With the knowledge that the future Illinois St. would go to the west of the property, variances will be needed to have signs
facing east. Specifically, number of signs and two signs not facing a right of way. Typically the City does not encourage
signs to not face a public right of way. Perhaps your ground sign could be moved so that it faces 106th St. perpendicularly,
instead of parallel and your signage needs could be met that way. We will discuss tonight with the Committee.

I'm confused regarding our proposed addition and your Docket No. 08040006 ADLS Amend. You identify in
your report the proposed Illinois St. is to be located just EAST of our property site. All plans and conversations
I have seen or heard of indicate Illinois St. (If ever actually constructed) would be to the WEST of our site. Our
site/property directly abuts the Farmers' Insurance property (To the east), and they are located on Meridain and
106th Streets. From all that I understand, it is not remotely possible to locate a street between the properties.
(Without demolition of one or the other)
With that, does that impact and/or change the need for a variance for our signage? Do we need to resolve this
issue prior to our June 3rd meeting/hearing?

Engineering has reviewed the plan for this project and is concerned with existing and
future access, encroachment of existing and proposed parking areas in the Thoroughfare
Plan right-of-way of 106th Street and impact from the future Illinois Street project.
We wanted to make you aware that the Department will recommend the following as a
condition of approval to the Plan Commission:
1. A commitment to abandon the existing access from 106th Street and accept access from
Illinois Street when Illinois Street is constructed.
2. A commitment acknowledging that no type of access will be provided to this property
from l06th Street when Illinois Street is constructed.
3. A commitment to release the City for compensation of loss of existing parking spaces at
the time of this approval provided that the City pays for the construction of a parking
lot that replaces 90% of the lost parking spaces on an area of land provided by the
petitioner.
4. A commitment to dedicate the right-of-way necessary for the construction of Illinois
Street when it is needed in the future.
5. A commitment to dedicate the right-of-way necessary for future 106th Street
improvements when it is needed in the future.
6. A financial commitment equal to the value to otherwise construct the required asphalt
path along the l06th Street frontage in lieu of physical construction required by the
Alternative Transportation Plan.
7. A commitment that the encroachment of the new parking spaces proposed as a part of this
project into the thoroughfare plan right-of-way on l06th Street shall be allowed until
such time as the roadway is improved and the exact right-of-way needs are established;
that any of these proposed spaces impacted by a future road project will be removed and
that there shall be no compensation for loss of these proposed spaces.

I am working on a building expansion for the Perkins VanNatta (Meridian Surgery Center) which you should have received
plans for on April 17th. It is located at 170 West 106th Street just outside of the Carmel City limits in unincorporated
Hamilton County. I have been asked by the planning department to show the proposed future improvements for the
roundabout at Illinois Street and 1061h Street. I have sent e-mails to Gary Duncan and to Craig Parks with American
Structurepoint and have not received a reply. Have you guys made any decisions as to the future alignment of Illinois
Street and the layout of the round-about that you could e-mail me CADD files to show on my plans? Any help would be

We received the TAC application today for this project We actually need the ADLS amenclrD8_nJ application instead, and
you are not required to submit plans to the TAC members for this type of project, nor attend as T AC meeting. But. if you
give me the word, I can add you the TAC meeting agenda anyway. That way, you can be sure thai the issues are
addressed regarding the possible road right of way dedication, path along 106th street, and the proposed roundabout at

Otherwise, you will only have to attend a meeting of the plan commission special studies committee, which does not

I think the bigger issue to consider here is the ramifications due to Illinois St. Any
expansion off the front of this building is likely to cause greater impact and cost when
we construct Illinois St. It is likely that the Illinois St/106th St. roundabout will be
constructed right on this properties SW corner. Additionally we will impact the parking
area that currently exists to the west of this building. Some kind of agreement should be
forced as a condition of this development approval to establish some kind of replacement
parking plan as well as dedication (to the extent possible) or commitment for future
dedication of right of way for the Illinois St. & 106th Street improvements. The
encroachment of parking into the right of way is not a big deal as long as it is
stipulated that this would only exist until the road improvements happen, at which we
would require all existing right of way and likely some additional. We could probably
force the Consent to encroach under authority of the Thoroughfare plan and Planning
jurisdiction. We have preliminary layout for the Illinois St. roundabout that we could
use to begin to identify the City's needs. Needless to say there are many issues related
to the Illinois St. work.
The path commitment vs. construction is fine.

The attached exhibit indicates the existing and proposed right-of-way as well as existing
and proposed improvements. This is on the north side of 106th Street, just to the west of
the corporate boundary.
They are proposing to eliminate the existing circular driveway, construct a building
expansion and create some additional on-site parking spaces. As you can see, the proposed
building expansion is outside of the TP right-of-way, but most of the proposed parking
spaces (including the access to them) are located in the TP right-of-way. Also, the TP
right-ai-way affects approximately 6 existing parking spaces as well as the existing
entrance, access to the main parking lot AND the proposed access to the remote parking
lot.
They are planning to be heard at the BZA (or maybe they have already been?) and then will
come back for DP/ADLS approval.
The plan does not indicate a multi-use path across the frontage but the petitioner has

I would not expect us to have too much issue with the encroachment into the 20-foot
setback and the building face being almost on the right-of-way line. There will still be
an offset from the travel lane (the planting strip, the multi-use path and then the
distance to the building) as well as barrier curb. Clear zone for roadways with barrier
curb is lO-feet or the right-of~way line; which in either case is satisfied.
The main issue is if a Consent-to-Encroach for the proposed improvements in the right-of-
way needs to be executed? Can the City require such an Agreement outside of the corporate
limits? If we cannot require a Consent-to-Encroach, can we make similar terms of a CTE a
condition of the BZA approval?
I would expect the terms of a CTE to include no remedy or compensation for loss of the
proposed parking spaces (or access to them if located outside of the right-of-way) in any
capacity, even if the loss brings the project into a zoning violation on parking count.
Could this be extended to the existing spaces that would be lost or is this stretching too
far?
Can we also stipulate that we will only provide one access at the location dictated by the
owner and that there would be no remedy or compensation for loss of the other access. Or,
would we be obligated to provide access to the remote parking area to the west because the
connection does exist today? Or does the proposed modifications to the existing drive
negate any "existing condition"?

David and I spoke to Gary Duncan yesterday about the sidewalk/ROW issues. It's my understanding that the sidewalk
issue would be brought up at the BZA hearing, but that the actual commitment to the thoroughfare fund would come at the
DP/ADLS hearing, before the Plan Commission. So, for Monday's hearing, we would just need to mention the issue, and
that it was being reviewed by Engineering and the Alternative Transportation Coordinator.

I spoke with David Littlejohn Wednesday afternoon (6120/07) after
our conversation and he confirmed the two suggested ways to address
the 10' paved pathway or the non-reverting thoroughfare fund. He stated
he would conference with you regarding possible solutions and yourlhis
recommendations and convey those to me. At this time, I do not have
any feedback from your offices and I am concerned due to the zoning
hearing Monday. We certainly want to provide the best and correct
information, if possible, however, with the very limited time available prior
to the actual hearing, it is questionable if we can perform adequately.
Please advise as soon as possible. Thanks.

Good morning, Dale:
Yes, you can apply for a variance for the building setback, It looks like the building addition will encroach into the bsl
approximately 18 feet? But will still be outside of the, proposed road right of way. (I do not have a to-scale site plan to
measure out the exact distance.) There might also be an issue with the new parking spaces you proposed that will be
located within the proposed road right otway. You might try contacting the city engineering office (Gary Duncan or Mike
McBride) to see if they are okay with that, or if you will need Consent to Encroach approval. Also, they might be able to tell
you their thoughts on having the proposed building addition so close to the proposed road right of way, and if the road
would ever be widened out that tar to those extents,
If possible - please send me another proposed site plan with the existi ng and proposed road rights of way, as well as the
building setback line, so that I can see how things layout on the site.

WOW! This information is disastrous and certainly not what I was told on Jan. 26, 07 by Christine Holmes
(Copy below) or Laura DeVore and
Lisa on Feb. I, 07. I was informed that the existing 90' (4S'lhal:f) RJW was/will be increased to 100' total and the
setback was another 20'
beyond that. This now-new information, if required for setbacks, and as shown on the 20yr. Thoroughfare Plan,
will terminate the project.
I have re-requested this setback information from Lisa Scott and she is attempting to provide this a.s.a.p.
Additionally, I spoke with Lisa and Laura
on 2/1/07 and they directed me to American Consulting Engineers regarding the Illinois St. project. I contacted
Craig Parks and he disclosed the project
was not remotely moving forward at this time and he e-mailed three plan scenarios, one of which encroaches
onto the Perkins property. Mr. Parks
stated that would not be a first option of the city. Angie, this is a shock. Can we obtain a variance? Anything?

As far as I know, the right-of-way has not changed, but you might want to verify with the Engineering department (571-
2441). The building addition would need to go through the DP Amend/ADLS Amend process, because the footprint and

square footage of the building will be changing. Staff and the Plan Commission will want especially to see the materials
used, and whether parking will be changed.

The next plan commission committee meeting is June 5. If you cannot attend the May 1 meeting, perhaps you
can send someone else to represent the project and speak on your behalf... a co-worker or someone who
represents the tenant(s).
Please show/label the proposed road right of way, per the Thoroughfare Plan, the road right of way is a 75-foot
half. The building setback line is usually measured from this r/w line. Also, do you know how Illinois Street will fit
into this site? It may be helpful to contact the Engineering office at 317-571-2441.
