Docket No. 07070037 Z: Dixie Highway Addition, lot 5 pt The applicant seeks approval to rezone 0.41 acres from R-3/Residence to B-IlBusiness within the Home Place Business District. The site is located at 10696 N College Ave. Filed by E. Davis Coots of Coots, Henke & Wheeler, and P.c. The petitioner seeks rezone approval to change the zoning of the lot from R-3/Residence into B-1 IBusiness. This lot does lie within the Home Place Business District, where business land uses are promoted. Currently, a residential structure exists on this lot. The site is directly west of the Clay Township Government Center & Fire Deparlment. The subject property is located in an area that has a mix of business and residential zoning. Ifrezoned to B-1, some potential land uses could be: nursing/retirement facility, medical office, general office, professional office, trade or business school, retail sales, service, veterinary hospital without kennel, art gallery, catering establishment, restaurant without drive thru, and so on. Please refer to Appendix A: Schedule of Uses in the Carmel Zoning Ordinance for more detail. DOCS comments/concerns: I . The petitioner should provide some information about the type of businesses that could operate out of tl:1 is site, if the rezone is approved. The petitioner should provide a paragraph stating what land use is proposed, hours of operation, number of employees, etc. The petitioner should provide a conceptual site plan for the site, showing the parking area, noor plan, landscaping, etc. 2. The City Forestry Dept has no comments on the rezone, but will provide review comments if/when the DP/ADLS is submitted. 2. The petitioner should provide the approval status of the County Highway Dept. (Some major concerns are road right-of-way and a drive permit.) 3. The petitioner should provide the approval status of the County Surveyor's Office. 4. Please note that the Home Place Overlay, Chapter 23E, does require additional requirements for lighting, landscaping, architecture, etc.) If this rezone is approved by the Plan Commission and City Council, lhis site would have to come back before the Plan Commission for site plan and design review and approval under a DP/ADLS application. S. A comparison of zoning districts is below. The Department of Community Services recommends the Plan Commission forward this item to the October 2 Special Studies Committee meeting for further review.
