Approved Building Rendering D ~ ~ ~ D ~ o ~ ~ o ~ o ~ o ~ ~ ~ ~ ~ Thomas English Retail Real Estate Request for Zoning W ai ver Docket No. 08060002 ZW West Carmel Drive Retail Center Waiver Request Summary On December 18,2007, Thomas English Retail Real Estate, LLC received Development Plan and ADLS approval from the Carmel Plan Commission for development of a 10,600 square foot retai I center at the Northeast Comer of Carmel Drive and Pennsylvania Street (Meijer Parking Lot). Thomas English Retail Real Estate, LLC has been working on the approved design of the building for the past 4 months. Unfortunately, the approved design of the building has created a constructability problem and functional use issue for retail tenants. We were originally anticipating that the building would have two or three interior vertical columns (excluding columns around the perimeter of the building). Upon final design it was determined that 10 interior vertical columns were needed in order to support the weight of the cantilever roof. As a result, Thomas English Retail Real Estate, LLC requested an amendment to its original architectural design. In working with the Special Studies Committee or the Plan Commission on the revised design, the committee wanted to see some vertical relief in the design. Because of the minimum height restriction of 25 feet by the ordinance and the maximum height restriction of 26 feet by Meijer (pursuant to the purchase agreement with Meijer), there is no room for vertical relief. As a result, we are now applying to the Plan Commission for: (1) a waiver of the 25 foot minimum height requirement of the zoning ordinance to allow ror a design of the building with vertical relief; and (2) to authorize the committee to approve the waiver at the same time that it approves the revised building design (ADLS Amend petition).
