plat must be recorded before the construction plans will be approved. ThO plat has been

8. A Testing and Inspection Agreement wUl be required between Hamilton County and the
Developer. The Agreement must be executed befor!!! any construction can begin. A pre-

LETTER OF APPROVAL
The undersigned has reviewed the proposed plans for
Carmel Centre West Project
and has approved the plans subject to the following:
1. Are any of the proposed buildings to be sprinklered buildings? If so a meeting is requested to
discuss the location of the fire department connection(s).
2. If buildings are to be sprinklered, we are requesting an exterior entrance for the fire riser
equipment room is provided.
3. We are requesting that a meeting be scheduled to discuss the location a fire hydrant for fire
suppression efforts.
4. Please note on plans if the buildings are multi-story and if the buildings have basements.
5. We are requesting Knox boxes be provided for all commercial buildings for emergency access.
Please respond to the above noted condition(s) in writing and submit to our office prior to the
scheduled Technical Advisory Meeting for this project.

plans for the above-mentioned project. After reviewing thlilo plans the Highway Department has the
follow!ng comments (I have malntalned the numbering from the December 11, 2002 letter):
1. OK.
2. OK, the maxrmum slope In 1he right of way is 4:1.
3. OK.
4. A Dedicatiojl of the necessary right of way for the street eonstructlon must be completed. The
plat must be recorded before the construc.tion plans will be llpproved,
5. A complete set of constructIon plans. including all necessary details, stonn sewer plans and
profiles, sanitary sewer pier and profiles and water main construction plus any other pertinent
information must be submitted for flnaf approval.
6. Whet accommodations Will be made to address the storm water run~off from the street
beyond stetion 15+507 The water will not be permitted to run onto the adjacent property.
7. A note is needed statln!;l that the ex~stiT1g pavement and curb must be saw cut.
8. A Testing and Inspection Agreement will be required between Aamllton County and the

To address the issues raised at the February 18, 2003 Plan Commission public hearing, 1
have enclosed a revised landscape plan, a drawing of the trash enclosure, and a site plan showing
the light pole locations and the conceptual location of the second building. The landscape plan
has been revised to replace the yew shrubs located around the building with other acceptable
species of shrubs. The site plan is the same site plan that we previously filed as sheet C, 1.3. I will
have copies of these drawings available at the March 4, 2003 SpeCial Study Com m ittee meeting
for the Committee's review.

qualified individual..vith structural practices designed by a qualffied engineer. The plan has not been reviewed/or local, state,
orfederal penn its that may be required to proceed with this project. Additional information. including design calculations may

The erosion and sediment control plan bas been reviewed and it bas been determined that the plan:

THE DEVELOPMENT AND USE OF REAL ESTATE

In accordance with Indiana Code Section 36-7-4-613, the undersigned makes the
following l\MENDED and REST A TED Commitments concerning the use and development of
certain real estate located in Hamilton County, Indiana (hereafter "Modified Commitments") to
the Carmel/Clay Plan Commission (hereafter "Commission"):
RECIT ALS
A, On January 16, 1990, Shady Brook Development Co., executed celiain written
commitments cOllceming the use and development of approximately 90 acres of
real estate, which included the 2.564 acre parcd owned by the undersigned
(hereafter "Real Estate") in connection with the development and construction of
a new retail, commercial and office development located at the southeast corner
of 106LI1 Street and U.S. Highway 421 in Clay Township, Hamilton County,
Indiana. These commitments were approved by the Cam1el/Clay Plan
Commission under Docket No. 75-89 Z (hereafter "Original Commitments").
B. These Original Commitments provided, among other things, that the development
of the Real Estate shall be subject to the Cannel/Clay Plan Commission's revie\v
and approval of the site development plan, architectural design, landscaping,
lighting and signage as provided in the U.S. Highway 421-Michigall Road
Overlay Zone (hereafter "Overlay Zone") of the Carmel Clay Zoning Ordinance
(hereafter "Ordinance") as to aU palis of the Real Estate whether located wholly
within or outside of such Overlay Zone.
C. The Original Commitments have been interpreted and implemented by the City of
Cannel Dep31iment of Community Services to not only include the review and
approval of the Plan Commission, but also the adherence to the development
standards of the Overlay Zone.
D. The undersigned, the owner of the Real Estate which is more particularly
described in Exhibit "A", desires to establish and develop a lot via secondary plat
that is less than the three-acre minimum required by the Overlay Zone.

E. The undersigned received the approval of the COlllilllssion at a meeting on
, 2003, which approval is reflected in a Letter of Grant attached as
Exhibit "B".
F. ]n accordance with the Letter of Grant, the undersigned wishes to amend and
restate the Original Commitments to reflect the Commission's approval of the
establishment of a lot that is less than three (3) acres.
G. The undersigned also wishes to record these Modified Commitments because to
the knowledge of the undersigned and its representatives, the Original
Commitments have not been recorded in the Office of the Recorder of Ham ilton
County.
RESTATED AND AlVIENDED COMMITMENTS
The Original Commitments are hereby amended and restated with respect to the Real
Estate as follows:
1. Description of Real Estate: See Exhibit "A" (Real Estate).
2. Docket Nos.: 75-89-Z and 03-03 CA
3. Statement of Conunitmellts:
a. Development of the Real Estate shall be subject to Cannel/Clay Plan C0I11111ission
review and approval of the site development plan, architectural design, landscaping, lighting and
signage as provided in the Cannel Clay Zoning Ordinance ("Ordinance") governing the U.S.
Highway 421-Michigan Road Corridor Overlay Zone ("Overlay Zone") as to all parts of such
Real Estate whether located wholly \vithin or outside of such Zone, but subj eet to the provisions
of subparagraph f below.
b. The Real Estate shall be developed and used solely for the following uses: general
office, office building and professional office, as such temlS are defined in the Ordinance of the
City ofCamlel, Indiana as of the date hereof
c. The undersigned ("Owner") commits that the buildings to be constructed all the
Real Estate described on Exhibit "A" hereto shall not exceed the lesser of one (1) story in height
or thirty-five (35) feet in height.
d. Owner commits that any building constructed on the Real Estate shall be set hack
not less than sixty (60) feet from the westemmost property line of the adjoining real estate
described on Exhibit "c" hereto.

e. The Owner conllnits that the following uses shall be prohibited on the Unique
Real Estate:
Di sposal of radi oacti ve materials;
Refining ormanufacturing of petroleum products;
Bulk storage of petroleum products not used for on-site manufacturing, excluding
service stations;
Refining or manufacturing of wood preservatives, cement, lime and gypsum;
Fertilizer manufacturing, stock yards, slaughtering, leather curing, and tmming;
Reclaiming processes involving materials and/or chemicals that are considered
dangerous to the health, safety, and welfare of the general public as determined by
the State oflndiana, Board of Health or City of Carmel;
Single family residences;
Roadside sales stands;
Garbage disposal plants/sanitary landfills;
J LInk and salvage yards;
Mobile home court;
Carnivals, circuses and fairs;
Outdoor theatre; and
Penal/coLTectional institution.
f The application of the Ordinance with respect to the Real Estate will allow the
estabIisl1l11ent of a lot on the Real Estate that is less than the three (3) acres in size as is othervvise
required under the Orclimmce.
4. Binding on Successors & Assigns: These Commitments are binding upon the
Owner of the Real Estate, and its successors and assigns, each subsequent owner of the Real.
Estate and each other person acquiring an interest in the Real Estate, unless modified or
tenninated by the Commission. These Commitments may be modified or tenninated only by a
decision of the Commission made at a public hearing after notice as provided by the rules of the
Commission.
5. Efrective Date: The commitments contained herein shall be effective upon the
approval by the Carmel/Clay Plan Commission or a Change of Commitment application, filed
under Docket No 03-03 CA.
6. Recording: The undersigned hereby authorizes the Director of Community
Services or the Secretary of the Cannel/Clay Plan Commission to record these commitments in
the Office of the Recorder of Hamilton County, Indiana, upon the granting of the approval
referred to in paragraph 5 above.

7. Enforcement: These commitments shall, run with the land and may be enforced
by the Carmel/Clay Plan Commission or the City of Cannel, lndiana.

Hello everyone:
Following are CTRWD comments on the agenda items effecting our sanitary sewers or service
area for the January 15, 2003 TAC meeting. Please feel free to copy and distribute this
email or attach it to your meeting minutes. We have also created a new page on our
website linked to the "Construction" page where we have posted all CTRWD TAC comments from
2001 and 2002 meetings held to date. We will continue to add to this page every month so
please let everyone know they can view our comments online now too.
West Carmel Center, Block B - The Goddard School (Development Plan)
The District has not received any plans for this proposal. Building permits should NOT be
issued unless the District has issued connection permits.
West Carmel Center, Block B - Unique - The Specialty Group (Development plan)
The plans received by the District need to be revised to show labeled sewer profiles and
manhole, lateral and bedding details which are in accordance with District specifications.
Revised plans need to be submitted. A preconstruction meeting will need to be held before
the construction of the proposed sanitary sewers. Building permits should NOT be issued
unless the District has issued connection permits.
Village of West Clay, Section 10D04-A
The District's most recent version of sanitary sewer specifications needs to be included
on the plans. Revised plans need to be submitted. A precortstruction meeting will need to
be held before the construction of the Building permits should NOT be issued unless the
District has issued connection permits.

1. Are either of the buildings proposed be protected by a fire suppression system. If so a meeting
will need to be arranged to discuss the fire department connection location.

enunciator panel be located at the main entrance of the building.

Thfs letter serves to acknowledge receipt of a transmittal received 12104102 conta1ning the plans
for the Bl>ove-mentloned proJeet. After reviewing the plans tM Highway Doparlment has the
following eomments:
1. The locations for any of the proposed et'\trMces on Commerce Drive may need to have tllm
1::lIles installed. Please include the locations on the plans.
2. The right of way along the ll:lke must be above the 1 DO-year flood elevation of the lake.
Please Include the elevation as well as 'VerifyIng that the right of way Is not below the 100-
year elevation.
3. The left turn lane on CDmmerce Drive at Retail Parkway must be a minimum of 200' In length.
4. A DedicatIon of the necessary right of way for the street construction must be complet.ed.
6. Further comments will be necessary when the entire set of construction plans Is submitted for
review.
