Enclosed are copies of the Right- of -Way dedications for the University High School Property.
As you can see, the dedications are contiguous and include the three parcels which you thought
were missing. In fact, the Auditors map indicates that there is no dedication along the three
parcels so I can understand why you thought it was needed,

After our phone conversation, I pulled out the Hahn Survey dated August 29,2000 and
compared the survey with the legal description appearing as Exhibit A to the Special
Warranty Deed recorded on October 6, 2000 and confirmed that the legal description and
survey of the 11.882 acres match. This letter will confiml that the school owns no other
real estate at this point. As I explained, the school is ground leasing property from 1 1 6th
and Towne Partners, LLC pursuant to a ground lease. Hopefully, this letter clears up any
confusion regarding UHS property ownership. If you have any further questions, please

Thanks fof c/' hone call.\~:nere are two issues that still need revision. The first is comment #2 in my
comment lettef~~Jenillig and I think that this issue should be settled at tIus time instead of waiting until
a later phase.
2. In the future, the drive from the east curb cut will be connected to the drive from the central curb cut.
It does not make sense to plant landscape materials in conflict with that connection at this time. The
connecting drive should be planned at this time, and large or valuable landscape materials should not
be planted within that area.
Additionally, though we have discussed the buffering requirements before, I checked the original primary plat
and there was a substantial buffer planting on the north section ofthe west perimeter: 18 spmce, 14 crabapple,
and two ash. There are now just 15 pine trees there. The 19 remaining trees need to be planted at this time. I
can accept species substitutions, but the species must have my approval. This planting needs to be shown on the
plan and improve the buffer planting already in place.

contact you to obtain information from you as to what you want to have in hand from us to enable you to give the
appropriate permits for us to get started with construction. Jackie may need your guidance in what you need to have
to satisfY our obligation to comply the recommendations of T AC.
In addition, it was my understanding that you were going to send me some language that you wanted us to
put in the commitment for putting in the sidewalks when appropriate, and also I believe that there was a commitment
that we would come back to the Board of Zoning Appeals if we were still going to be using modular units after the
next three years or in the time trame Please let me have that information as soon as possible, and I will put together
the documents you want to have us record when I get back in the office.

This letter serves to ackrJDwledge receipt of a transmittal received 1/21/03 containing the
plans for the above-mentioned project. After reviewing the plans the Highway
Departmenl has the followi ng comments (several of the following comments are from a
letter date 12130102):
1. An agreement for rem.oval of the exls~ng entrances will also be needed before
approvals of tl1e permits are granted. Please draft an agreement regarding the
removal of the temporary entrance when the entrance is no longer needed.
.2. Permits will be required for the entrance construction. Please contact Mr. Robb
Chadwell. Highway Department Permit Inspector, for all necessary information on
the peMit process. Entire sets of construction documents wlll need to be submitted
with the permits.
3. It appears that the dedication of right of way that was done durlng the original
approval procesBwas not correct. A small triangular piece was omitted at the eastern
end of the property. Please prepare ~he proper legal description and dedication of
right of way forms.
4. T1"1e submitted revisions 'appear to be correct except for one item. The lane width for
the through eastbound lane and decellane should be 24' from the bulb of the
pavement markings. not the begInning of the taper as shown on the submIttal. I have
included a mark up showing the areiil. Please make the necessary corrections.

Laurence Lillig, Planner for the Department of Community Services (City of Carmel),
loaned me a copy of your revised plan, which he received today. I have not yet received
a set for Urban Forestry review. My comments are as follows:
1. In the Teclmical Advisory Committee meeting on December 18, 2002, there
were several comments made that have not been corrected:
A. On the tree planting graphic detail #2, "top of ball" needs to be changed to
"root flare.
B. Perimeter buffering plantings for the site are required as found in
Ordinance 26.4. These have not been shown on the plans. Buffering
plantings do appear onthe original master plan, and are required to begin
at this stage of development. As stated in T AC, the 1 16th perimeter falls
under institutional to arterial buffering, and the remaining sides are
institutional to residential buffering. Buffering plantings on perimeters
that fall within your limits of construction must be shown on this plan.
2. In the future, the drive from the east curb cut will be connected to the drive
from the central curb cut. It does not make sense to plant landscape materials
in conflict with that connection at this time. The connecting drive should be
planned at this time, and large or valuable landscape matetials should not be
planted within that area.
3. Species comments:
A. Do not use "Snowdrift" crabapple because of disease and insect problems
in this area. Please choose a species from the Jndiana Urban Forestry
Council's recommended crabapple species list (see attached list).
B. Do not use Austrian Pine (Pinus nigra) because of disease and insect pest
problems in this area. Choose an alternative evergreen species such as
other green spruce (Picea), or fir (Abies).

C. Red Maple tends to be easily injured, over-planted, stressed by neutral
clay soils, shallow-rooted and sometimes invasive. In the grove of six
shade trees surrounded by the portable classrooms and in the parking lot
islands, please choose an altemati ve native shade tree species such as
tupelo (black gum, Nyssa sylvatica), sassafras, at red or scarlet oak
(Quercus spp.) if similar fall color is desired.
D. Sweetgum (Liquidambar styraciflus) is not a desirable tree around streets
and parking lots: becomes chlorotic (yellows and dies back) in neutral pH
soils, has problems with excessive fruit drop, and is weak branched and
subject to sudden limb drop. Please choose a more suited native shade
tree for planting around the parking lot south of the east driveway such as
oak (except pin oak), ash, hickory, hornbeam, tuliptree, beech, or possibly
ginko.
4. There are no total species numbers on the plant schedule. Please add the total
number of each species to the plant schedule.
5. There is new plant material shown around the new (school) building addition.
This plant material is not "called out" or identified by species. Please identify this
material by species.
6. A note needs to be added that requires all tree staking and guying wires to be
removed after one year.

Dear Mr. Lillig:
The purpose of this letter is to address the issues raised in the Technical Advisory
Committee meeting held on December 18, 2002 and our other discussions relating to the above-
referenced zoning matter.
Pursuant to your request and the Department's report for the January 27, 2003 Board of
Zoning Appeals meeting, my client agrees that a 70-foot half right-of-way for West 116th w.ill be
dedicated across the entire frontage of the several properties. Recorded copies of the right-of-way
dedication will be filed with the Division of Planning and Zoning prior the issuance improvement
location permits for the present project.
In addition, my client understands that approval of the application is contingent upon
satisfying various issues raised by members of the Technical Advisory Committee. My client
agrees to these requests. We believe the more significant of these to be as followS:
1. Representatives of Odle McGuire & Shook will confirm that the request set f011h in
John South's letter sent to Ben Rawlins has been complied with in regard to a
construction time line.
2. A letter from the County Highway Department will confinn that all requests made by
the Department have been resolved. This includes an agreement by the applicant that

the residential drive of the headmaster ofthe school will only be used temporarily as
a commercial drive.
3. We wi1l provide the Department of Community Services with a property description
of the combined properties into a single tract that are presently being used by the
school.
4. The applicant will obtain a commercial permit for the farmhouse that is presently
being used by the school administration
5. As indicated on the site plan, the applicant agrees to put an asphalt path for pedestrian
traffic along the 116th Street property line. However, as we have discussed, the
applicant would like to defer doing this until such time as there is a need to do so.
There is open property to the east of the project and also to the west. The applicant
will commit that when development is started on the adjacent properties, the path
would be developed pursuant to code and tied into the new projects' pathways.

Dear Mr. Myrick;
This letter serves to acknowledge receipt of a transmittal received 12/6/02 containing the
plans for the above~mentloned project. After reviewing the plans the HIghway
Department has the following comments:
1. The proposed entrance at the existing home will need to be permitted through the
Highway Department. A commercial drive psrmi1 wlllbe required for this location.
Details of the entrance should be provided wlth the construction plans. All work to be
done within the 116lh Street right of way WIll need to meet country standards for
pavement depth. The pavement section will need to be a 1411 stone base, 5" HAC
binder and 1" HAC surface.
2. The proposed eastern entrance will need to be constructed to the full standard,
within County right of way, at this time. Later Improvements to the entrance will not
be permitted. Complete sets of construction plans and details must be 5ubmltted for
review and approval. Commercial drive permits will also be required.
3. All road widening will also need to be completed at this time. 116'" Street will need to
be widened from the west entranc:e to tl1e eastern property 11ne.
4. AccelJd ece I lanes as well as left turn lanes will also be required at the eastem
entrance.
5. An agreement for removal of the existIng entrances will also be needed before
approvals of the permits are granted, Details of the agreement wHl be discussed at a
later date.
6. The pavement section for all improvements with," the 11Slh Street right of way shall
match the section listed in item #1.
7. Please note that decorative signs, sprinkler syStems, trees. l,i:lndsc:.aping mounds,
fences, light poles or other such amenities are not permitted in the right of way.
8. Any work to be performed within County right of way will need to be permitted
through this office. Please contact Mr. Robb Chadwell, Highway Department Permit
Inspector, for all necessary ,nforma'ion on the permit process.
9. Please submit the construction plans for the road improvements and entrances as
well as all necessary details for further review,

Hello everyone:
Following are CTRWD comments on the agenda items effecting our sanitary sewers or service
area for the December 18, 2002 TAC meeting. Please feel free to copy and distribute this
email or attach it to your meeting minutes. We have also created a new page on our

2001 and 2002 meetings held to date. We will continue to add to this page every month so

Village of Mount Carmel, section 10 (Primary Plat)
The District has not received any plans for this proposal. Building permits should NOT be
issued unless the District has issued connection permits.
Wexley Chase (Primary Plat)
The plans received by the District show the sanitary main lines and manholes, but will
need to be revised to show sewer profiles, manhole, lateral and bedding details. The
District's most recent version of sanitary sewer specifications also needs to be included
on the plans. Revised plans need to be submitted. A preconstruction meeting will need to
be held before the construction of the proposed sanitary sewers. Building permits should

Gentlemen:
Enclosed are drawings for future expansion of the University High School Campus
located on 116rh Street, west of Towne Road.
We are requesting your review and comments. We are scheduled to present to the
Technical Advisory Committee on December 18.
The future work includes a classroom and cafeteria/auditorium addition to the
existing building and the addition of 12 portable classrooms with new parking and
paved walks. All work, other than additional excavation for storm water storage in
the dry detention basin, is located north of the Panhandle Pipel ine Easement.
The enclosed drawings include site layout, grading and landscape plans as well as
architectural floor plans and building elevations.
Please let me know if you have any questions before the December 18 T AC meeting.
