development, and the willingness of Hearthview to adequately screen the development
from the surrounding homes.
Having reached an impasse, we have been forced to reconsider Hearthview's project in
its entirety. As the proposed bank/professional office complex is a duplication of what
Westfield and Noblesville arc constructing all along the north side of 146th Street in our
area, we do not see this development addressing a pressing need for north Cannel; there
is certainly no necessity for erecting it in our back yards.
Weare being asked to sacrifice privacy and property value - not for the good of the
community - but for the benefit of Hearthview Residential, who will take their money
up front and move on, leaving the residents to deal with lengthy construction, as well as
increased traffic, drainage, noise, water safety issues, and any problems arising from the
multiple landlords who may take over the property. We invested in our neighborhood
years ahead of Hearthview, and asking us to sacrifice to bailout Hearthview's investment
in this property is both unwarranted and grossly unjust.
Therefore, we remain opposed to any change in zoning for this property and urge you to
vote against this proposal.

Dear Planning Commissioner,
We urge you to deny the petition to rezone the property at 146th Street and Gray Road.
Hearthview Residential's proposed bank/professional office complex offers minimal benefit for
north Carmel. Indeed, recent and ongoing construction on the north side of 146th street in this
area has already made Hearthview's plans superfluous. In plainer words, you can barely
swing a dead cat (not that we would) in that neighborhood without hitting a bank or office.
There is certainly no necessity for building this additional development in our back yards.
We nearby residents of Woodfield invested in this area long before Hearthview. Hearthview
will get its money upfront and move on, leaving us residents to deal with any problems. To ask
us to sacrifice privacy and property value for the sake of Hearthview's investment gamble is
both unwarranted and totally unjust.
We hope you will vote "No" on the rezone.

We are asking you to deny the rezoning request of Hearthview for the corner of 146th St and
Gray Rd.
We invested in our homes and our neighborhood years ago and we feel that the proposed
development will have a negative impact on our home values and on the neighborhood. We
have compromised with Hearthview to allow an office park but we are not satisfied with their
current plan that includes a bank. We have asked for a plan that does not include a
bank and a much smaller development. We are also not satisfied with the screening of the
development. The increased car traffic, lighting and parking will be clearly visible from our
homes. These concerns have continued to not be adequately addressed.
For these reasons we are asking you to deny the rezoning request for 146th and Gray Rd.

lbis is to inform you that the surrounding neighbors owning homes with values in excess
of 8 million dollars and the initial 250 petitioners are not in favor of this development.
As requested by the Chairman of the subcommittee our group provided an alternative
solution from S-l to allow for a Professional Office park. As a result of our good faith
compromise we found ourselves at the last meeting begging fOT an adequate buffer,
bigger trees and fencing. Why does Carmel need a Bank at this Corner? If the
development doesn't work financially without it THEN DON'T DO THE
DEVELOPMENT. Please consider the residents investments and hear the concerns
from the Citizens of Carmel and vote NO to this proposal as it is presented this evening.

I am writing to encourage you to vote NO on the proposal set forth by Hearthview.
As residents we have been asked to compromise our quality of life, our home values and
our mere safety with this development so that Hearthview can make a profit. We did
offer a compromise to Hearthview and it was ignored because their profit wouldn't be
large enough. The business park needs to be smaller, further away from our homes and
we need immediate screening.
No one in the community needs or wants this business park but, for some reason we
have been pressured to go along, why? These are our family homes, not a business and
we purchased them knowing that the land behind us was zoned residential by the city of
Carmel. But we are now pressured to go along so Hearthview can make a profit. Please
protect our quality of life.
Please vote NO on this development.

I am the President ofthe Woodfield Homeowners Assoc. [represent 186 homes in the Woodfield sub-division that is
located on the northern edge of Carmel with entrances on both 146th St and on Gray Road.
I last spoke to the Commission at the Sept 18,2007 Plan Commission Meeting. At that time, I and several Cannel
residents brought up numerous objections to this development. I must admit that Jim Thomas and the Hearthview team
have worked hard to address those issues.
At the recent April 1st Special Studies Committee meeting, the adjoining Woodfield neighbors were prepared to
compromise and accept this project in their backyard. The 3 final requests on the table were:
1. Move the development further northwest and the bank branch would then be acceptable.
2. Reconfigure the site plan to permit sufficiently sized berms and sufficiently sized trees to shield the adjacent residents'
view of the complex.
3. Provide fencing around the retention pond.
Of these final 3 requests, only one was granted, the fencing. The requests to move the development away from the homes
and to install the berms were rejected.
Please allow me to bring this development into perspective.
This development is about rezoning and changing the character of a residential area. The property is bordered by homes on
two sides. A commercial development on this parcel is not congruent with the nearby residential areas nor would it provide
services that are not already available nearby.
Accepting this development in what is now a residential area is very difficult and unsettling for these neighbors. TheiT
home values are threatened. Their lifestyle may also change since the privacy of their back yards will be impacted. As you
vote this evening, ask yourself "Would I want this development in my backyard?" and "Is this the proper use for this
highly visible property?"
The bottom line here is that Hearthview Residential is asking these neighbors to accept a commercial development and the
inherent risk of declining property value for the developer's benefit. What benefits are included in this rezoning and
commercial development for the neighbors?
With all the hard work that both parties put into this project, I hoped that I would be able to support the rezoning of this
property. However, in good conscience r cannot. I strongly urge you to vote No on this rezoning request.

1. Number of Lots: The Real Estate shall be developed with a maximum of eight (8) lots and one
Block to be known as "Block A".. No buildings or structures, except for underground utilities,
drainage improvements or fencing as shown on the Primary PLat, shall be permitted in Block A.
2. Building Area: The total area of all buildings to be constructed on the Real Estate shall not
exceed 80,000 square feet of gross leaseable area. No individual building shall exceed 15,000
square feet of gross leaseable area.
3. Building Height: No building on the Real Estate shall exceed one-story in height.
4. Use Restrictions: The use of the Real Estate shall be limited to the following:
Office Uses: Retail & Service Uses (as limited below):
General Offices Financial Services/lnvestment Offices
Professional OfIJces Real Estate Companies and related services

6. Architectural Design Requirements:
a. Materials:
(1) A minimum of three (3) materials shall be used for building exteriors chosen
from the following list: stone, brick, split face block; architectural pre-cast
(panels or detailing), architectural metal panels, glass, ornamental metal, wood
or EIFS.
(2) EIFS shall be limited to trim pieces and/or portions of the far;ade located eight
(8) feet above grade.
(3) A minimum 01'70% of the building exteriors (exclusive of roofs, doors,
windows and gables) shall be stone, brick or split face block.
(4) Similar building materials will be used on all four (4) building facades.

9. Signs:
a. Freestanding Signs: All freestanding signs, including identification signs and directory
signs, shall maintain a consistent design theme, using similar materials and colors for
each sign structure. The final design of all freestanding signs shall be subject to the
ADLS process.
b. Wall Identification Signs: All wall identification signs:
(1) shall be restricted to individual letters or logos;
(2) shall not be permitted on the south facade of buildings l.ocated on Lots 5,6, 7
and 8 as depicted on the Primary Plat; and,
(3) shall not be permitted on the east facade of buildings located on Lots 5, 6, and 7

1. Staybridge and Legacy Towns and Flats. We have no issues with these going to committee; as I assume
they will. We have commented on each of these and are awaiting responses-but had no significant issues.
I was late getting the T AC COlllmenLs out which is why they have not responded to date.
2. 146th and Gray Waiver. We have no issues with this going to committee or if the Plan Commission votes
to approve the waiver.

rQ)');4Gth and Gray Primary Plat-We win have no issues with approval provided such approval is conditioned
~pon working out any unresolved issues with Engineering when the Secondary Plat or Construction
Drawings are filed. There are three items: (1) Formalized cOlmnitments for Tlloroughfare Plan
improvements. The latest response letter indicates that the petitioner will provide the necessary
commitments. We have not seen the documents, however; (2) The petitioner shall acknowledge at the
meeting that the Minimum Lowest Adjacent Grade shall be considered in addition to the provided
Minimum Flood Protection Grade in the final design and that the City will review the highest noted
elevation of the adjacent flooding source (the Mitchener Ditch and the proposed detention facility and the
overfloW weir elevation); (3) the Secondary Plat shall comply with the easement requirements of the
Storm Water Technical Standards Manual and the Subdivision Control Ordinance. Perimeter easements
per the SDeO are not provided. Even though the drainage is expected to be a private system, celtain
easements may be required over the storm piping if right-of-way drainage is conveyed through the piping
system.
5. Holiday Inn-The Department has no issues with the approval of this project. There may still be some
items to be resolved on the final constmction plans; but as a whole, the Department no longer has any
issues with the development plan.
6. Old Meridian Plaza-There are still issues related to access and the opposing curb cut modifications that
need to be addressed before Engineering provides a favorable recommendation for approval. We may
have these items worked out prior to the meeting and will notify you if we do. I am also uncertain if a
shared access easement has been indicated to allow a shared access for future development to the south.

1) Allow the bank if you believe 11 banks in a 2 mile radius is not sufficient for the
area, delete the dry cleaner, move the development to the Northwest and
reduce the square footage.
2) Move the site plan to allow for a proper buffer including Berms, fencing and
trees. The restrictions on planting or construction of fencing in a flood plain or
easement area would be eliminated if you move the development to the
northwest.
3) The Fencing around the development and specifically the retention pond is
essential whether the pond is dry or not. There is an' autistic chiid that iives
adjacent to the sIte and this is a health and safety issue. (Please see the

Autism and Water Safety
Autism is the fastest growing children's disability in America. Much has been
reported about Autism and the spectrum of Autism Disorders (ASD) recently
In the news but many of us still don't understand that much about it unless we
are directly affected. With current statistics, it is likely that you either know
someone directly who is on the ASD spectrum or you have a neighbor who
is. For this reason, we should all be aware of the unique risk these children
face in regards to open water.

children, and most children are already fascinated by water! This
includes lakes, ponds, stream, fountains... just about any source of
water.
f;lt is known that drowning is one of the leading causes of death in
Autistic children nationwide.
t'AutistiC children are generally unaware or not understanding of dangers
around them. This can include water depth, water temperature, current,
steep slopes, slippery slopes, and confined spaces (culverts and
drains).
As most neighborhoods have retention ponds, spillways, and fountains, there
are a host of dangers for many of these children. Take the following into
consideration in your neighborhood:

t'lf you see a child alone near water. try to make contact to see why tl1e
child is there and where they should be.

meaning that they repeatedly attempt to leave whatever area they are
in. Commonly the parents will have installed many locks and fences but
these children are masters of escape and evasion. This is not a
reflection on the parents ability to control the child, merely and
unfortunate side effect of Autism.
f:'lf a caretaker can't be located quickly and the child doesn't seem to
respond, keep a close watch on the child and send someone for help.

t1)lf the child is in .imminent danger of entering the water it may be
necessary to intervene. Autistic children resist restraint with tremendous
force and agitation. You may not be able to hold the child but do what
you can to keep them out of the water.
!('If you have an Autistic child, consider printing flyers to educate you
neighbors (particularly those who live near the \ivater) on your child's
tendencies and how to contact you quickly.
An autistic child can slip away from his or her home or yard without anyone
noticing for many minutes. If that child finds a source of water he or she may
end up in it with know knowledge of the danger they are in until it is far too
late. Do your part to intercede anytime you see a child near a water source
that may be dangerous. If you have an autistic child be sure to let your
neighbors know what to expect, even if they've never shown an interest in

What is a "Retention Pond"?
A retention pond is a body of water that
is used to collect storm water runoff for
the purpose of controlling the release of
this runoff. Retention ponds have no
outlets or streams, creek ditches, etc,
Water collects and then is released
through atmospheric phenomenon such
as evaporation or infiltration.
'v^v'hat is the difference between a Re~ention pond and a Detention pond?
The biggest difference between a detention pond and a retention pond is that a detention pond has
an outlet such as a pipe that discharges water to a stream. A detention pond is a body of water
that is used to collect storm water runoff for the purpose of controlling the release of this runoff.
The pipe that a detention pond contains is sized to control the release rate of the storm water
runoff.
Both retention ponds and detention ponds can be located in your neighborhood, so be sure to
apply the safety rules to both types of ponds. Both can be dangerous. .

Reducing the lane width around the building to 14' sounds fine. Our main concern was reducing the amount of
impervious surface and increasing the amount of land available for landscaping/screening, and possibly moving the
building a bit closer to 1461h Street. 14' should provide plenty of room, and it will bell out a stacking space or two before it
actually gets to the drive-throughs, right?

The packets should have been submitted today with the revised drawings and commitments.
Just a few notes on the items below.
o We added the table to the plat to show the setback lines for each lot. This was a lot cleaner than actually
showing the lines on the drawings.
o We added the bufferyards onto the Plat. All were required to be Type D based on my reading of the ordinance.
If not, we can change that.
o For today's submittal we were not able to get the lane to the drive-through narrowed. This is a possibility
however J would like to know what you are comfortable with in terms of the width of that lane. We would at least
like to keep it at 14'. Please note thai moving this will make that lane not align with the access to the south. Let
me know what you would like and we can try to get a change made prior to the Department Reports being sent
o We are meeting with the neighbors next week and hope to come to the committee meeting with the final
resolution to the wall/landscape buffer area

After discussing your questions with Angie and Christine this is what we have decided:
The locations of the various yards and the building setback lines are correct, except for Lot 4. Please
show/label the 15' BSLalong both of the rear lot lines of Lot 4, Also, please label the rear yard setbacks for
Lots 6 and 7 an the primary plat. They were not labeled on the document you sent.
While there are a lot of setback lines, we would still like you to show them on the primary plat. The only other
option is making a note an the primary plat with some sort of wording that states that all setbacks for all lots
will be according to section 12.04 of the zoning ordinance and possibly listing them. Of course, you would
need to formulate a better way of wording that. Either way, it needs to be stated on the primary plat.
The revised bank location is preferable so long as more landscaping is provided to buffer the drive lanes form
Gray Rd. and 146th Street. We were also wondering if you could make the drive lane along Gray Rd and
146th narrower and then it could widen once it reached the stacking lanes on the eastern portion of the lot.
This would allow the building to be moved closer to the corner.
Please show the bufferyards on the preliminary landscape plan or make a note on the plan similar to the note
mentioned above.
We are comfortable with the length of the wall between lots 5 and 6 being shortened. Also, if you choose to
shorten the length of the wall, please increase the landscaping between lots 5 and 6, including adding some
overstory trees instead of only evergreens. This will provide a better buffer for the neighbors.
Please be sure to add the docket number to the primary plat.
Please be sure that the half road rights of way are labeled on the plans.
Please provide a subdivider agreement form if you have not already done sa.

They're missing a setback Iirie on the far SW corner, and I'm not sure why the arrow-shaped parcel doesn't have setbacks
on the pointy section, especially adjacent to the neighbors. I'm guessing it's the retention pond, but it still needs to show
setbacks.
As far as the wall goes, I'm fine with it being pulled back, as long as they increase the landscaping there, which it looks
like they've done.

What do you guys think? Also, on the plan with the landscaping, you can see that they have added some more
landscaping near the retention pond on the southeast corner and decreased the length of the wall. Now one of the
neighbors wants the wall back and to go all the way to the pond like it did. Are we ok with the wall not extending all the
way to the pond?

Good to meet with you this morning. Hopefully you can work out the buffering issues with the neighbors and the drlve-
thru routing with the staff and plan commission.
I would recommend large Norway spruce trees, a mixture of sizes: some 8'-10" and some larger 12"-14", and a few big
ones - 18"-20". Suzie Dubois might have a line on some for you; she planted some for the City this winter. It would add
some instant dimension to your project once construction starts.

Many of the larger ones, I would plant in a line just to the north of the grade wall (to give them added height) and block the
neighbor's view as much as possible. I would intersperse those with some London plane trees (look like sycamores)
which are fast growing and get large.
Let me know if I can do anything else. For the hedge screen for the front (to block the view of the drive-thru), I would
recommend medium sized native shrubs and ornamental trees, and I'll attach a list:

After discussing your questions with Angie and Christine this is what we have decided:
The locations of the various yards and the building setback lines are correct, except for Lot 4. Please showllabel the
15' BSL along both of the rear lot lines of Lot 4. Also, please label the rear yard setbacks far Lots 6 and 7 an the
primary plat. They were not labeled on the document you sent.
While there are a lot of setback lines, we would still like you to show them on the primary plat. The only other option
is making a note on the primary plat with some sort of wording that states that all setbacks for all lots will be according
to section 12.04 of the zoning ordinance and possibly listing them. Of course, you would need to formulate a better
way of wording that. Either way, it needs to be stated on the primary plat.
The revised bank location is preferable so long as more landscaping is provided to buffer the drive lanes form Gray
Rd. and 146th Street. We were also wondering if you could make the drive lane along Gray Rd and 146th narrower
and then it could widen once it reached the stacking lanes on the eastern portion of the lot. This would allow the
building to be moved closer to the corner.
Please show the bufferyards on the preliminary landscape plan or make a note on the plan similar to the note
mentioned above.
We are comfortable with the length of the wall between lots 5 and 6 being shortened. Also, if you choose to shorten
the length of the wall, please increase the landscaping between lots 5 and 6, including adding some overstory trees
instead of only evergreens. This will provide a better buffer for the neighbors.
Please be sure to add the docket number to the primary plat.
Please be sure that the half road rights of way are labeled on the plans.
Please proVide a subdivider agreement form if you have not already done so.

Kevin was uncomfortable with approving outright before the BZA had seen it, so he withheld his vote for approval. The no
recommendation vote was unanimous, though. Apart from that, there weren't really any outstanding issues on that one.
They'd still like to see elevations showing the building from Michigan Road, though.
And the petitioners for the 146th St rezone have agreed, verbally at least, to eliminate all retail components from their
request. Office only, and they're going to meet with the neighbors again. I was wondering last night, with this going
forward and our positive recommendation, and also the church nearby, can we have a negative recommendation again for
Furry Friends? I was going to go with the same recommendation we've had before, especially since now she's not really
living there, but there are more commercial uses along 146th than there were last time she applied

The staff report as drafted is good then (Thank you and sorry for not getting back with you this morning). To approve the
Primary Plat We at least need a response and revised drawings incorporating any other issues besides access. They also
need to acknowledge the request for Thoroughfare Plan commitments and other right-of-way improvements.
No comments on the traffic study. While r still have not seen the study itself, our main issues were access locations. The
County will likely need the traffic study if they ever modify the signals at 146th and Gray.
Did the traffic study make any specific suggestions for improvements to the road network resulting from the re-zone?
From Carmel's standpoint, the only thing it might conclude is the need for a SB left turn lane on Gray Road. I think the
anticipated NB stacking at the intersection does not come as far south as the proposed entrance.

Attached is the latest landscape plan. We added several trees, particularly evergreens, along the eastern edge of
the entrance drive from 146th Street in order to provide an additional buffer. The entrance drive on Gray Road
has been moved south from the original plan and closer to our preservation area due to requirements of the
Engineering Department.
In the commitments, which Angie should have tbe latest version, we have committed that we will not clear trees in
the Block A area. Below are the various commitments we have already submitted far the landscaping. Let me
know if this is what you had in mind. The statement regarding the Mitchener Ditch was required by the County
Surveyor since he has jurisdiction to require clearing around the ditch
Landscaging:
146th Street Frontage and Gra}{Road Frontage: Frontage landscaping
shall, at a minimum, comply with the requirements of Section 26.04.06 of
the Carmel Zoning Ordinance, and shall be subject to final design approval
through the ADLS process.
Tree Preservation / Buffer Area: All trees located along the south property
line and within Block A, as depicted on the Primary Plat, shall be preserved

except for: (i) dead or diseased trees; and, (ii) those trees located at the
southeast corner of the site which must be reasonably removed to

The purpose of this letter is to infolm the Plan Commissioners about progress to date in reaching a compromise'
solution for the subject rezoning proposal and the related impasse betw-een the petitioner (Hearthview Residential),
Woodfield residents and the Woodfield I-lOA.
You may recall that I sent you a previous update on October 22 related to ongoing discussions between Hearthview
Residential and Woodfield residents. At that time I described the lack of progress towards reaching a compromise
solution.
Since that last progress report, several Woodfield residents and I met with Mr. Jim Thomas and his counsel on
November 16. The intention ofthis meeting was to determine ifMr. Thomas had reconsidered his original proposal
of requesting a zoning change that would permit the construction of retail, banking and office buildings on the
subject site. Pkase keep in mind that Woodfield residt:nts' position has been consistent. That is, we would not object
to property development as long as it fit within the current zoning classification (S-l).
Unfortunately, the revised proposal from Hearthview included only minor changes related to building repositioning
and vehicle entrances but failed to provide a compromise that homeo\Vners could embrace. In fact, rather than
reducing the amount of combined retaiJ/office space, an additional 7,560 sq. feet of office/retail space was added to
Hearthview's new proposal since the original proposal was submitted to the Plan Commission.
Up to this point, Hearthview has contended that this property has no viable use other than some mixtllfe of retail and
office buildings. However, Hearthview has not presented any indepcndent analysis of the site that supports B~l
zoning as the only viable option for this property.
Instead, it appears that Hearthview's is attempting to convince Woodfield residents that they should accept B-1
zoning as their only option and then negotiating an acceptable commercial complex that is economically feasible.
The affected Woodfield residents and the HOA do 110t believe that a B-1 zoning is a foregone outcome at this time.
However, based upon Hearthview's remarks during om discussions, B-1 zoning is the only zoning option that would
allow their development to be economically viable.
At this stage, I have little hope that Hearthview will consider developing this property within the current S-l zoning
classification. Based upon the cost of this land, which Hearthview stated they had under contract, only a retail/office
complex will ~.Ilon them to achieve an economically viable project. Thus, the impasse may not be overcome.
Regretfully, on behalf of the Woodfield homeowners directly affected by this proposed development and the
Woodfield BOA, 1 cannot support this project and ask that you reject the rezoning proposal.

You mayrecall thatI spoke at the Sept 18 Plan Conmlission regarding the rezoning request from Hearthview
Residential. Thi~proposed rezoning will have a significant impact on the Woodfield sub-division and especially our
fellow neighbors adjacent to the subject property.
At the Sept. 18 meeting, I brought up several health and safety concerns as well as the inappropriate placement of a
retail and office complex next to a residential area. During the period of public conunent therc was signilicant public
outcry in opposition to this rezoning.
Further, comments made by the Plan Commission members were also less that supportive. Referring to my notes,
the comments made by the Comn'1issioners included (my parapIIJasmg):
Probably only 15% of the trees can be removed because most of the trees ate mature.
A PUD (Planned Urban Development) may work here but it was not considered.
Retention pond is a concern related to location
Would like to see traffic study
Have trouble seeing this as a "village". Need to see more renderings. Renderings sho"1/n were not significant enough
for decision making.
Don't want a corner building with a drive thm
Avoid making development look like suburban sprawl
Significant impact to the area's current drainage issues
Proposed bank will have impact on the traffic flow
The request looks suspiciously like spot zoning

The Plan Commission then assigned this rezoning petition to the Subdivision Committee and was subsequently
tabled. This proposal is now scheduled, I believe, to be heard at the Nov. I Subdivision Committee meeting.
Since the Sept 18 nieeting, Hearthview Residential again reached out to our community and other nearby residents
that live on 146th Street and on Gray Road. We anticipated that Hearthview intended to listen to resident concerns
and work to arrive at a compromise solution. That is what the residents expected.
The meeting with Hearthview took place on Oct. 8 at the Hearthview Offices. The conference room was
overcrowded with apptoximate 25-30 people who were interested in hearing a new proposal from Mr. Jim Thomas,
President of Hearthview.
The meeting began with a lengthy dialog about the current traffic coneems at this intersection and the impact that
adjacent growth in Westfield and Noblesville will have on the traffic flow though this intersection. Mr. Thomas
assured us that a traffic study done by A&F Engineering had been completed in July 2007 and the consultant had
determined that this intersection could handle the additional tralIie. Skepticism prevailed in the audience. Residents
noted that the study had been done during the summer months, when traffic on 146th Street is lighter due to school
recess and vacations. We asked for a copy of the tratTic study. None has been proved to date.
Mr. Thomas then proceeded to explain why alternative special land uses within the same zoning classification would
not work at this location. Unworkable projects specifically mentioned included a church and a day care center. He
then resurrected the same development plans and renderings that had been previously proposed. Homeowners asked
if Hearthview had any new ideas for this property. Mr. Thomas said no. At that point, several residents left frustrated
that Mr. Thomas had not attempted to reach any compromise. Mr. Thomas subsequently stated that his project
would not be economically feasible without including retail in the plan. He also told the attendees that the Dept of
Community Services staff had suggested retail be included at this site. Retail use is one of the primary objections
that residents have against I-learthview's proposal.
I understand that these developm.ent issues require a great deal ofwotk and insight and look forward to the Nov. 1
Subdivision Committee meeting in hopes of moving closer to a responsible compromise. I am, at the same time,
concerned that the currentimpasse with Hearthview may delay this compromise. I etnailed Mr. Thomas about one
week ago and offered to set up another neighborhood meeting prior to the Subcommittee meeting on Nov. 1. I-Ie has
not responded to my invitation.

architecture, and addresses the neighbors' concerns. The Land Use Plan Map within the Comprehensive Plan shows this area of Clay Township to be considered

Regarding the first reading of a proposal to rezone the lot (11.6 acres) at the Southeast corner
of 146th and Gray Road from S-1 Residential to B-1 Commercial, we are concerned about a
number of traffic, drainage, and quality of life issues related to the current plans for this
property. We are the owners of adjoining property and our specific concerns are:
1) To the North of the development is a landmark church and residential property zoned 3-1,
but there is woefully inadequate provision for a landscaped boundary between them and the
development. Indeed the churchgoers and residents to the North will have an unobstructed
view of the development's garbage storage and pickup facilities. This church is a national
historic site and a neighborhood treasure. Clearly, the church and cemetery deserve much
more protection than this design offers.
2) Patrons of the development exiting to the North can cross the eastbound lane of 146th
Street and make a left turn into the westbound lanes. Overtime, reckless people making this
highly dangerous maneuver will likely cause numerous catastrophic accidents and consequent
traffic delays. We submit that this risk is not totally preventable by "Right Turn Only" signs or
even traffic lights.
3) Runoff from cars in the parking lot containing oil drips, antifreeze overflow and other
pollutants are likely to enter the holding pond and eventually make their way into the

watershed to the West.
Untll these issues are adequately resolved through negotiations with the church, neighbors,
highway planners and environmental planners we urge that the property zoning remain 8-1.

I would like to thank Hearthview Residential and its attorneys for meeting with Woodfield residents on August 1-4-(0/
explain the proposed I 46tl1 and Gray Rd. project and rezoning proposal. I believe the meeting was successful and
the attendees left with an adequate understanding of the development being proposed and the business rationale
supporting this project.
The Woodfield HOA believes that development of the southeast corner of I 46lit and Gray Road is inevitable and we
do not stand in opposition to development. However, that development must be congruent with surrounding
neighborhoods and complement ~xistin~ development. In addition, que care is required to set the appropriate
precedent forfutureproje!'ts~19l)g 1.49"oSt.
NotWithstanding, the gclodfuteniions of'the developer, we believe that this project is'flawed.
We have several health and safety concerns regarding this project that the Plan Commission should carefully
consider before any zoning change is approved. They are as follows:
I. With the widening of 146th Street several years ago, the traffic on this road has increased signiticantly such that it
is now a heavily traveled east-west four lane county road. In addition, Gray Road carries a significant amount of
traffic to and from Carmel's east side subdivisions. As a result, the 1461h and Gray intersection has become a heavy
traffic zone and traffic backups are common during various times oftheday. At our meeting with Hearthview, we
were told that a traffic study had not been completed and therefore, we have no idea how the planned entrance and
egress fromthe proposed development w.ill affect the busy 146th and Gray intersection. We understand that a traffic
study may have been cOlupleted'but we are not aware of its findings or recommendations.

Street. Based upon the proposed exits and the concrete median on i46th Street, the only possible and most
expedient entrance to the property during an emergency will be via GrayR,.oad. In this regard, the entrance,
as currently designed, will hinder police and fITe protection response during heavy traffic periods since
traffic regularly backs up on northbound Gray Road at 146th Street. The northbound right turn lane on Gray
Road as shown on the proposed plat is not long enough or wide enough to permit prompt emergency
vehicle access during heavy traffic periods.
b. As previously noted, this intersection is quite busy and traffic moves at a high speed east and west along
146th Street. As currently depicted, there is no decelleration lane or acceleration lane on 14610 Street to
permit safe entry and exit from the site. Further, the proposed exit from the site onto 146tl. street includes no
island to prevent motorists from turning the wrong direction on to 146th Stre,et. Finally, the 146th Street curb
cut on the. plat drawing is,directlYllGt'ossthe traffjccurb llnq i$Ial1d in tbemidqleqf I 46th Sg-eet,which

d. i don't know if tile Plan Commission members are very familiar with this intersection. For your
information, both sides of Gray Road at 146lh Street are steeply sloped towards the north or south. This
natural contour oHlle land presents a significant safety hazard tor drivers on Gray Road turning onto 146lh
Street. [n this regard, a sight distance study should be done at this intersection to assure that the proposed
multiple buildings and traffic changes will not increase accident risk to motorists.
3. Drainage on this property is also a concern. The property currently slopes to the southeast from the 1461h and Gray
intersection and drains into Mitchner Ditch. Cllnently, Mitchner Ditch floods some of the properties that it passes
during various times of the year. With the significant paving required to support the proposed retail, office and bank
complex, the developer has not shared any drainage studies or assessed the drainage impact on the Mitchner Ditch or
the surrounding properties.
4. The residential properties adjoining the proposed development are shielded from the development by deciduous
trees. During the fall and winter the proposed complex would be clearly visible from these homes as would the
homes be visible from the proposed development. Further, the neighbors along the south and east borders of the
development will only be a few hundred feet or less from buildings and parking. As a result, strangers will have a
clear view and access to the back yards of these nearby residents. In addition, these strangers can easily be hidden
from street view by the low lying landscape of the property and the multiple buildings being proposed. This is a
significant safety eoncem. The proposed complex provides excellent access to the nearby upscale homes for
criminals, vagrants and delinquents and the wooded area provides good cover. No security planning or site
monitoring has been proposed by the developer.
5. The proposed plat includes a retention pond. Currently, one of the families whose property adjoins the property to
be rezoned has an autistic child. The proposed pond poses a significant hazard for this child since this child is
attracted to water. This family should not be required to guard this child from the potential pond hazard in order to
accommodate the proposed l:lUsiness develQpment.

6. The project intrudes into a residential area on a property that was not planned for commercial development. While
we recognize that the I46th St corridor has changed over the last few years, there is no reason for the Plan
Commission to set a precedent by changing the zoning of this property from single family residential to commercial.
As you know, there are other permitted uses under the S-l zoning classification. Some of these alternatives include a
church, a medical clinic, a pre"schoolfacility, a single estate or multiple estate type properties. All of these
altemative uses within the S-1 zoning are acceptabie to Woodfield residents and would result in effective use of this
property, prevent the deyelop~entfrom intruding on the area's residential character, and provide a significant
financial return to its cqrrent o}yners.

8. The Plan Commission should.be aware that we have asked Woodfield and other nearby residents to opine on
whether they were opposed to the rezoning of this property from S-I. Our online petition attracted 242 signers total.
Of those 242 signers, ] 20 were Woodfield residents. I encourage the Plan Commission and the developer to read the
petition signer comments. I have attached the results of the petition to my remarks for your review.
9. Prior to our meeting with the developer, their legal counsel shared Draft Proposed Commitments for this property.
These commitments were not reviewed during our meeting with the developer on August 14 Ul. This needs to be done
so that all Woodfield and surrounding residents fully understand the development proposal. In addition, we request
the following additional commitments be included for any development of this property:

community to the site planning meetings in order to include any residents interested in providing their
input. Recent invitations were sent only to selected residents as required by law.
Finally, it is my understanding that the Carmel Comprehensive Plan was last reviewed in 2006 and this review did
not result in a rezoning of this parcel. As you know, the rezoning to B-1 provides the developer significant latitude
to conduct multiple types of businesses on this property, many of which are likely to be problematic for nearby
homeowners: In this regard, a reasonable person may conclude that this is a spot zone requested purely for the land
owner's and developer's economic gain and not in the best interest of our community. Please consider this
possibility during your deliberations.

Regarding the first reading of a proposal to rezone the lot (11.6 acres) at the Southeast corner
of 146th and Gray Road from 5-1 Residential to B-1 Commercial, we are concerned about a
number of traffic, drainage, and quality of life issues related to the current plans for this
property. We are the owners of adjoining property and our specific concerns are:
1) To the North of the development is a landmark church and residential property zoned S-1,
but there is woefully inadequate provision for a landscaped boundary between them and the
development. Indeed the churchgoers and residents to the North will have an unobstructed
view of the development's garbage storage and pickup facilities. This church is a national
historic site and a neighborhood treasure. Clearly, the church and cemetery deserve much
more protection than this design offers.
2) Patrons of the development exiting to the North can cross the eastbound lane of 146th
Street and make a left turn into the westbound lanes. Overtime, reckless people making this
highly dangerous maneuver will likely cause numerous catastrophic accidents and consequent
traffic delays. We submit that this risk is not totally preventable by "Right Turn Only" signs or
even traffic lights.
3) Runoff from cars in the parking lot containing oil drips, antifreeze overflow and other
pollutants are likely to enter the holding pond and eventually make their way into the
watershed to the West.
Until these issues are adequately resolved through negotiations with the church, neighbors,
highway planners and environmental planners we urge that the property zoning remain 5-1.

On behalf of Hearthview, we request that Docket Numbers 07070003 Z and 07070004 PP, petitions
to rezone and primary plat an 11.6 acre parcel on the southeast corner of 146th Street and Gray
Road, be continued from the August 21,2007 Carmel Plan Commission meeting to the September
18,2007 meeting, This request is due to confusion from interested parties as to the correct hearing
date as legal notices and the sign posted on the site referenced a hearing date of August 20,2007.
We have had an opportunity to meet with neighbors of the site and discussed a number of their
questions related to the proposed development. It was during this meeting that we became aware of
the confusion of the public hearing date. We will send new notices to all interested parties and
correct the meeting date on the posted sign to reflect a public hearing date of September 18, 2007.
