MEETING MINUTES
MONDAY, JULY 7, 2008 - 6:00 P.M.
COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE
MEMBERS PRESENT:
Mayor James Brainard, Council President Richard L. Sharp, Council Members W. Eric Seidensticker,
John V. Accetturo, Joseph C. Griffiths, Luci Snyder, Ronald E. Carter, Kevin Rider, Clerk-Treasurer
Diana L. Cordray and Deputy Clerk-Treasurer Lois Fine.
Council President Sharp opened the meeting at 6:03 p.m.
Councilor Seidensticker pronounced the Invocation.
Council President Sharp led the Pledge of Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
There were none.
APPROVAL OF MINUTES:
Councilor Seidensticker made a motion to approve the Minutes from the June 16, 2008 Regular Meeting.
Councilor Snyder seconded. There was no Council discussion. Council President Sharp called for the
question. Minutes were approved 7-0.
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:
There were none.
COUNCIL MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
Councilor Carter thanked the Carmel Rotary Club, Carmel Street Department and Northview Christian
Life for the quick clean-up of Carmel Fest on July 4`h so that the Farmer's Market could open on July 5m.
ACTION ON MAYORAL VETOES:
There were none.
CLAIMS:
Councilor Griffiths made a motion to approve the Claims in the amount of $7,395,150.22. Councilor
Snyder seconded. There was no Council discussion. Council President Sharp called for the question.
Claims were approved 7-0.
COMMITTEE REPORTS:
Councilor Snyder reported that the Finance, Administration and Rules Committee met and discussed the
first two items of business on this agenda and will be reported later on the agenda.
Councilor Griffiths reported that the Land Use, Annexation and Economic Development Committee had
not met. The next meeting will be held on Thursday, July 10, 2008 at 5:30 p.m.
Councilor Carter reported that the Parks, Recreation and Arts Committee had not met. The next meeting
will be held on Tuesday, July 8, 2008 at 3:00 p.m.
Councilor Seidensticker reported that the Utilities, Transportation and Public Safety Committee had not
met.
OLD BUSINESS
Council President Sharp announced the Eighth Reading of Ordinance D-1887-08 As Amended; An
Ordinance of the Common Council of the City of Carmel, Indiana, Issuing City of Carmel, Indiana
Waterworks Revenue Bonds of 2008, in one or More Series, in an Original Principal Amount not to
Exceed Eighty Five Million Dollars (5'85,000,000). Councilor Snyder reported on the actions of the
committee. Councilor Seidensticker made a motion to amend VERSION A 4/21/08, and move into
business VERSION B 7/7/2008, for discussion and proceeded to read the suggested changes. Council
President Sharp made a motion to suspend reading of the-last pages. Councilor Rider seconded. There
was no Council discussion. Council President Sharp called for the question to discuss Ordinance
D-1887-08 As Amended VERSION B 7/7/2008. The motion was approved 6-1 (Councilor Griffiths
opposed). There was brief Council discussion. Mayor Brainard addressed the Council. Council
President Sharp called for the question to adopt Ordinance D-1887-08 As Amended VERSION B
7/7/2008. Ordinance D-1887-08 As Amended VERSION B 7/7/2008 was adopted 6-1 (Councilor
Griffiths opposed).
Council President Sharp announced the Second Reading of Ordinance D-1897-08; An Ordinance of the
Common Council of the City of Carmel, Indiana, Re-Establishing the Tax Leery for the City of Cannel
Cumulative Capital Development Fund and Amending Carmel City Code Chapter 2, Article 4, Section
2-91. Councilor Snyder presented the committee report and made a motion to move into business
VERSION A - July 7, 2008 for discussion. Councilor Griffiths seconded. There was no Council
discussion. Council President Sharp called for the question. The motion was approved 7-0. Council
President Sharp called for the question to approve Ordinance D-1897-08 As Amended VERSION A -
July 7, 2008. There was no Council discussion. Ordinance D-1897 As Amended VERSION A - July 7,
2008 was adopted 7-0.

Council President Sharp announced Resolution CC-07-07-08-01; A Resolution of the Common Council
of the City of Carmel, Indiana, For Designation of the. Attached Property as an Economic Revitalization

Snyder made a motion to move this item into business. Councilor Griffiths seconded. Councilor Snyder
presented this item to Council by reading the resolution in its entirety. There was no Council discussion.
Council President Sharp opened the Public Hearing at 6:55 p.m. Seeing no one who wished to speak,
' Council President Sharp closed the Public Hearing at 6:56,.p.m. Councilor Griffiths made a motion to
approve Resolution CC-07-07-08-01. Councilor Rider seconded. There was no Council discussion.
Council President Sharp called for the question. Resolution CC-07-07-08-01 was adopted 7-0.

Council President Sharp announced the First Reading of Ordinance D-1898-08; An Ordinance of the
Common Council of the City of Carmel, Indiana, Adding Chapter 8, Article 5, Section 8-47(a)(35) to the
Carmel City Code (No Parking-Areas). Councilor Seidensticker made a motion to move this item into
business. Councilor Griffiths seconded. Councilor Griffiths presented this item to Council. There was
no Council discussion. Councilor Seidensticker made a motion to suspend the rules and not send this
item to committee and vote this evening. Councilor Griffiths seconded. There was no Council
discussion. Council President Sharp called for the question. The-motion was approved 7-0. Councilor
Griffiths made a motion to approve Ordinance D-1898-08. Councilor Seidensticker seconded. There was

adopted 7-0.

Councilor Seidensticker made a motion to move this item into business. Councilor Accetturo seconded.

ordinance for July 21, 2008. Councilor Seidensticker referred to John Duffy, Director of the Carmel
Utilities, to present this item to Council. There was no Council discussion. Council President Sharp
referred Ordinance D-1902-08 to the Utilities, Transportation and Public Safety Committee for further
review and consideration.

this item into business. Councilor Seidensticker seconded. Councilor Accetturo presented this item to
Council and referred to John Duffy, Director of the Carmel Utilities, to address the Council. There was
no Council discussion. Council President Sharp referred Ordinance A-96-08 to the Utilities,
Transportation and Public Safety Committee for further review and consideration.

Council. Mayor Brainard addressed the Council. Councilor Griffiths referred to Steve Pittman, Pittman
Partners, 11711 N. Pennsylvania Avenue, #260, Carmel, IN 46032, to present, additional information to
the Council. Also in attendance was Nick Churchill with Pittman Partners, Paul Rioux with Platinum
Properties, Rich Starkey with Baker & Daniels and Loren Matthes with Umbaugh. There was extensive
Council discussion. Councilor Snyder requested Council President Sharp to send this item to committee
so that a public hearing could be held so that the public understands what is happening in their area.
Council President Sharp stated he would not send this item to committee. Councilor Snyder requested an
appeal from Council President Sharp's decision. Council President Sharp called for the question to
support the decision of the chair. The decision of the chair not to send this item to committee Failed
2-5 (Councilors Accetturo, Griffiths, Snyder, Carter and Rider opposed). Councilor Snyder made a
motion to suspend the rules and send this item to committee. Councilor Carter seconded. There was no
Council discussion. Council President Sharp called for the question. The motion was approved 6-1
(Councilor Seidensticker opposed). There was brief Council discussion. Council President Sharp passed
the gavel to Councilor Snyder to address the Council. There was brief Council discussion. Council
President Sharp reclaimed the gavel from Councilor Snyder. Council President Sharp referred Resolution
CC-07-07-08-02 to the Land Use, Annexation.and Economic Development Committee for further review
and consideration.
