P:\ 1299\006\docs\Land Desc - See 2. doc April 1, 2004 \ Ww ~ G . .W SUBDIVIDER AGREEMENT FORM Project: The Lakes at Hamilton Place Section 2 9.6 THE SUBDIVIDER The following agreement shall be included as a submittal with the final plot application AGREEMENT The developer shall be responsible for any drainage problems including standing water, flooding and erosion control, which arise or become evident at any time during the 3 year maintenance period after release of subdivision bonds, and which is attributable to a deficiency in subdivision drainage design or construction of drainage improvements. This shall include all pipes, structures, swales, ditches and ponds which are pertinent features to the proper drainage of the subdivision. This responsibili ty of the developer created, subsequent to the completion grading by individual builders. or accomplished by individual homeowners. shall not, however, include problems which are of the subdivision improvements by the improper structures and improper grading installed or It is the intent of this requirement, that the developer shall, specifically, provide such sub-surface drains, or storm sewers or ditches as are required to properly rectify any drainage problem or sub-surface water problem which was not contemplated in the original approved subdivision design, including, but not restricted to, disposal of sub- surface water from footing drains of individual lots. ROAD IMPROVEMENTS: The typical agreement of exis ting contiguous Hamil ton county Roads which are substandard, with Hamilton County is: None The developer will put in 12-inch stone base to the required width of the road, and grade the shoulders to a minimum of 6 feet width and construct proper side-ditches, or, provide storm sewers and' c'urbs. ,This will be the black top grade during construction of subdivision. Then the county will come in and cut out 3 inches and put in 3 inch binder asphalt after which the developer will be responsible for 1 inch of asphalt topping. This is being done as joint projects between county and developer. An agreement shall be executed, in writing, between the developer and Hamilton County specifically detailing the exact work to be accomplished by the developer and that to be accomplished by the County, and shall also s ta te the road or roads or portions thereof which are included. If the subdivision is contemplated to be annexed to the City of Carmel, then the agreement shall include the Ci ty of Carmel Board of Public Works as a signatory, which shall be for the purpose of the City of Carmel agreeing to accept for maintenance and operation the improved road facility upon completion of said improvements and completion of annexation. Water.Distribution The potable water to the site will be provided by the Indianapolis Water Company. Connection onto the existing main will be made at the following location: . An 8" water main will be extended from it's current location at two points along the perimeter of the site within existing sections IA and 18 of The Lakes at Hamilton Place. The new 8" main will be stubbed at one dead end street within the project for future expansion. Approval for the extension of water mains will. be required from the Indiana Department of Environmental Management, and all mains will be designed and installed in accordance with the Indianapolis Water Company rules and regulations. 2. Sanitary Sewer Sanitary sewer effluent for the site will be accepted by the Clay Township Regional Waste District (CTRWD). Proposed Section 2 will connect to an existing 8" main located 315' west-of the intersection of West Road and Eagleridge Drive in the existing sectjon B and to an existing 8" main located at the intersection of Eagleview Drive and Eagiechase Way in the existing section lA. Approvals for the design aild constiuction ofthe sanitary sewers must also be obtained, from CTRWD, it's consultant and from the Indiana Department of Environmental Management. 3. Storm Sewer The surface runoff on the site will be conveyed by a system of swales and pipes to one ciftwo lakes within The Lakes at Hamilton Place. In accordance with the requirements of the Hamilton County Surveyor's requirements, the retention lakes will provide stann water management control in order to restrict the discharge rates onto the site's various outfall points. The discharge points for the site are into the Long Branch watershed. The connection points for the proposed section 2 are as follows: To an existing 21" storm sewer located along the South side of 121 st Street west of West road and along the eastern boundary of existing Section 2. To an existing 21" storm sewer located along the eastern bOlmdary of proposed Section 2 west of West Road at the rear of existing lots 105 & 106. To an existing 36" storm sewer located at the southeast comer of proposed Section 2 north of existing Eaglechase Way and east of Eagleview Drive at the rear of existing lot 1 J 2. To an existing 2 J" storm sewer located at the intersection of existing Eagleview Drive and future Mannings Pass. It is the intent that all main storm sewer lines and all tines interconnecting lakes and serving as outlet points be petitioned to be accepted by the County Surveyor as regulated drains. A limited portion of the storm sewers that serve to drain rear and side yards m<\y remain within the maintenance jurisdiction of the project's homeowner's association; however, most stann sewers and all retention lakes will be maintained by the County Surveyor. Subsurface drains, or pavement base drains, are proposed to be installed under the street curbs, in order to provide an outlet point to home sump pumps, and in order to intercept groundwater seepage before reaching and compromising the pavement stability. Erosion Control During all phases of the construction the Site General Contractor and all Subcontractors shall exercise measures to prevent the erosion of soils due to the action of water and wind. All erosion and sediment control measures shall be implemented prior to earth moving activities. Sediment in run-off water shall be trapped by the use of such methods as debris basins, siltation sumps and silt fences until the disturbed area is 'stabilized. These shall be in place before any land alterations/grading. Trapping devices shall be periodically inspected during dry periods and after each rainfall event by the Site Contractor. Trapping devices.shall be replaced if determined to be incapable of performing intended function of sediment trapping. The Contractor shall have available on the construction site a water source capable of applying water to dry exposed soil in order to prevent wind erosion.
