Petitioner seeks a Development Standards Variance of 923CIO.02(2) of the US 42l!?vfichigan
Road Overlay Zone requirements in order to forego installation of foundation plantings along the
east side of the building.
The site is located at 4335 West 1061h Street The site is zoned B-3/Business within the US
42] /Michigan Road Overlay Zone.

Areas to be Landscaped:
Foundation Plantings. Foundation plantings shall be included along
all sides of any building. The minimum width of the planting area
shall be five (5) feet, except that when adjoining a parking area located
in the front yard adjoining u.s. 421, the minimum width shall be ten (10)
feet.
On July 28, 1999, the Board approved Docket Nos. SU-49:"99 and V-SO-99 for this site.
Docket No. V-SO-99 was to. allow the building to be constructed without the eight-foot fayade
offsets required in the US 421 Overlay Zone. The plans approved with Docket No. SU-49-99
included foundation plantings on the east side of the building, During a site inspection
conducted in November 2002, the Division of Planning & Zoning discovered that the Landscape
Plan had not been executed as approved. At the December 3, 2002, Special Study Committee
meeting, the Plan Commission approved a revised Landscape Plan that di d not include
foundation plantings on the east side of the building.
The Department recommends favorable consideration of Docket No. V-207-02 consistent
with the Plan Commission's approval of Docket No. 173-02 ADLS Amend.
