Once you've secured your neighbor's consent, you will need to get some very specificguidancefrom the Plan Commission (specifically, the Director of Planning) regarding how the County wants you to plot the easement, and its proposed dimensions. This plot will have to be approved by the County before the proposed easement is prepared and executed. I am told that the Plan Commission is used to these requests, and should be cooperative. Once everyone has agreed on the size, and plot, of the easement, we will need the legal descriptions of both your property (I have this) and yo neighbor's property (I don't have this), as well as a metes-and-bounds description of the plot of the easement (this will require a surveyor's services). With this information, We can draft the instrument granting you the easement (yours will be the "benefitted" parcel, your neighbor's th "burdened" parcel). Note that surveyors aren't cheap (count on spending a few hundred dollars for these services), and that this process will take some time. It will be important that the proposed plot of the easement have the Plan Commission's blessing before you spend a lot of money on a surveyor, etc. I hope this helps. Have fun in Hawaii.
