RE: ZONING ORDINANCE VIOLATION — LAND USE
Dear Ms. Colvin:
This letter is being provided to inform you that our department has recently received several
concerns regarding 10230 Carrollton Ave., in Clay Township, a property listed under your
ownership. As my letter dated November 19, 2007 stated, this property is currently zoned
residentially (R1), which does not permit for business operations to be run from the property. The
Home Occupation standards of §25.18 of the Carmel Zoning Ordinance do make provision for
home businesses to operate from a person's residence, however, this provision is only available in
cases when the home is occupied as the person's primary residence.
Hamilton County property records indicate that your primary residence is at 11271 E. 700 N in
Sheridan, Indiana, therefore, the Home Occupation section of the ordinance does not apply to this
residence. ANY COMMERCIAL USE OPERATING AT THIS RESIDENCE IS AN ILLEGAL USE.
You have thirty (30) days from the receipt of this letter to cease and desist the illegal commercial
use of this residential property. Failure to do so may result in further enforcement action which can
include an appearance in Carmel City Court and the assessment of fines. Please feel free to
