I hope that you had a nlce holiday! I was able to go through and update the comparison
chart and list of current regulations.
The file '2003 Proposed Landscape Ordinance' has the new updates that I have added to the
ordinance. Mainly, I went in and added any regulations that were not specified for special
districts. I made sure to add any regulations that were on the 'current zoning ordinance'
chart. So essentially, there proposed zoning ordinance doesn't add or subtract any
regulations, it simply combines all of the regulations together.
The file 'Landscape Regulations Chart' is the chart that I showed to everyone at the
meeting. I went through the current ordinance again to check each entry to make sure that
it was correct as well as added B-3, B-7, 8-5, R-5 and M-3. The file 'Landscape
Regulations' has the 'codes' so to speak for the chart. It contains a listing of quotes
from the current ordinance and how they relate to the chart.
The file 'Comparison' is a rough listing of the infonnation taken from the Landscape
Regulations and the Landscape Regulations Chart and put into categories so that I could
more easily determine what needed to be added to the proposed ordinance and what didn't.
This also helped for me to see a specific comparison beh,een the points system and the
current regulations because all that I did was directly convert the regulations. So you
could compare the regulations in a section of this document to the special district
regulations section of the proposed ordinance.
Scott (or anyone else who could offer any suggestions) - As I was looking through the
current ordinance, there was a regulation for the following:
1. Materials: All plants proposed to be used in accordance with any landscaping plan
shall meet the following specifications for the US 31 Overlay district
a. Shade Trees: two and one-half inch (2 ~") caliper, a minimum height of eight feet
(8'), and branching height of not less than one third (1/3) nor more than one-half (1/2)
of tree height
b. Ornamental Trees: one and one-half inch (1 ~") caliper a minimum height of six feet
(6), and a branching height of not less than one-third (1/3) nor more than one-half (1/2)
of tree height
c. Evergreen Trees: a minimum height of eight feet (8')
d. Deciduous Shrubs: A minimum height of twenty-four inches (24"), and no less than six
(6) main branches upon planting
e. Evergreen Shrubs: A minimum height and spread of twenty-four inches (24")
When we were first working on this you had said that we could state "Any shrub shall be in
accordance with the most current publication of the American Standard for Nursery Stock as
produced by the funerican National Standards Institute, Inc" -- Is there a difference...
the should we keep both regulations or should we use one or the other? Just let me know.
Also, what was the decision that we made about including the City Code in the ordinance. I
am not sure if I should include that information or some of the information or none at
all. Thanks a bunch!
Anyways - Chris is planning on going to Carmel sometime this week. I am going to have him
drop of the binder with all the information in it, I took it with me so that I could work

on things while I was in Chicago. If there is a particular day that would be best, I can

BOUNDARlES
A - The boundaries of the State Highway 431 Overlay Zone are hereby established as shown on the
Zoning Map. The zone shall include an area of one hundred twenty (120) feet on either side of the
right-of-way for State Highway 431
B - A. Beginning at north right-of-way line of 96th Street and extending to the north right-of-way line
of Interstate Highway 465, the boundary shall follow the centerlines of Spring Mill Road on the
west and College A venue on the east.
B. Beginning at north right-of-way line of Interstate Highway 465 and extending to the south
right-of- way line of 131 st Street, the boundary sha11 follow the centerlines of the proposed or
constructed parallel roads, namely Pennsylvania Street on the east, and Il1inois Street (and
Meridian Corners Boulevard) on thc west.
C. From the south right-of-way line of 131st Street to the south right-of-way line of 146th Street,
or the southern boundary of any TIF District that is contiguous to 146th Street, the boundary shall,
(unless othe1"\vi8e shown on the official Zoning Map) include all land that is within six hundred
(600) feet of the right-of-way for U.S. Highway 3 L
C - The boundaries of the Overlay Zone are hereby established as shown on the Zoning Map. The
boundaries extend four hundred (400) feet on either side of the U.S. Highway 421 right-of-way,
include the North Augusta subdivision in its entirety, including both that real estate described as
Block "A" and the cemetery on the plat of Section 1 recorded September 2,1947. The portion of
the Overlay Zone east of Michigan Road does not extend north of the parcel numbered 17-13-06-
00-00-034 and any lot subdivided there from after September 1, 1997.
D - Beginning at the intersection of the centerline of W cst Smokey Row Road (East 136th Street) and
the Monon Greenway;
thence east to the alley between 1st Avenue Northwest and North Range Line Road;
7th Street Northeast; thence east to the rear property line of properties on. the east side of 2nd
Avenue Northeast; thence south to 3rd Street Northeast; thence eastro 3rd Avenue Northeast;

B West Home Place Conunercial Corridor, which is comprised of properties on the East side of
Pennsylvania Street from East l03rd Street to East 1 16th Street.

B - Any Properties adjacent to Or abutting an existing residence or residential area must create at least a
five-foot (5') wide buffer consisting ofa minimum of three (3) shade trees, two (2) ornamental
trees, and nine (9) shrubs per one hundred (100) linear foot increment
C - I. Low Intensity Area: Any Properties adjacent to or abutting an existing residence or residential area
must create at least a five-foot (5 ') wide buffer consisting of a minimum of three (3) shade trees,
two (2) ornamental trees, and nine (9) shrubs per one hundred (100) linear foot increment
2. High Intensity Area: Any Properties adjacent to or abutting an existing residence or residential
area must create at least a ten-foot (10') wide buffer consisting of a minimum of five (5) shade
trees, four (4) ornamental trees, and fifteen (15) shrubs per one hundred (100) linear foot
increment
MINIMUM FRONT YARD
A - From the Right-ofeway:
Residential Zones: Thirty (30) feet
Business, Industrial, and Manufacturing Districts and/or Uses: One hundred twenty (120) feet
B - With Frontage on Road
Minimum Thirty (30) feet, measured from the right-of-way. This measurement shal1 include the
mandatory thirty-foot (30') greenbelt.
Maximum: One Hundred twenty (120) feet, measured from the right-of-way. This measurement
shall include the mandatory thirty-foot (30') Greenbelt.
C - Additions, except for open-air porches, may not be added to thc tront ofthe building except where the
building is set back more than twenty (20) feet from the setback line of its nearest two neighbors.
D - A Corner Lot for a residential use is presumed to have a front yard setback on both streets that it faces.
For a non-residential use, the from yard shall be Range Line Road or the street with the greatest
traffic.
E - Front Setback: The buildings must sit on the front property line except for minor reesses for entrances
and outdoor seating/dining.
F - Front Yard Setback
1. Minimum: Five (5) feet from Front Lot Line
2. Maximum: Fifteen (15) feet from Front Lot Line
3. Uses which require outdoor seating shall be set back no less than ten (10) feet

PRESERVATlON AND PROTECTION
A - Sites with existing trees or stands of trees shall protect and im;orporate them into the overall site
design. The landscape plan must preserve not less than fifty percent (50%) of all trees that are:
1. Six-inch (6") DBH or larger, and
2. located within the required yard/setback areas
B - Protection of Existing Trees
Sites with existing trees or stands of trees should make reasonable efforts to protect and
incorporate them into the overall site design. The landscape plan must preserve not less than
seventy percent (70%) of all trees that area
A. nine~inch (9") DBH or larger, and
B. located within the Greenbelt, Planting Stripes) and perimeter buffering
C - If tree preservation is not possible due to other site constraints, the Director or his appointed designee
may require a Reforestation or Afforestation Plan
INSTALLATlON AND MAINTENANCE
A - Installation. All required landscaping pursuant to the ADLS Approval shall be installed prior to the
issuance of a Cartificatc of Occupancy by the Department Administrator. If it is not possible to
install the required landscaping because of weather conditions, the property owner shall post a
bond for an amount equal to the total cost of the required landscaping prior to the issuance of the
Final Certificate of Occupancy
B - Maintenance. Il shall be the responsibility of the owners and their agencies to insure proper
maintenance of the landscaping, in accordance with the standards set by this Ordinance. This is to
include, but is not limited to, replacing dead plantings with identical varieties or a suitable
substitute, and keeping the area free of refuse and debris.
C - Landscaping Installation and Maintenance
Materials: AlIplants proposed to be used in accordance v.rith any landscaping plan shall meet the
following specifications:
1. Shade Trees: two 81ld one=halfinch (2 \12") caliper, a minimum height of eight (8)
feet, and branching height of not less than one third (1/3) nor more than one-half
(1/2) of tree height
2. Ornamental Trees: one and one-half inch (1 y,") caliper a minimum height of six (6)
feet, and a branching height of not less than one-third (1/3) nor more than one-half
(1/2) ofa tree height
3. Evergreen trees: A minimum height of eight (8) feet
4. Deciduous Shrubs: A minimum height oftwenty-four (24) inches, and no less than
six (6) main branched upon planting
5. Evergreen Shrubs: A minimum height and spread of twenty-four (24) inches
The dimensions, specifications and design of any planting area or planting median shall be as
lollows:
1. Shade Trees: nine (9) leet wide
2. Ornamental Trees: seven (7) feet wide
3. Smubs (only): five (5) feet wide
Landscaping materials selected shall be appropriate to local growing and climate conditions
LANDSCAPE PLAN
A - Landscape Plan
A landscape Plan shall be submitted to the Plan Commission for its approval at the same time
other plans (i.e. architectural design, lighting, parking and signage) are submitted. This plan shall:
A. Be drawn to scale, including dimensions and distances;
R Delineate all existing and proposed buildings, private parking areas, walks, ramps for
handicapped, terrace, drive-ways, signs, lighting standards, steps and other similar
structures;
C. Delineate the location, size and description of all plant material and the irrigation
system for all planting areas, Landscape treatment for plazas, roads, paths, service
and private parking areas shall be designed as an integral/coordinated pmt afthe
Landscape Plan for the entire lot.
B - Landscape Plan - The applicant shall submit a Landscaping Plan to the Commission as pmi of the
ADLS application. This plan shall be drawn to scale, including dimensions and distances; shall
delineate all existing and proposed stmctures, private parking areas, walks, ramps for the
handicapped, terraces, driveways, signs, lighting standards, steps, storm water facilities and other
similar structures; and shall delineate the location, size and description of all landscape material
and the method to be used for the watering or irrigation of all planting areas. Landscape treah11ent
for the plazas, roads, paths; service and private parking areas and storm water areas shall be
designed as an integral and coordinated part or the landscaping plan for the entire site. The
Landscaping Plan shall require the approval of the commission.
D~:SLGN
A - Style and Species. Landscaping shall be designed in accordance with the adopted landscaping style and
species palette established for the City Center by the City of Cannel Redevelopment Commission.
B - Landscaping Standards:
The interior dimensions, specifications and design of any planting area or planting median shall be
sufficient 0 protect the landscaping materials planted therein and to provide for proper growth. The
following minimum interior widths for planting areas shall be used:
A canopy trees: nine (9) feet
B. ornamental trees: seven (7) feet
C. Shrubs (only) five (5) feet
All plant material proposed to be used in accordance with any Landscaping Plan shall meet the following
specifications
A. Shade Trees: a minimum trunk diameter of two and one-half (2 Y2) inches at six (6)
inches above grade, a minimum height of eight (8) feet, and a branching height of
not less than one-third (1/3) or more than one half (112) of tree height.
B. Ornamental trees: A minimum tmnk diameter of one and one-half (1 If2) inches at six
(6) inches above grade, a minimum height of eight (8) feet, and a branching height of
not less than one-third (I/3) or more than one-half (1/2 ) of tree height
C. Evergreen Trees: a minimum height of eight (8) feet, and a width of not less than
three-fifths (3/5) of the height
D. Deciduous Shrubs: A minimum height of eighteen (18) inches, no less than six (6)
main branches upon planting, and a mature height no greater than thirty-six (36)
inches
E. Evergreen Shrubs: a minimum height and spread 'of eighteen (18) inches, maximum
mature height ofthirty-six (36) inches
C - The remaining Front Yard of all buildings will be maintained with a groomed landscape oflow shrubs,
ground cover, trees, flowers andlor grass.
D - All shade trees shall be a minimum of 8 - 10 and a minimum trunk diameter, 12" above ground, of 2
y,". Mature average spread should be 20'.
E - Vision clearance on corner lots and at the intersections or streets and drive ways shall be observed.
FOUNDATION PLANTINGS
A - Planting Adjacent to Buildings
I. A planting area equal to an area measuring twenty-five (25) feet in depth by the width of the
front of the building plus twenty (20) feet (to extend ten (10) teet out on both sides) shall be
installed along building facades that face U.S. 31.
2. A planting area equal to an area ten (10) feet in depth by the remaining side ofthe building
shall be installed on all other sides of the building(s).
3. Sidewalks up to eight (8) feet in width may be permitted in,these areas, but shalll10t occupy
the entire planting area on any side of the building(i,)
4. if an approach driveway of sidewalk cuts into a planting area, the area displaced by the
driveway or sidewalk shall be added to the building perimeter planting.
5. These adjacent planting areas need not be rectangular in shape as long as the required amount
of space is landscaped; innovative and original designs are encouraged
B - Foundation Plantings shall be included along all sides of any building. The minimum width of the
planting area shall be five (5) feet, except that when adjoining a parking area located in tne front
yard adjoining U.S. 421, the minimum width shall be ten (10) feet

PARKING
A - Shade trees shall be planted within parking areas greater than 10,000 square feet. There shall be
planted one (1) shade tree and five (5) shrubs per every nine (9) spaces.
B - A minimum of one (1 ) shade tree and five (5) shmbs shall be planted within each parking lot for every
nine (9) space provided, or not less than eighteen (18) trees per acres of parking
C - Parking Lots
A. Interior Landscaping. A minimum of one (1) shade tree and five (5) shrubs shall be planted
within each parking lot for every nine (9) spaces provided, or not less than eighteen (18) trees
per acre of parking
However, for buildings with parking areas located in a front yard, with frontage directly on
the highway, a minimum of one (1) shade tree and five (5) shrubs shall be plantcd within cach
parking lot for every six (6) spaces provided, or not Jess than twenty-four (24) trees per acre
of parking
B. Parking Lot Perimeter. Where parking areas are located in the front yard, with frontage
directly on the highway, a six (6) foot wide perimeter planting area shall be provided along
the front and side of those areas
a. The required planting u nit for this area shall include: two (2) shade trees, three (3)
ornamental trees, and thirty (30) shrubs per 100 linear feet
b. The perimeter planting area shall be provided in addition to the Greenbelt area
C. Front and Side Parking Area. Parking areas within front and side yards shall be completely
screened from view. Such screening shall be subject to Commission approval
D - Parking areas shall be landscaped as follows:
A. a five foot (5' ) wide planting strip shall be provided along the sides of the rear of all parking
areas. The minimum planting shall include two (2) shade. trees and twenty (20) shrubs per one
hundred linear (100) feet or three (3) shade trees and ten (10) shrubs per one hundred (100)
linear feet.
B. Parking areas that are located in Side Yards shall be screened from the street right-of-way
with a six (6) foot wide planting strip consisting of:
a. Three (3) shade trees and thirty (30) shrubs per one hundred (100) linear feet, or;
h. A forty-two"inch (42") decorative wall, or;
c. A combination ofthe above as approved by the Commission
C. Shade trees shall be planted within parking areas greater than ten thousand (10,000) square
feet. There shall beplanted one (1) shade tree and five (5) shrubs per every nine (9) parking
spaces.
SCREENING
A - Parking areas that are located in side yards shall be completely screened fi.om the street right-of-way
with six (6) foot wide planting strip using shrubbery, hedges,. shade trees, masonry walls, or
combination thereof.
B - Screening areas. All air conditioning units, HV AC systems, exhaust pipes or stacks, overhead doors,
outside storage areas, and satellite dishes shall be integrated into the overall building design or
sl:reened from the highway right-of-way and adjollling residential zones or uses using walls,
fencing, parapets, penthouse. screens, landscaping, camouflage, or other approved method.
C - Screening shall be done with suitable sbmbbery, and shall be planted at the time of construction or
conversion to, a business activity and shall be maintained in order to provide effeelive screening at
all times during the year. TIle screening may be planted infomlally in rows and shall screen
parking areas, outside storage areas, loading berths, trash and refuse containers and so forth
abutting or adjoining residential properties.
PLANTING STRrP
A - A five-foot (5 ') planting strip shall be provided along the sides and rear of all parking areas. The
minimum planting shall include rnto (2) shade trees and twenty (20) shrubs per linear feet
B - Planting Strip
1. A planting strip, minimum width shall be. ten (10) feet, shall be provided
adjacent to any collector or arterial street, or parkway right-of-way within
the highway overlay zone
2. Adjacent to an entry drive: Minimum width ten (10) feet
3. Adjacent to any parking area: Minimum width as follows:
1. five feet (5) wide when adjacent to business zoncd property
2. fifteen feet (15) wide when adjacent to residential use or zoned
property
4. 111e planting strip shall be unoccupied except for plant material, steps,
terraces, driveway and pathway crossings, lighting standards, signs,
benches, and other similar shuctures.
5. The base planting unit for planting strips shall be as foHows:]
1. Adjacent to parallel collector/arterial roadways:
a. For each one hundred (100) linear foot increments:
i. Three (3) shade trees
ii. Two (2) ornamental trees
iii. Ten (10) slU'ubs
2. Adjacent to entry drives: Same planting unit standards as for
parallel Collector/ Arterial Roadways
3. Adjacent to parking areas
STRIi:ET TREICS
A ~ Shade Trees shall be planted along all streets within the rights-of-way, parallel to the street and at
equal intervals

The following definitions shall be applied to this Ordinance. All defined words throughout this
ordinance shall be indicated in italics.
BURIAL HOLES
CALIPER shall mean the diameter measurement of a tree trunk taken six inches above the
ground on trees with a diameter of four inches (4") or smaller and four feet six inches
(diameter at breast height - DBH) above the ground on larger planting stock.
CONCRETE WASHOUT
CRiTICAL ROOT ZONE: A circular region measured outward from a tree tnmk representing the
essential area of the roots that must be maintained in order for trees survival. CRZ = }'

DRIP LINE a vertical line that runs from the outermost portion of the crown of a tree to the
ground.
EVERGREEN SHRUB means a shrub of a species that normally retains its leaves throughout the
year.
EVERGREEN TREE means a tree or shrub of a species that normally retains foliage throughout
the year.
FATALLY INJURED TREE: a tree that has been injured to the point that it will inevitabl~ die
due to the damage ~
FINISHED GRADE LE VEL shall be defined as the level at which soil is replaced around the root
ball of a tree, slU1.lb, or evergreen.
FOUNDATION PLANTINGS At one time foundation plantings were mainly used to hide the
bases of older houses. It is no longer considered necessary or desirable to plant a line of
shrubs all the way across the foundation. Plantings at the front of a house are used to
complement the home appearance, to blend it into the surroundings and to create an
invitillg entrance.

Many designers now like to refer to the area in front of the house as the entry garden to
emphasize that the purpose of this area is to complement, not camouflage, the house. The
entry garden can incorporate any of the areas that are in the public view.

PRIVATE TREES: Any landscaping, primarily trees, that grows from within the boundaries of
privately owned property.
PROPERTY OWNER: The owner of the property on which the tree in discussion resides.
PROTECTED TREES refer to trees that are located on a lot prior to construction and must
remain in the same location without any ill health effects due to construction.
PRUNNING: the strategic removal of portions of a plant.
PUBLIC NUSIANCE shall refer to any tree, shrub or other plant material with an infectious
disease or insect problem; dead or dying; a tree limb(s) that obstruct street lights, traffic
signs, the free passage of pedestrians or vehicles; a tree that posses a threat to safety; or a
tree deemed as such by the Urban Forester.
ROOT BALL the bound roots of a plant that is retained in a soil ball.
ROOT FLARE the portion of the tree where roots and the trunk. join creating a widening at the
base of the trunk.
SCARIFY
SHADE TREE a large tree growing to over forty feet (40') in height at maturity, usually
deciduous, that is planted to provide canopy cover shade.
SHRUBS
STAGiNG AREAS portions of a construction site that are designated for specific needs
STREET TREES are trees that planted along a street inside the right-of-way or within five feet
(5') thereof.
TRENCHING
TOP or TOPPING shall be defined as cutting a currently growing or one-year-old shoot back to
a bud, or cutting an older branch or stump to a stub or lateral branch no sufficiently large
enough to assume the terminal role.
TREE CARE shall mean the treating, spraying, removal pruning, and any other tree maintenance
or cultural work intended for the enhancement of preservation of trees and the removal and
prevention of any and aU damage to any street trees caused by tree pests, blights, and
diseases.

including, but not limited to: overtop electric wires, television and communication cables,
guy wires, underground water, gas, sewer drainage, communication and power lines and
pipelines.
