ITY SERVICES (xpmeq" Division of Building and Code Services VIA CERTIFIED MAIL April 18, 2008 1427 W h86'a° Street #149 COPY Indianapolis, IN 46260 RE: CITY CODE VIOLATION —ANIMALS Dear Ms. Ramey: This letter is being provided to inform you that an inquiry was made to the Department of Community Services regarding a possible City Code Violation at 13003 Chew Street, in the City of Carmel, a property listed under your ownership. An inspection revealed that the concern appears to be valid and that the property is in violation of the CarmeVClay Zoning Ordinance and Carmel City Code as it relates to the number of pets allowed in a residential home. The following are the 2 definitions related to this situation: KENNEL, COMMERCIAL-- Any Lot on which four (4) or more dogs, or small animals, at least four months of age are kept. KENNEL, RESIDENTIAL— Any Lot on which three (3) or less dogs, or small animals, at least four months of age are kept. As you can see by these definitions, having more than three animals in your home is considered a "commercial kennel" and, therefore, a violation of the zoning ordinance. I offer you these two remedies to this situation in order to bring your property into compliance: 1) obtain a variance of use to legally establish your excessive number of pets, or 2) remove four of the pets from the home permanently. Please bring this property into compliance with the Cannel/Clay Zoning Ordinance and City Code by June 13, 2008. Failure to resolve the violation(s) by the specified date could result in further enforcement action by the City of Carmel. Ms. Ramey authorized me to write you concerning your letter to her of April 18, 2008, a copy of which I am enclosing herewith. Both Ms. Ramey and myself do thank you for your cooperation which you have extended to us since we received your letter of April 18, 2008. We appreciate your understanding and your cooperation. Please be advised that on Friday, May 23, 2008, Ms. Ramey moved from her premises at 13003 Chew Street and returned to her home in Indianapolis and this move is permanent. In other words, Ms. Ramey and her children and her animals and pets no longer reside at 13003 Chew Street and the premises are completely vacant. This is a permanent move and Ms. Ramey and her family will no longer be located at 13003 Chew Street. She is going ahead and listing the property for sale immediately. Her decision was a very difficult one for her because, as you may know, she has spent a substantial amount of money and a great deal of time in the construction of her new home on Chew Street and just moved in the first week of April, 2008.
