RE: CITY CODE VIOLATION — CONDITION OF PROPERTY
Dear Mr. & Mrs. Fuller:
This letter is being provided to inform you that an inquiry was made to the Department of
Community Services regarding a possible City Code Violation at 5874126t' St. E., in the City of
Carmel, a property listed under your ownership. An inspection revealed that the concern appears
to be valid and that the property is in violation of the Carmel City Codes, §6-77(k), § 6-106(b)
and § 6-114, which states the following conditions to be public health nuisances:
§6-77(k): Any accumulation ofjunk, rubbish, scrap metal, automotive parts,
building materials, machinery, dead trees, or parts thereof, upon any premises
in a residential area.
§6-106(b): A Junk Car shall mean any motor vehicle which does not bear a
currently valid license plate, and is not kept in a garage or building.
§6-114: Because of the danger to the health from vermin, the danger ofpersonal
injury to children attracted by such vehicles, danger of fire by the storage of
gasoline and oil thereon, any abandoned, unlicensed, inoperable,
disassembled, wrecked orjunked motor vehicle on any street or public
property for more than five days or upon any private property for more than
15 days, except as hereinafter provided, is declared to be a nuisance and
unlawful.
This department has also received complaints that there is a business being operated out
of this residence. However, there has been no documented evidence of this at this point.
Home Occupations are allowed as long as they meet the provisions included in the
Carmel Clay Land Use Regulations. The following provisions apply to Home
Occupation (§25.18) in the Carmel Clay Land Use Regulations, and specifically
§25.18.01 Standards Generally, (B) Character:
The Home Occupation shall not change the character of the Dwelling, Lot, or
Parcel;

2. The Dwelling shall not bear any indication from the exterior that it is being
utilized in whole or in part for any purpose other than a Dwelling;
3. The Home Occupation shall not be permitted outside storage or display of
materials in connection with the Home Occupation:
This list of provisions does not exhaust the list of provisions to be met in maintaining a
Home Occupation (see enclosed).
Please bring the condition of this property into compliance with the Carmel City CodelCarmel
Clay Land Use Regulations by November 5, 2007. Failure to resolve the violation(s): vehicle(s)
to have current plate, inflated tires, and operable, or be garaged: all outside storage/rubbish
removed from property or stored inside; (plus adherence to provisions of the Home Occupation
informational, if necessary) by the specified deadline will result in further enforcement action by
the City of Carmel to include city abatement (billed to property owner) and/or citations.

A. Flnor area: Home Occupations shall utilize no more than fifteen percent (15%) of the
gross floor area of the dwelling.
B. Character:
1. The Home Occupation shall not change the character of the Dwelling, Lot or
parcel;
2. The Dwelling shall not bear any indication from the exterior that it is being
utilized in whole or in part for any purpose other than a Dwelling;
3. The Horne Occupation shall not be permitted outside storage or display of
materials in connection with the Home Occupation;
4. The Home Occupation shall not be permitted signs other than those normally
permitted in the district in which the Home Occupation is located.
C. Nuisance: The Home Occupation shall be conducted wholly within the Dwelling, such
that there is no outside noise, vibration, odor, smoke, dust, glare or electrical disturbance.
D. Froployecs The Home Occupation shall employ no more than one (1) individual outside
of the immediate family.
E. Deliveries, The delivery of any materials for the Home Occupation will not exceed two
(2) trips per day by any vehicle not owned by a family member.
F. Equipment. The Home Occupation shall utilize only mechanical equipment that is
customarily used for domestic purposes and is of a size and type that is similar to
domestic mechanical equipment or is customarily found in a business office.
