved up as well as parking when the specific use is known. The outlot users will
have their own parking area.

Additional Department Comments, Matt Griffin. There is a little design work to be done;
walkways, parking, etc.
Jerry Chonianczuk wanted to see a commitment from the City regarding the parking. Jerry
suggested that the petitioner retum to the special meeting of the Committee now scheduled for
September 29th.
ZeffWeiss responded that there are 120 parking spaces inside the units, 120 in the driveways. In
addition, there are 38 guest parking spaces. Also, the petitioner was considering a stamped,
concrete walkway and thjs should probably have been shown on the site plan. Zeff Weiss said he
would double-check with Mike Wells to see ifhe has addressed the residents in Technology Park.

The applicant seeks approval for a medical office building.
The site is located at the SW comer ofCanne1 Dr. and Guilford Rd. and is zoned M-
3/Manufacturing.

Mary Solada, attomey with Bingham McHale appeared before the Committee' representing the
applicant. Also in attendance: Russ Boyer, project manager for Bremner & Wiley, Bob Doster,
Schneider Engineering, and Dan Gmbert, CSO Architects.
The petitioner is seeking approval for a medical office building at the southwest comer of Cannel
Drive and Guilford Road. The property is zoned M-3/Manufacturing and is within the Carmel
Science and Technology Park, Block 11.
The initial site plan has been revised to provide for a smaller building, (primari Iy masonry) reduced
by approximately 10,000 square feet, and the orientation of the building has been pivoted more to
the east and actually works better on the site and provides more of a front entrance facing Carmel
Drive.
Regarding the pedestrian circulation around the site, the project team has met with the City
Engineer and the Assistant City Engineer. The petitioner is willing to cooperate with the City
Engineer's office as to their desire-sidewalk or a multi-use asphalt, walking path.
In temts of vehicular circulation, the intersection of Carmel Drive and Guilford is slated for some
major reconfiguration in 2006. One ofthe requirements of the City Engineer's office and the
Department is necessalY right-of-way dedication as wen as some usage of the pond to accommodate
those intersection improvements. The petitioner is actually intending to purchase the pond and it
would be used for site drainage.
Full access points onto Guilford are plalmed with a right-in/right-outonly on 1221ld Street. The
access on Carniel Drive has been explicitly discussed with the City Engineer's office and Mr.
McBride has no objection and is actually in suppoli. The access point is clear of the planned
medians that come down Carmel Drive and there is ability for full access.
Currently, there are two variances proposed for signage for this site that are to be heard at the
September 26th BZA meeting. The variance would be to allow two wall signs on the same
elevation and for a directory sign to be one foot higher than permitted.
At the moment, the planned use for this propeliy is mixed retail, perhaps a bank and a restaurant,
small shops etc.
