HomeMy WebLinkAboutCorrespondence Remonstrance April 25, 2008 Carmel Board of Zoning Appeals Carmel City Hall One Civic Square Carmel, Indiana 46032 Dear President: Re: Docket No. 08030033 V, Woodland-Perkins Garage Addition, 201 Woodland Drive, Carmel, Indiana, aka Lot 48 in Woodland Golf Club 2nd Addition, I would respectfully like to inform the Board that I personally object and do not support the petition submitted by the owners Mr. and Mrs. Ross and Buffy Perkins relating to their request for a variance for the purpose of constructing a 4-car garage on the above described property. My objection is based upon the negative affect and impact this proposed structure will have on my property which is directly adjacent to and south of the property of Mr. and Mrs. Perkins. My property is known as 21 Cardinal Lane, Cannel Indiana, aka Lot Sl in Woodland Golf Club 2nd Addition. The follow are the reasons that I feel will negatively and detrimentally affect my property: 1. Water drainage and run-off of the subject property directly onto my property which will compound and already existing caused by the existing property. 2. Create a limited access to my property off of Cardinal Lane. 3. Cause a potential loss of value of my property by the encroachment of the proposed structure in the minimum side and front setback zoning requirements. 4. The negative impact that a large structure will have restricting the visual beauty and opelmess in the front of my dwelling. 5. The concerns for my property relating to Fire and security protection and response due to the size and location of the proposed structure in restricting the visual locatIon and identification of my property. Perkins From: Robert and Barbara Heinlein 151 Woodland Lane, Cannel Dear Sirs: My wife and I are opposed to the approval of a variance for 20 I Woodland Lane for several important reasons. 1. Drainage - Our home is located across the street (Cardinal Lane), to the west and downhill from 201 Woodland Lane. Due to poor soil and the lack of storm sewers, we have a serious basement water seepage problem during heavy rain. We had solved the problem at considerable effort and expense when we remodeled in 2004. But paving Cardinal Lane in 2006 caused water run-off to leak into the basement again, requiring more expensive sealant work and in- ground drainage pipes to carry water away from the basement. This work has greatly reduced the basement leakage problem. But heavy rain can still be a problem due to downhill water run-off. Also a fire hydrant placed in the same uphill comer of our lot requires special testing procedures because surface and ground water flows downhill toward our house. The city of Carmel has already paid to have our basement carpets cleaned because of hydrant testing done without regard to where the water would flow. If the proposed variance for 201 Woodland Lane is approved, there would be a 42x35 foot concrete slab for a 4-car garage and a huge parking area for the garage, plus a second driveway besides the existing drive. When it rains, the water will not sink into the yard at 201 Woodland because almost the entire west side yard will be paved or have a garage slab on it. The water will run off downhill into our yard and into our basement. That is why the setback needs to be 35 feet (55 feet from the center of the street). 2. Location - There are 4 houses on Cardinal Lane, two on each side of the street. Al14 houses are currently set back 35' or more from the 40 foot right of way (not the side oftbe pavement which is a very narrow 15-20'). The houses are nicely arranged in line. Allowing 1 house to stick out 42 more feet (the proposed garage addition) will upset the look of the street. That is why we have zoning laws with minimum standards. The house at 20 1 Woodland, added onto years ago, is too close to the side property line already (less that 5 feet). The proposed garage addition will make the house too close on 2 sides instead of one. ~"'-"':" 3. Precedent - There is no precedent for this proposed remodeling variance request. No otber homes are this close to the street or have been remodeled to be this close to the street. Actual measurement shows this addition to be only 17' from the edge of the pavement /1 0' if you consider the 40' right of way. The other homes cited in Mr. Perkins variance application are not on or facing Cardinal Lane. Woodland addition has several odd-shaped, very large or very small lots. The houses in the addition were built 50.60 years ago. Some were built nearer the street than others due to lot size, shape, hills, creeks, etc. All 4 houses facing Cardinal Lane (including 201 Woodland Lane) have similar sized lots and have similar set-backs. Carmel has jurisdiction of Woodland addition. Carmel zoning rules apply now, not Hamilton County of 195 L 4. Practical use of property - Mr. Perkins' application states, "there is not another practical way to add adequate usable space to the existing home." Adding a garage with 4 bays and 2 driveways is beyond "adequate". The proposed garage is actually larger than a 4-car garage. That's why it would have to be so close to the street. More importantly, if the real purpose, according to Mr. Perkins, is for more bedroom and bath space than the existing house provides, a quick look at the overall view of the house on the lot shows there is room to add on the back of the existing structure which faces Woodland Lane or behind the existing garage which faces Cardinal Lane. Adding a 2nd floor is a possibility. In short, there are alternative design possibilities for "adequate useable space" that would not . . reqUIre a vanance. 5. When my wife and I remodeled our house 4 years ago, we had plans similar to Mr Perkins' proposed addition. Upon recommendation from the Carmel Planning Commission office, we changed our plans to fit Carmel's zoning regulations. An inspector meticulously measured to make sure our additions were 35' from the 40' right of way. Our neighbors should have to do the same. This neighborhood has a certain style and look. Allowing this proposed addition to be built so close to the street would detract from that neighborhood look. This neighborhood is in transition. Many houses having been remodeled, some tom down, new houses built on the property. There are several vacant lots awaiting new homes. Zoning regulations are what we have to insure that new and remodeled homes will fit their lots and not encroach on their neighbors. In conclusion, for these reasons we join several neighbors in opposing approval of this variance. Remodeling and construction plans for the home located at the above address and owned by Mr. Ross Perkins were submitted to the Woodland HomeoVv11ers Association without any specific requests, apparently to render judgments regarding the plans. No mention was made of any Variance request. The Woodland Homeowners Association returned the plans to Mr. Ross Perkins without any judgments offered. The Woodland Homeowners Association neither approves nor disapproves ofthe Plans for the Perkins House. Certainly, individual members of the community can express any position they have regarding this matter at the Variance Hearing April 28,2008. J:~~_r!_(/z:J;. Docs - J~--:'l , ./ Mr. Ross Perkins 301 Woodland Lane Carmel IN 46032 Refer to: Variance Request, Findings of Fact page, Section Three To confirm our conversation regarding the use of the word "Precedent" in describing the location of my home on my lot: My home located at 202 Woodland Lane was constructed in the 1950's, and it's my understanding that it conformed to the codes of the COWlty, then the governing body for Woodland. It is my understanding that there were no exceptions requested or granted; therefore, my house should not be used as a precedent for justification of your request for a variance from the City of CarmeL The circumstances are not similar.
