Dear Mr. Ferrand,
I am addressing this letter to you because we have already discussed the situation of the parking lot view from the
homes on what remains of Sylvan Lane. As you view the pictures r ask you to keep in mind the promise that was made
to the home owners at the beginning of the Freshman addition construction, namely, that the integrity of the
neighborhood would be maintained. For the most part that promise has been kept and r personally was happy until the
last home set for demolition was brought down. As you can see from the picture below, the view is hardly a view that
could be identified as 'neighborhhood' but rather, Parking Lot! This is the view from all three rooms in the front of my
home since my home is elevated considerably above the street:

I was always pleased when my empLoyees came to me with a probLem that tbey also brought with them a plausible
soLution. Now I offer a very plausible, inexpensive solution to the parking lot view.
You can see from the picture below that there already exists an incomplete line of evergreens at the edge of parking
lot. If that zigzag line of pines was extended west across the grassed area between the parking lot and the road (white
stars), the parking lot would be obscured from the neighborhood.
A total of ten evergreens would solve the problem. One of those ten, the forth from the left, is replacing one that is
aLready dead.

At the meeting held Monday, February 28, 2005, Cannel Advisory Board of Zoning Appeals Hearing Otlicer took the
following action regarding the Developmental Standards Variances (V) filed by you for the property located at 520 East
Main Street:
APPROVED: Docket Nos. 05010031 V, 05010032 V & 0501 0033 V: Development Standards Variances for the
sign oriented east, the institutional sign size and the number of signs.
Please be advised that per Section 30.05,05: Time Limit of the Zoning Ordinance, the aforementioned Development
Standards Variance approval is valid for one (1) year. By that time, either continuous construction of the
improvements must be underway, or'a written request for a one-time, six-month extension of the approval must have
been received 3l1d approval granted by this Depmtment. The expiration datc of thc approval is February 28, 2006.
Please be advised that per Section 25.0707' Sign Permits of the Zoning Ordinance, the signs approved pursuant to
the aforementioned Development Standards Variances must be established within one (1) year. The expiration date
of the approvals is February 28,2006.
When applying fOl" applications for permits regarding the improvements contained within this approval,
please include a copy of this letter with your application materials in or'der to assist the [)cpartmcnt's review.

'After our discussion yesterday an-d speaking with Pat I have put together the following outline of
what the BZA has requested:
1. Traffic Access Plan to include the following:
A. Diagram bus paths and Q-ing areas with number of bus loading spaces
B. Diagram parent drop-off paths and Q-ing areas with number of spaces which
allow waiting.
C. Diagram pedestrian access paths to building from surrounding areas including
stadium parking area
D. Diagram location and type of wayfinding signage on site.
2. Traffic counts to include the following:
A. Area of study should include Keystone to Range Line Road along Main Street
B. Peak times are of specific concern
C. Illustrate access points to school campus
D. Recommend actions that will be taken to improve conditions
3. Emergency Plan to include:
A. Location of Fire Lanes I access points
B. Hydrant locations
C, Diagram emergency access at drop-off I pick-up times (presumably areas other
than Q-ing lanes)
D. Illustrate outdoor staging area for students I how this relates to emergency
access locations
E. Provide written plan for different situations. Very critical.
The diagrams should be easy to read and simple to understand. Anticipate that the BZA will
condition approval on the School distributing this information to the public (parents of high school
students) by mail.
The overall question is, "How are we serving patrons (students, parents and visitors) outside the
building?"

Summary of Commitments made durinq February 24. 2003 Board of Zoninq Appeals Meeting
Following is a summary of issues discussed and items committed to by Carmel Clay Schools during
the February 24, 2003 Board of Zoning Appeals meeting. These items will be incorporated into the
plans for the Freshman Center and can be made a condition of approval if required.
III The Andich Property at 120 Sylvan Lane recently purchased by Carmel Clay Schools will
remain a residential property.
41 The proposed plan provides improvements to the student walkway along the north road and
the circular drop-off at the north entrance. These improvements will allow bus traffic to enter
the site from Smokey Row Road. This will eliminate the current bus loading on Main Street.
Additional bus drop-off will occur at the north circular drive.
. Carmel Clay Schools and the construction team will review small trees not identified in the
survey after the layout of the site improvements has been completed. An attempt will be
made to save as many smaller trees as possible or adjust the layout as needed to save
some additional existing trees. Staff from the Department of Development could participate
in this review during construction if desired.
. The parking located along the curve of the new interior drive along the northwest side in the
proposed plan will be eliminated.
. Preliminary plans have been developed for an additional parking lot northeast of the building.
This parking lot would support and additional 152 spaces. These parking spaces are above
those required by the zoning ordinance when all of the parking available on the campus is
considered. The additional spaces are also not required during the school day to
accommodate staff and students permitted to park adjacent to the school. This additional lot
would provide additional parking only for event activities at the High School. Carmel Clay
Schools would like to have the option to work with the Department of Development staff in
determining the requirement and timing ofthis additional parking.

EMERGENCY PREPAREDNESS PLAN
CARMEL HIGH SCHOOL
Developed 1999 - 2000
Developed by Carmel Clay Schools and Carmel High School with assistance from
Carmel Police and Fire Departments
Plan provided to each staff member and included in each classroom
Plan provides general guidelines for numerous emergency scenarios requiring both
evacuation and remaining within the building.
Each classroom teacher is responsible to supervise the evacuation of their class and
students following the emergency evacuation routes from the building.
. Once outside the building the plan instructs classes to walk clear of the building leaving
driveways open for emergency vehicles. The class or group must be kept together and
attendance is taken. Complete evacuation of the building occurs in approximately 4-5
minutes.
Safety Zones within the building have been established if it is acceptable to return to the
building.
There is a designated evacuation site if the situation requires this portion of the plan to
be placed in affect. Other potential evacuation sites have also been established by
Carmel Clay Schools.
Carmel Fire Department will go to the main fire alarm panel location initially to
determine location of fire hazard and communicate with school administration. From
this location the remaining fire vehicles will be directed to the specific fire hazard
location and utilize the nearest fire hydrant and fire department connection.
Carmel Clay Schools Safety Officers will assist in directing traffic during an emergency
and maintaining emergency access.
If access is needed at the bus drop-off area, radio communication is available between
the buses and the administration to clear the bus area.

INTRODUCTION & SCOPE
A&F Engineering has conducted a Traffic Operations and Traffic Flow Study at Carmel High
School. The purpose ofthis study was to identify travel patterns as they exist today and to
develop and recommend travel patterns that could be used when a proposed freshman wing is
added to the existing high school. The recow..rtlended travel patterns are developed in order to
improve the traffic flow in and around the high school in conjuncbon with the opening of the
new wmg.
DESCRIPTION OF FUTURE EXPANSION
A freslunan wing is being planned by the Carmel-Clay School Administration. This wing would
house all existing and all future freshman attending Cannel High School. Approximately 960
freshman students are currently enrolled at the high school with approximately 240 more to be
added over the next ten years. In order to accommodate the new wing, changes will be made to
the internal roadway system and to the existing parking lot layout. Figure 1 shows the existing
school layout and the future school layout after the expansion is added.
FIELD REVIEW
A field review was conducted around and within the Carmel High School site during the
morning and afternoon peak hours ofthe school. As part of the review, entering and exiting
traffic flows were noted for all vehicles. In addition, all traffic control devices were documented
and their effect on traffic movement was noted. Finally, pedestrian movement into and out ofthe
site was observed.

Manual peak hour turning movement traffic volumes counts were collected by A&F Engineering
during a typical school day during the hours of 6:45 AM to 8:00 AM and from 2:30 PM to 4:00
PM. These counts were coIlected at the following locations:
]. Main Street and 41h A venue
2. Main Street and the High School Center Drive
3. Main Street and the High School East Drive

The traffic volume counts included all passenger vehicles, buses and commercial vehicles that
passed through the three data collection locations during the study hours. Figure 2 summarizes
the peak hOUT traffic volumes at each location. In addition to the traffic volume counts, special
notice was given to traffic queuing due to afternoon pick-up traffic at the front of the school.
PEAK TIME PERIODS
Carmel High School is in session from 7:50 AM to 3:05 PM Monday through Friday. Therefore,
morning drop-off traffic is greatest from 7:00 AM to 8:00 AM and afternoon pick-lIP traffic is
greatest between 3:00 PM and 4:00 PM. Physical traffic control barriers, traffic cones and
manual traffic control are used from 7:15 AM to 7:50 AM and from 3:05 PM to 3:40 PM to
direct traffic entering and exiting the high school.
EXISTING TRAFFIC FLOW ANALYSIS
Based on the traffic data collection and the field review, the ex isting traffic patterns and the
existing traffic control devices were graphically illustrated in order to develop a simplistic
snapshot ofthe existing traffic patterns. Figure 3 and Figure 4 show the existing traffic flows
and the existing traffic control devices used during the AM and PM peak time periods.
PROPOSED TRAFFIC FLOWS
\Vhen the proposed freshman wing is opened, traffic destinations will change due to the fact that
many freslunan students are dropped off in the morning and picked-up in the afternoon.
Currently, most ofthese drop-offs and pick-ups are done in front of the school off of Main
Street. However, the new wing will create a greater demand near the rear of the site. Thus,
future traffic flows need to be developed to accommodate these new traffic destinations within
the site. The proposed new traffic flow patterns and the resulting traffic control
reconunendations are illustrated on Figure 5 and Figure 6.

FUTURE TRAFFIC FLOW IMPROVEMENTS
When the proposed freshman wing is opened, the traffic patterns and traffic control methods
recommended in this study should be implemented. The following is a summary of the potential
traffic flow improvements that will occur due to these recommendations:
III A number of busses currently park on Main Street during the PM peak time period.
When the proposed expansion is constructed, the rear parking area will be used to store
these busses. Therefore, bus parking will be eliminated on Main Street.
o A significant number of pick-up vehicles queue in front of the school during the PM peak
hour while they wait for school to let out. At times, these queues can back up onto Main
Street. Due to the fact that a significant number of pick-ups are for freshman students,
these pick up trips will be diverted to the rear of the building when the expansion is
constructed. Thus, queuing onto Main Street from the front of the building is less likely
to occur.
II As part of the future expansion, the sidewalk that runs from the northern parking lot to
1361b Street will be widened and a barrier wall wiIl be constructed between the roadway
and the sidewalk. This barrier wall will discourage the use of the roadway by students
walking to and from the school during the morning and afternoon peak times. The
separation of pedestrian flows from traffic flows will increase safety along this roadway.
. The northern roadway that connects the northern parking lot to 136lh Street/Smokey Row
Road is currently dosed to vehicular traffic from 3:05 .PM to 3:40 PM. This roadway is
closed because students typically use the roadway to walk from the school to the stadium
parking lot. The construction of the barrier wall (discussed above) will separate
pedestrian and vehicular traffic. Therefore, this roadway will be opened during the PM
peak time once the expansion is completed. Opening this roadway for two way traffic
during the AM and PM peak hours will reduce the amount of vehicles accessing the front
of the building for pick-ups and drop-offs.
Ii A portion of an existing parking lot will be eliminated when the freshman wing is
constructed. However, a new parking lot will be constructed just west of the proposed
wing. The addition of this parking lot will ensure that future parking capacity will be
greater than the existing parking capacity.

Summary of Commitments made during February 24. 2003 Board of Zoninq Appeals MeetinQ
Following IS a summary of issues discussed and items committed to by Carmel Clay Schools during
the February 24, 2003 Board of Zoning Appeals meeting. These items will be incorporated into the
plans for the Freshman Center and can be made a condition of approval if required.
.. The Andich Property at 120 Sylvan Lane recently purchased by Carmel Clay Schools will
remain a residential property.
.. The proposed plan provides improvements to the student walkway along the north road and
the circular drop-off at the north entrance. These improvements will allow bus traffic to enter
the site from Smokey Row Road. This will eliminate the current bus loading on Main Street.
Additional bus drop-off will occur at the north circular drive
I) Carmel Clay Schools and the construction team will review small trees not identified in the
survey after the layout of the site improvements has been completed. An attempt will be
made to save as many smaller trees as possible or adjustthe layout as needed to save
some additional existing trees. Staff from the Department of Development could participate
in this review during construction if desired.
o The parking located along the curve of the new interior drive along the northwest side in the
proposed plan will be eliminated.
It Preliminary plans have been developed for an additional parking lot northeast of the building.
This parking lot would support and additional 152 spaces. These parking spaces are above
those required by the zoning ordinance when all of the parking available on the campus is
considered. The additional spaces are also not required during the school day to
accommodate staff and students permitted to park adjacent to the school. This additional lot
would provide additional parking only for event activities at the High School. Carmel Clay
Schools would like to have the option to work with the Department of Development staff in
determining the requirement and timing of this additional parking.

EMERGENCY PREPAREDNESS PLAN
CARMEL HIGH SCHOOL

Developed by Carmel Clay Schools and Carmel High School with assistance from
Carmel Police and Fire Departments
Plan provided to each staff member and included in each classroom
Plan provides general guidelines for numerous emergency scenarios requiring both
evacuation and remaining within the building.
Each classroom teacher is responsible to supervise the evacuation of their class and
students following the emergency evacuation routes from the building.
Once outside the building the plan instructs classes to walk clear of the building leaving
driveways open for emergency vehicles. The class or' group must be kept together and
attendance is taken. Complete evacuation of the building occurs in approximately4-5
minutes.
Safety Zones within the building have been established if it is acceptable to return to the
building.
There is a designated evacuation site if the situation requires this portion of the plan to
be placed in affect. Other potential evacuation sites have also been established by
Carmel Clay Schools.
Carmel Fire Department will go to the main fire alarm panel location initially to
determine location of fire hazard and communicate with school administration. From
this location the remaining fire vehicles will be directed to the specific fire hazard
location and utilize the nearest fire hydrant and fire department connection.
Carmel Clay Schools Safety Officers will assist in directing traffic during an emergency
and maintaining emergency access.
If access is needed at the bus drop-off area, radio communication is available between
the buses and the administration to clear the bus area.

INTRODUCTION & SCOPE
A&F Engineering has conducted a Traffic Operations and Traffic Flow Study at Cannel High
School. The purpose of this study was to identify travel patterns as they exist today and to
develop and recommend travel patterns that could be used when a proposed freshman wing is
added to the existing high school. The recommended travel patterns are developed in order to
improve the traffic flow in and around the high school in conjunction with the opening ofthe
new wmg.
DESCRIPTION OF FUTURE EXPANSION
A freshman wing is being planned by the Camlel-Clay School Administration. This wing would
house all existing .md all future freshman attending Carmel High School. Approximately 960
freshman students are currently enroHed at the high school with approximately 240 more to be
added over the next ten years. Tn order to accommodate the new wing, changes wiH be made to
the internal roadway system and to the existing parking lot layout. Figure 1 shows the existing
school layout and the future school layout afLer the expansion is added.
FIELD REVIEW
A field review was conducted around and within the Carmel High School site during the
morning and afternoon peak hours of the school. As part of the rev iew, entering and exiting
traffic flows were noted for all vehicles. ]n addition, all traffic control devices were documented
and their effect on traflic movement was noted. Finally, pedestrian movement into and out of the
site was observed.

DATA COLLECTION
Manual peak hour turning movement traffic volumes counts were collected by A&F Engineering
during a typical school day during the hours of 6:45 AM to 8:00 AM and from 2:30 PM to 4:00
PM. These counts were collected at the following locations:
1. Main Street and 4th A venue
2. Main Street and the High School Center Drive
3. Main Street and the High School East Drive
The traffic volume counts included all passenger vehicles, buses and commercial vehicles that
passed through the three data collection locations during the study hours. Figure 2 summarizes
the peak hour traffic volumes at each location. In addition to the traffic volume counts, special
notice was given to traffic queuing due to afternoon pick-up traffic at the front of the school.
PEAK TIME PERIODS
Carmel High School is in session from 7:50 AM to 3:05 PM Monday through Friday. Therefore,
morning drop-off traffic is greatest from 7:00 AM to 8:00 AM and afternoon pick-up traffic is
greatest between 3 :00 PM and 4:00 PM. Physical traffic control barriers, traffic cones and
mLillual traffic control are used from 7:15 AM to 7:50 AM and from 3:05 PM to 3:40 PM to
direct traffic entering and exiting the high school.
EXISTING TRAFFIC FLOW ANALYSIS
Based on the traffic data collection and the field review, the existing traffic pattems and the
existing traffic control devices were graphically illustrated in order to develop a simplistic
snapshot of the existing traffic pattems. Figure 3 and Figure 4 show the existing traffic flows
and the existing traffic control devices used during the AM and PM peak time periods.
PROPOSED TRAFFIC FLOWS
When the proposed freshman wing is opened, traffic destinations will change due to the fact that
many freshman students are dropped ofT in the morning and picked-up in the afternoon.
Currently, most of these drop-offs and pick-ups are done in front of the school off of Main
Street. However, the new wing will create a greater demand near the rear of the site. Thus,
future traffic flows need to be developed to accommodate these new traffic destinations within
the site. The proposed new traffic flow patterns and the resulting traffic control
recommendations are illustrated on Figure 5 and Figure 6.

walking to and from the school during the morning and afternoon peak times. The
separation of pedestrian flows from traffic flows will increase safety along this roadway.
e The northern roadway that connects the northern parking lot to I 36th StreetlSmokey Row
Road is currently closed to vehicular traffic from 3:05 PM to 3:40 PM. This roadway is
closed because students typically use the roadway to walk from the school to the stadium
parking lot. The constnlction of the barrier wall (discussed above) wi Il separate
pedestrian and vehicular traffic. Therefore, this roadway will be opened during the PM
peak time once the expansion is. completed. Opening this roadway for two way traffic
during the AM and PM peak hours will reduce the amount of vehicles accessing the front
of the building for pick-ups and drop-offs.
lit A portion of an existing parking lot will be eliminated when the freshman wing is
constructed. However, a new parking lot will be constructed just west of the proposed
wing. The addition of this parking lot will ensure that future parking capacity will be
greater than the existing parking capacity.

2. Carmel Clay Schools is also submitting a Dedication and Deed of Public Rights-of Way tor a
new right-at-way across the vacated parcels. This public right-at-way will allow a new portion
of public street to be constructed in order to reconnect Sylvan Lane and Audubon Drive.
These two streets are being disconnected as part of the Freshman Center Project at
Carmel High School. A legal description of the proposed right-af-way is included along with
two drawings showing the planned location across the property. The required forms are
being prepared and may require School Board signatures. They will be executed and
provided as soon as possible.
From our conversations there are still two items to be addressed regarding the parcels and proposed
plan, granting of an emergency access easement and vacation of the existing public right-of-ways.
The legal description of the emergency access easement is being finalized and will be submitted as
soon as possible for consideration at the next Board of Public Works and Safety meeting. The
vacation of the public rights-of-way will be submitted to the City Council.

Dear Board of Zoning Appeals Member:
This is one of those rare occasions when concerns raised at Plan Commission are of
sufficient merit to bring to you in writing.
Before you tonight is a 1,000-student expansion of Carmel High School in the form ofa
Freshman Center. Even the "revised" plan is need of your careful review because of past
planning shortfalls of a 3500 student school (presently 17 acres under roof) wedged onto
a very small parcel of land. The revised plan includes a new parking lot for 162, up from
the first proposaL showi~g a net parking inc~ease of only 17 (for 1000 students and 150
staff). It will help, but without adequately enlarging the site and improving the traffic
flow the current traffic/parking/safety problems will not abate.
Please speak up for grandparents and parents that faithfully witness their grandchild or
child's performance, sporting event or award ceremony. They now are forced to park in
adjoining neighborhoods and walk for blocks on icy, often snow-covered sidewalks to
attend, because of the glaring parking deficiencies.
Please consider the impact on adjacent homeowners, business owners and library
personnel who struggle with people who block driveways and choke streets during a
school calendar chock full of simultaneous high school and regional events.
Please speak up for the teachers and staff who have a constant concern for parking and
feel it is unfair to ask those who arrive a few minutes behind the "early birds" in the
winter to park Y2 mile away in the stadium parking. There has been no corporate office,
retail business or hospital permitted to "count" remote parking Y2 mile away, in Carmel.
Question the Chief of Police about the ~gers ofth~ proposed perpendicular parking
on the inside of a curve, directly across from the new pick-up/drop off area and backing
out blind between two SUV's into traffic on a curve. Ask him about the current traffic
problems caused by the lack of drop-offloick-up lanes in front of Carmel High SchooL

Please look closely at the need for a safe, dedicated bus staging area. A 4,500-student
high school is larger than all but a few colleges and universities in Indiana. Carmel High
School just last month. has resorted to staging some buses on Main Street.
Our community (owner) deserves better planning. The decision is in your hands.

It is normal to make the assumption that a plan proposed by a governmental agency has been
carefully reviewed. Unfortunately, in this case the site plan proposed by Carmel/Clay Schools is
flawed:
I
1) PARKING. Ifwe were reviewing a Site Plan for a new 1000 student high school the
parking requirements for teachers, administrators, support staff and visiting parents would be
substantial.
Question: Given the new 1000 student facility and existing parking deficiencies, what would
be reasonable in terms of additional parking spaces for teachers, staff and parents?
a) ISO?
b) 1 DO?
c) 50?
d) II?
Carmel/Clay School proposal: (d) A net increase of approximately 11 parking spaces.
Historically, parking requirements have been skirted by claiming the stadium parking.
However, the new additional staff alone will number nearly 100. While student parking is a
low priority, there are situations including medical, that require close-proximity student
parking. Even if only 5% of the projected student body need close proximity parking at any
given time, that would amount to 225 spaces. If20% of the students were involved in events
where a parent would attend ana given night, it would require in excess of 1000 parking
spaces, including teachers and staff.
The distance from the center afthe closest stadium parking lot to the nearest entrance is iust
over .4 miles. Tbe West stadium lot to the same entrance is over Y2 mile to the nearest
entrance. assuming security permits it to be unlocked.
Would we permit an office site plan to claim a parking lot Y2 mile away? Is it appropriate to
require Grandparents or very small children to walk Y2 mile to basketball games, fine arts
performances or PTO meetings in winter weather? It is fair to adjacent homeowners to force
parking onto side streets; blocking driveways because of poor pl~nning?

2) CONNECTOR ROAD DESIGN ( Re-routed street to connect 2nd Street to the North
parking lot)
The obvious questions are:
a) Why are they are proposing what is in effect, a four-way intersection only 50' from a
three-way intersection at the corner of 2nd Street and 4th Avenue? When school is let out,
there will be a convergence of schooL buses from the West lot, cars attempting to vacate
the new parking lot and through traffic from the North ]0t/136m Street. Stacking through
both non-signalized intersections couLd be problematic. Now add the students who walk
West into adjoining neighborhoods through these intersections. It is a poor design.
b) Why is perpendicuLar parking permitted on the inside of a curve? Visualize a mother in a
full size station wagon who is parked, waiting for her student, between a Mini-van with
tinted windows and a tall Suburban. She then attempts to back out, in the blind as the
other parked vehicles block her view, into through traffic. Compounding this dangerous
scenario is she will be backing. directly into a que line of vehicles at the curb in front of
the new Freshman Center. The pick-up/drop off traffic will not only include the current
student population, but the additional students generated by the 1000 student Freshman
Center. This is all happening on a curve.
c) How many cars can safely que-up in front of the proposed pick-up point before backing
up and blocking the parking lot curb cuts, effectively narrowing the width of an already
too narrow street, during the busiest time of the day?
d) Is there sufficient width to allow for easy passage of school buses and emergency
vehicles if other vehicles are "parked" on one edge of the roadway waiting for passengers
after a game or other activity? We must plan for today's reality. Fire trucks and
ambulances are large vehicles. Don't count on the other connector road East of Carmel
High School. It is only 16' wide and clearly substandard. So much for past planning.
To summarize, we have before us a site. plan that if built, may result in needless risk/injury not
mention a glaring deficiency in parking. The fact that Carmel/Clay S.choo] District is engaged in a
shortsighted attempt to minimize land costs does not relieve us of our responsibility to the
community. A school capital budget is separate and distinct from the operating budget under
Indiana Law. Additional land can be easily accommodated in the capital budget. It will not result
in any loss of teaching positions, as they are in the operating budget. The operating budget
challenges are due solely to an ill-conceived state expenditure cap per pupil, not Carmel/Clay's
growing tax base.
The original concept for 1000 student Freshman Center was a separate site with sufficient land.
That need still exists. It is time for both the School District and the community to face up to the
reality more land is necessary. Past planning errors should also be corrected during this last major
expansion to Carmel High School.
Should we not ask for a new site plan? ShouLd it not include additional land to properly
accommodate parking, improved connector road design, expanded pick-up/drop-off area and
proper buffering? The reputation of OUT school system is central to the future of Carmel/Clay.
The decision rests with you.

Dear Mr. McMichael:
You have asked that we prepare an opinion for your consideration on the following
question:
By seeking a plat vacation in order to facilitate planned construction at
Carmel High School, is the Carmel Clay School Corporation acting by and through
its Trustees liable for alleged or potential reduction in value of neighboring
residential real estate?
Our answer to this question is "No."
Reasoning:
Carmel Clay School Corporation is an Indiana Municipal Corporation governed
by both Indiana Constitutional provisions and state statutes. It is charged as a
governmental entity with providing for the common education of the citizens of its
district and, as such, it is empow~red to construct buildings and facilities necessary to
meet its legal duties and obligations. No other municipal corporation is entitled to inhibit
or impair or interpret the manner and means by which the School Corporation carries out
these duties. The construction and/or existence of a school in this specific area of the
community is permitted by underlying Constitutional and statutory law as well as by the
Carmel Clay Zoning Ordinances which recognize that a school is a permitted use
pursuant to special exception. There are simply NO reported cases in Indiana or
anywhere else that we have been able to find that subscribe to the theory that a
neighboring property owner is entitled to damages by virtue of the existence of or
construction of a school nearby which does not involve the actually "taking" of a part of
that neighbor's real estate.
The issue in the circumstances now prevailing may be drawn even more narrowly
and arises from the suggestion that the school corporation participate in some form of an
appraisal exercise sugge'sted during the Carmel-Clay Plan Commission Subcommittee
hearings. There, we understand, it was proposed that if the "before and after" appraisals

concluded that there is diminished value to the neighbor's residence following the
construction of the improvements proposed on the property being acquired by the School
Corporation, then the Schaal Corporation would be obligated to pay this difference
between the "before" value and the "after" value. For many, many reasons, we believe
that such an act would be inappropriate. Among these reasons are the following: (1) In
our opinion it would be contrary to law, for the reasons set out above; (2) Such payment
or payments could subject the School Corporation to an audit note from the State Board
of Accounts for improper payments; and, (3) Perhaps most significant, it could set a very
problematic precedent for all local government lmits, including the City of Carmel. As
noted above, there is no legal duty or obligation for governmental entities to pay damages
for using property that such lUlit owns for its governmental purposes. Distinguished from
actually "taking" property, or, exercising the power of eminent domain, this proposal
asks for the school to pay for exercising its right to "use" its property for its express
governmental purpose. lfthe same standard or precedent were applied to city, township,
library or other goverrunental "uses", you can readily understand there would be
resistance and a fundamental disagreement that any such legal obligation exists!
Potential Remedies for Neighbors:
In the event that any neighboring property ovmer believes
himself/herself/themselves to be damaged by reason of the use of the property owned by
the School Corporation or the act of partial or complete vacation of a plat by the Carmel
Plan Commission, the Courts of Hamilton County are open to seek redress. The means
by which the "use" issue can be tested is the filing of a complaint against the School .
Corporation for inverse condemnation. The Court will consider the question of whether
or not the actions of the School Corporation provide a legal basis for darri.ages. The
decision of the Court in such an event would resolve the question. The Carmel Clay Plan
Commission is not the place to address this significant legal issue.
Conclusion:
We have intentionally omitted legal citations from this letter but they are available
to you if required. We are familiar with the case knovm as the "Daniel's" case and
believe that it is distinguishable by virtue of the fact that the vacation of the plat in that
case was to facilitate a non-goverrunental use. We are also familiar with the case known
as the "Scott" case and it is also distinguishable because it deals with a private or non-
governmental use. With regard to the underlying legal citations as well as the case law,
arguments or discussions regarding their application are better suited for a courtroom.
For aU of the foregoing reasons, we believe that it would be inappropriate for the
School Corporation to agree to participate in a scheme that might result in unlawful
payments being made to neighboring owners of real property.

Local family struggles with property dispute
On a. sunny Saturday aftem~on, Marshall and Sandy A,ndich enjoy the view from

their kitchen window. In their backtard, their dog plays in the leaves that have fallen
from the trees. However, in less 'than tvvo months, the Andic:h family may have to leave
their house at 120 Sylvan Lane due to construction of a parking lot for the new freshman
center at this schooL

Marshall and$a:ndy have lived in Carmel for 32 years, and they have lived in
their house on Sylvan for 14 years. "(Marshall and I) thought this was going to be our
retirement home," Sandy said. "\Ve wouldn't have built next to a parking lot ifwe would
have knov..'l1 (this situation was going to arise)."
However, the current conflict that the A...ndich family is facing is not the fust
complication they have had v.rith the school system. Twelve years ago, the administration

acquired a large farm on SIUokey Row Road by declaring Beut domain, a legal term
that involves taking property from owners if it is necessal)' to facilitate the students. This
property was used to construct the football stadium and student parking lot. The school
~~em ~ought more property on A~ Drive, a meet near SylvW1 Lane located
directly east of this bllildmg, but the Audiches and a lleighborhood alliance were able to
stop the ad:ministratio,Il from seizing houses in the Local neigllborhood.
Now, this time around, the Andich family does not have a neighborhood alliance
behind them for support. "We don't have any support like we did 12 years ago when we
went through this," Marshall said.

-will affect Pocko, the family dog. According to :rvfa.rshall, Pocko's veterinarian informed
him that the dog might also suffer from headaches due to t~e high~pitched sounds. which
could come from the c.onstruction site.
W'hen construction begins in early spring, Marsh.all andSnndy have decided to
move into a differe~t neighborhood, permanently. "(Onr new residen.ce) isnot Hear as
nic,e as this house." Sandy said. "If (we were not facing this situation) we would not be
len"ing. .'
According to 1vfarshaH, the ideal situation at this point would be for the district to

purchase their home at appraised vahle bec.anse they are unhappy \\lith the construction of
the parking lot. In the beginning of the process, the district originally had th~ Audich
home appraised, and Marshall thought that they system would purchase the h(l use for
additional parking spaces.
However, that was not the cas:e. The diii1:rict used tax dollars to h.~ve the land
appraised. but it was pointless, Marshall said, beca1lse the system never intended on
buying their home for con!>truction.
According to Roger McMichael, assistant superintendent for business affairs, the
district doesn.ot need the Andich home for construction ofthe.parking lot. In addition,

Because of the parking lot being c.onstructed so close to their home, lV[arshall and
Sandy said thafthey are oonstantly worried about their upcoming financial situation. "\Ve
don't know if and when this house will sell," .MaIshall said. "\Ve 'ro probably going to
lose a lot of money. " If .Marshall and Sandy are unable to sell their home, they will be
paying taxes, insurance and utilities at both residences.
The trouble with the district is not the only source of pain for :Marshall and
Sandy. According to Marshall, there has been personal trauma involved as well.

Ac'oording to Sandy, .Marshalllies awake during the night bocause of all the stress from

this situation. In addition, Ma.rshall said thtlt he has lost inany bU:siness deals and taken
too much time away from his work in order to deal with this situation. '.We 've never had
, this kind of trauma before," Marshall said.
Marshall also said that students have wandered onto his property after school to
smoke Vrith their friends and he has had to ohase these kids aWay on several occasions. In
addition) student drivers drive .50 to 60 miles per hour do~ the street after school and
often do not abide by the stop signllin the area.
Furthermoro, !\1arshall and Sandy said that although they have been in the
commUnity longer than most members of the administration have, Marshall and Sandy's
feelings 2re not im.portant. Marshall was born and raised in Kokomo, and both he and
Sandy graduated from state universities. "1 was taught to have"respect for your elder~,"

Sandy said. "Some students thought (that us being in this situation and having to move
out) was OK because we were just old people."

'"(The situation) has caused us a Lot of grief all year long," Marshall said. "It has
just c.aused undue strQss."
Although the situation discourages the whole family, Marshall and Sandy said
they pLan to fight until the end. "So far, I have made a little bit of progress, but not
enough at this time," Marshall said.
According to Charles Tyler, the architect from Fanning/Howey Associates who is
in charge of the freshman oenter, the residents who 'Will remain on Audobon and Sylvan
after the construction will receive several accommodations after construction of the
parking lot. First, the entrance to Audobon Drive from the s'chool will be blocked and
become only a sidewalk for emergency vehicles. In addition, Tyler said that tho architects
are attempting to maintain II sizeable buffer between the properties that will remain on
Audobon and Sylvan after construction is complete.
f After the family attends a planning.commission meeting at City Hall later this
month to find out the l~te6't information on the con6truction of the parking lot, they will
deoide the next. step in their fight 'Nith the district. Marshall said that if not everything
goes well at the meeting, he and his wife could take their argument to the legal system.
Although Marshall said he iliJ dif>appointed about giving up his house because he
likes being close to the downtown area so much, he still has some hope that the district
could purchase their home at appraised value so they do not have to pay taxes on two
houses.
"CThis situation) is the last thing that we wanted to enter onr lives," Marshall said.

1. On sheet G4.2, the tree and shrub planting detail note which states 'Place soil
ball slightly higher than grade," needs to be changed to read 'Place Root Flare
of Plant Material Slightly Higher Than Grade."
2. On sheet L 1.2 for the trees labeled eCl please use a Malus species that is
included in the Indiana Urban Forest Council's list ofrecommended Malus
(crabapple) species list. 'Louisa' is included in that list. Thornless hawthorn
varieties are not recommended because of insect and disease pests in this area.
3. Please include graphic details and narrative describing the tree protection
measures being taken to insure the preservation of the existing mature trees
that will remain on the site.
4. In the planting notes, please include a note specifying that stakes and wires
must be removed after one year from planted or transplanted trees.
5. The south east side of the mound located in the west-northwest corner ofthe
site may need to be screened more heavily for sight buffering from the
neighbors to the north-west. Ornamentals or medium maturing native shade
trees could be well used here.

Attached is the boundary description used in the public notice. This legal was generated to include the
entire property now owned by Carmel Clay Schools including the recently purchased properties being
vacated.
We asked the Hamilt()n County Auditor when obtaining the adjacent property owner listing about the three
lots previously purchased by Carmel Clay Schools. These lots are identified with Parcel No's
161030010200701,1610300102008000 and 1610300103012000. The Auditor's office indicated their
records showed these three parcels being vacated and recorded on 8/14/91. We don't know the process
that was done at that time, but they appear to have gone through some vacation process.
Please advise if you have any questions or if modifications still need to be made to the request.

Dear Mr. Cradler:
We have reviewed the plans submitted for this project. We offer the following comments:
1. Vacation of dedicated right of way requires Carmel City Council approval. Dedication of right of
way requires Board of Public Works and Safety approval.
2. I am enclosing an example of a dedication ofright of way form This form may be electronically
transmitted to you if you so desire.
3. Why isn't that portion of Audubon Drive between the two vacated streets being vacated? Isn't this
currently a dedicated street?
4. It would be helpful if an additional sheet could be provided that would show the existing with the
vacated overlaid in dashed or lighter lines or vice versa and without the detail presently shmvn.
5. It would also be helpful if the location of existing streets could be indicated beyond the extent of
the arc as proposed to be vacated. Perhaps this could be combined with thc request in item 4
above.
6. Please providc existing and proposed street names in a more prominent manner. They are very
hard to read, particularly on sheets 1,2,3 and 4.
7. Will the right of way and plat vacations be submitted together or separately?
This is the extent of our comments at the present time.

Soils Information for new site:
Miami silt loam, 2-6 percent slopes- this soil is light colored, silty in texture and on sloping
uplands. It is deep and well drained with moderate permeability. It has moderate available water
for plant growth and a mecIiumorganie matter content. It has compact till starting at a depth
between 20- 40 inches. The main soil features that adversely affect urban development uses are
moderate potential frost Cletion, moderate shrink-swell potential, moderately slow permeability,
low strength and erosion during construction.
Additional information about soils is available in the "Soil Survey of Hamilton County". The engineer and/or
developer should consider the need for an onsite soils investigation.

The following is a report of our meeting on the above date. If you find anything with

Purpose:
Review of the site plan and vehicle circulation around the Freshman Center.
1. Fanning/Howey Associates, Inc. reviewed the. revised site plan layout and proposed drive
configuration at the northwest side of the campus. The following comments were made:
a. The drive has been reconfigured and pulled away from the adjacent residential
properties, where possible.
b. The proposed plan disconnects the High School drive from the adjacent
neighborhood. Sylvan Lane and Audubon Drive will be connected across one of the
residential properties purchased by Carmel Clay Schools.
c. An emergency only access drive is proposed between the High School drive and the
connected Sylvan Lane and Audubon Drive. The emergency access was reviewed,
and found to be acceptable to the Carmel Fire Department. The emergency access
was required in order for the Carmel Fire Department to support the Plan.
d. The emergency access lane could be upgraded to a temporary street, if required,
until the connection of Third Street and Sylvan Lane is completed, This optIon would
allow traffic to flow back into the neighborhood from the High School and not
eliminate the current concerns of the neighbors.
e. Additional green space may be considered adjacent to the main entrance for the
Freshman Center.
2. All parties felt the majority of the adjacent Property Owners would support this plan. Some
Property Owners on Syl,,:,an Lane have voiced concerns about the disconnection of the
current street system to both the City of Carmel and Carmel Clay Schools.

3.. The current plan eliminates approximately 132 parking spaces and adds a total of
approximately 200 parking spaces.
4. The parking previously discussed, in the northeast area of the campus, will not be needed to
replace the lost parking. The parking in this area was not included in the original Project
budget.
5. The intersection of the High School Drive, with Second Street and Fourth Avenue, should be
reviewed further. There are a number of entrances occurring at this location. The new drive
cannot align with Second Street and remain on the property recently purchased by Carmel
Clay Schools.
6. Fanning/Howey Associates, Inc. will review having the new drive align with one of the
existing entrances heading north out of the west parking lot. One of the entrances heading
west out of.the west parking lot could be removed to help focus traffic toward one location.
7. Sidewalks should be shown on the upcoming plans. T.he emergency access point could be
an enlarged sidewalk area. One of the concerns of adjacent Property Owners was losing a
pedestrian walk connection to Main Street.
8. The pedestrian walk should extend along the north side of the new drive and connect to area
north of the High School building.
9. The configurations of Sylvan Lane and Audubon Road should anticipate future curbs and
sidewalks to match those being done elsewhere in the area. It may not be beneficial to ,
include those improvements for a short stretch of road at this point. Carmel Clay Schools
would provide these improvements at a later date, if required. These issues should also be
reviewed with the City of Carmel Department of Engineering.
10. The parking spaces that would bave vehicles backing up into the maIn drive should be
reviewed and reconfigured, if possible.
11. Plat vacation, right-of-way, vacation and right-of-way grant will be required for this Project, as
the Project continues through the proper City of Carmel approvals processes.
12. An emergency access easement should be granted to the City of Carmel for the emergency
access point. This should be reviewed with the Carmel Fire Department.

provided us with information on the existing parking spaces. We then evaluated the number of
classrooms in the existing building and the proposed additions.
We used the 10 spaces per classroom requirement, noted in the Zoning Ordinance, to determine the

As we continue to prepare the Informa.tion required for the various submissions of this Project, we
woufd appreciate your review and comments on the enclosed document Staff at the High School
provided us with information on the eXisting parking spaces. We then evaluated the number of
classrooms in the existing building and the proposed additions.
We used the 10 spaces per classroom requirement, noted in the Zoning Ordinance, to detetmlne the
number of parking spaces required for the entire campus
Did we select the proper requirement from the Zoning Ordinance? Does our evaluation appear
appropriate for this Project?

Allen J. Cradler, Fanning/Howey Associates, Inc. .
Purpose:
This meeting was held to further review the street alignment and traffic issues
relating to the Freshman Center Project.
1. A plan was presented based on previous discussions about disconnecting the circulation
drives for the High SGhool campus from the adjacent city streets. The plan would eliminate
any connection to the adjacent neighborhood from 2nd Street and the traffic from the High
School campus.
2. A number of adjacent. property owners at the recent neighborhood meeting indicated one of
their biggest concerns with the Project was the additional traffic, both vehicular and
pedestrian, generated that could go through the neighborhood. Eliminating any route
allowing traffic from the High School campus into the neighborhood, they feel, would be a
benefit.
3. The proposed plan was developed with input from the Carmel Clay Schools Administrative
Team after discussions regarding a number of different options. The use of the roundabout
was thought to help control vehicle speed and ease the intersection of the drive and parking
a rea.
4. The internal road around the northwest side of the High School campus would be a private
drive for the High School campus. The connection of Sylvan Lane and Audubon Road would
become a portion of the public street.
5. Gary Hoyt with the Carmel Fire Department should be consulted about the potential
emergency access issues if the neighborhood would be disconnected from access via 2nd
Street.
6. An evergreen buffer would be provided along the adjacent properties and the internal road.

7. As mentioned in the last meeting, the vacation of plats purchased by the School and the
existing street rights-of-way would have to be requested and presented before the Plan
Commission.
8. All parties understood that the elimination of the connection between the School and
neighborhood would benefit both areas and eliminate current frustration and complaints by
the neighborhood.
9. The City of Carmel is concerned about eliminating one means of access into the adjacent
neighborhood. Public security and emergency services need to be considered for this area.
The elimination of the second access point makes the properties on Sylvan Lane the end of
a long dead end street not desirable, in most circumstances.
10. The City of Carmel would like to see the connection of Sylvan Lane and 3rd Streetto the west
considered in order to provide the two access points required for the neighborhood.
11. Additional property acquisition ,and off-site improvements would be required of the Freshman
Center Project in order to meet this requirement.
12. The plan presented is a result of an attempt to sol\le concerns about an existing condition
and make improvements to that condition during the proposed Project. Previous plans
presented to the City of Carmel and the neighborhood suggested a realignment of Audubon
Road and maintaining the connection of the School circulation routes with Audubon Road.
13. The' realignment of Audubon Road in order to maintain the two points of access to the
neighborhood could still be incorporated if the proposed disconnection is a concern or the
extension of 3rd Street became a requirement of the proposal. However, the realignment of
Audubon Road doesn't resolve the major concerns of the adjacent property owners,
14. An intermediate step could be to provide a temporary connection to the neighborhood using
the proposed intern'at road for the High School campus that would be eliminated when
3rd Street would be extended to Sylvan Lane. There is the potential for other parties to
develop surrounding area and extend 3rd Street in the future.
15. The Department of Development would have to be comfortable with the proposed plan in
order to make a positive recommendation to the Plan Commission. The Plan Commission
could still require improvements beyond those desired or not approve the proposed plan for
the plat vacation and right-of-way vacation.
16. The adjacent property owners and public safety officials would also have to support the
proposed plan to disconnect the neighborhood without the connection to 3rd Street. This
would benefit the proposal when presented to the Plan Commission.
17. Other traffic calming devices should be considered to control vehicle speed along' the internal
clrculation routes. Other options may make a temporary connection easier and provide
additional space for landscape buffering.

18. Allowing the parking areas to extend to the perimeter circulation route instead of separating
the perimeter circulation would also help control vehicle speed within High School campus.
19. A 50' wide buffer between the proposed parking or road areas and the adjacent properties
should be sufficient and would exceed the .zoning ordinance requirements.
20. The plat vacation and right-of-way vacation process should be started as soon as possible.
The details of the entire site development are not required for this process. The Plan
Commission will not be reviewing zoning ordinance issues such as parking or landscaping as
part of the plat vacation process.
21. Fanning/Howey Assocjates, Inc. will meet with the Carmel Fire Department and further
develop options for the internal road circulation for review by the City of Carmel and the
adjacent neighbors.

Purpose:
This meeting was held in Roger McMichael's office to review proposed buHding
additions and their impact on surrounding roads, residential areas, and city
infrastructure.
1. BiJl Payne explained that the primary location for new construction for the Freshman Center
would occur in the knuckle area. Appraisals are being sought for five adjacent residential
properties in consideration of the potential to purchase these properties. Should the School
Corporation purchase these properties, greater design flexibility would be allowed for
building additions and additional buffer space could be provided for parking and drives
between the Freshman Center and adjaCent residential properties.
Concerns have been expressed by adjacent property owners regarding traffic, the speed at
which cars are driving, and noise. Bill Payne questioned whether the City of Carmel is
considering any road improvements or extensions that might help this situation.
2. Kate Weese explained that the City of Carmel does not have any plans for further road
construction or extensions in Old Town area.
3. Mike Hollibaugh noted that the Department of Community Services would support continued
dialogue on the improvement of traffic circulation in this area. The Department of
Community Services does not have any specific objections to the approach that this Project
is taking in terms of providing premiere High School facilities with appropriate traffic
circulation and parking.

4. Participants generally agreed that additional detention facilities were probably not provided
south of Smokey Row Road in the previous bullding Project at Carmel High School. Kate
Weese supports the concept of "beating the peak" by directing any increase in storm water
flow to Cool Creek. This viewpoint may not be held by the County Surveyor's Office.
