BPW-06-18-08-01 PUBLIC SAFETY ASSISTANCE FROM THE CITY OF LONG BEACH MISSISSIPPI WHEREAS, the City of Long Beach, Mississippi ("Long Beach"), was ravaged by Hurricane Katrina and is still in need of additional public safety vehicles in order to better protect the health, safety and welfare of its citizenry; and WHEREAS, the City of Carmel, Indiana ("Carmel"), desires to assist Long Beach in its hour of need;and WHEREAS, Carmel is the owner of one (1) Fire Department.Administrative Vehicle ("Vehicle") that has recently been taken out of service and are therefore of no further use to Carmel, which Vehicle is identified on Exhibit A, attached hereto and incorporated herein by this reference; and WHEREAS, in exchange for the transfer of the Vehicle, Long Beach has agreed to make available to Carmel for consultation certain of its officers and officials who were involved in the preparation for and response to Hurricane Katrina and its aftermath ("Public Safety Assistance"), so that Carmel can learn what issues were faced and resolved by Long Beach, and therefore better ensure that Carmel's own emergency management policies are at the highest level of preparedness; and WHEREAS, Carmel will transfer and Long Beach will accept title to the Vehicle in an "as is" condition, with no guarantees nor warranties as to the fitness of same for any particular purpose or use, or otherwise, and Long Beach, upon its receipt of the Vehicle, will thereafter be solely responsible for the operation, maintenance and insurance of same; and WHEREAS, Long Beach will, by separate materially identical resolution, authorize and agree to accept the Vehicle in exchange for the Public Safety Assistance; and WHEREAS, Carmel and Long Beach now desire to exchange the Vehicle for the Public Safety Assistance subject to the terms and conditions of this Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works and Safety of the City of Carmel, Indiana, as follows: 1. The foregoing Recitals are incorporated herein by this reference. 2. The exchange of the Vehicle by Carmel to Long Beach and of the Public Safety Assistance by Long Beach to Carmel is hereby approved pursuant to and in accordance with the terms of this Resolution. Page One of Two Pages 1 That Stephen Engelking, on behalf of Carmel, is hereby authorized and directed to take such actions as are lawful, necessary and proper to effectuate the exchange approved by this Resolution.
