41. Docket No. 07070037 Z: Dixie Highway Addition, lot 5 pt
The applical1t seeks approval to rezone 0.41 acres from Rc3/Residence to B-l/Business
within the Home Place Business District. The site is located at 10696 N College Ave.
Fi]ed by E. Davis Coots of Coots, Henke & Wheeler, and P.e.
The petitioner seeks rezone approval to change the zoning of the lot from Rc3/Residence into B-1
/Business. This lot does lie within the Home Place, Business District, where busincssland uses are
promoted. Currently, a residential structure exists on this lot. The site is directly west of the Clay
Township Governmenr Center & Fire Department; The subject property is located in an area that has a
mix of business and residential zoning. Please see the petitioner's informational packet for more detail.
The B-1 zoning classification permits land uses such as a nursing/retirement facility, medical office,
general office, professional office, trade or business school, retail sales, service, veterinary hospital
without kennel, art gallery, catering establishment; restaurant without drive thru, and so on. (Please refer
to Appendix A: Schedule of Uses in the Carmel Zoning Ordinance for more detail.) However, at the
October ]6 Plan Conunission meeting, the attorney for the project committed to limiting the land uses to
general office, professional office, and retail. A preliminary site plan was also presented.
At the Nov. I committee meeting, the vote was a 5-0 Positive Recommendation to the fu11 Plan
Commission, '.vith the condition that the petitioner will have approval from the County Highway Dept.
and the County Surveyor's Office before Plan Commission. (This has been achieved.)
DOCS comments/concerns:
1. Thc City Forestry Dept has no comments on the rezone, but will provide review comments
if/when the DP/ ADLS is submitted.
2. The petitioner has recei ved approval from the Hamilton County Highway Departmcnt. Also, road
right of way will be dedicated by the petitioner.
3. The County Surveyor's Office does not have any issues with the rezone.
The Department of Community Services recommends the Commission forward this item, with a
favorable recommendation, to the City Council.
