RE: ZONING ORDINANCE VIOLATION — LAND USEIDEBRIS
Dear Ms. Beymer:
This letter is being provided to inform you that our department has recently received some
concerns regarding 54 Wilson Drive, in Clay Township, a property listed under your ownership.
This property is currently zoned residentially (R2), which does not permit for business operations to
be run from the property. The only standards that permit for a business to be run from a residential
property are the Home Occupation standards of §25.18 and the Sign Ordinance §25.07.02-03 of
the Carmel Zoning Ordinance (See Enciosed).
The nature of the home occupation standards is to allow a home business to operate with NO
visible evidence or impact upon the property's residential character. Activities such as large
commercial vehicles, gathering of employees, and storage of materials violates these regulations.
This restriction is in place to protect and enhance the character of the residential neighborhood and
minimize the impact such visible exterior evidence would have.
Additionally, an inspection revealed that the concern appears to be valid and that the property is in
violation of the Carmel City Code, §6-77(k), which construes the following conditions to be public
health nuisances:
(k) Any accumulation of junk, rubbish, scrap metal, automotive parts, building
materials, machinery, dead trees, or parts thereof, upon any premises in a
residential area.
NI of these are violations of the Ordinance and must be corrected by the removal of the equipment,
the materials and the debris from the property no later than January 17, 2008. Failure to abide by
the conditions of the Home Occupation Ordinance and City Code will result in further enforcement
