RE: ZONING ORDINANCE VIOLATION —ILLEGAL SIGN/COMMERCIAL KENNEL
Dear Sir or Madam:
This letter is being provided to inform you that a sign violation(s) has been brought to this
department's attention. The sign(s) advertises Under Construction, is located at 1337
Ironwood Dr. W., in the City of Carmel, a property listed under your ownership. This sign
is violation of Carmel Clay Land Use Regulations for the following reasons: it advertises
the business located at this property — Home Occupation §25.07.02-03; all exterior
structural construction, renovation, or repair has been completed, ending any possible
signage allowances (disregarding all other signage requirements); and the sign would not
meet size and setback requirement(s) if it had been issued the appropriate permits —
Additional Signs in Residential Zones §25.07.03-05.
Specific regulations apply to different types of signs, depending on the nature and location
of the sign. For further regulations and needed clarification please contact Rachel Boone
at (317) 571-2280. Please remove the sign by April 24, 2008. After this date, if the sign is
not removed, additional enforcement action will be necessary.
The Department also received a complaint that a possible kennel is being operated at this
property, which is zoned residentially (R1). As per Appendix A, Schedule of Uses, of the
Carmel/ Clay Zoning Ordinance, a commercial kennel is not a permitted use in this zoning
district. Chapter 3 of the Zoning Ordinance defines a commercial kennel as "any Lot on
which four (4) or more dogs, or small animals, at least four months of age are kept." You
must apply for and obtain a variance (accessory use) in order to keep the fourth dog,
otherwise, you will be required to maintain the maximum of amount of three (3) animals on
the property. Removal of the fourth animal or initiation of the variance process must begin
by May 5, 2008 in order to prevent further enforcement action from occurring.
