ORDINANCE NO. Z-405-03
AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA
REZONING DISTRICT CLASSIFICATION
Rezoning two parcels adjacent to the Danbury Subdivision from the R-1/Residence District
Classifications to the P-i/Parks & Recreation District Classification
WHEREAS, the Carmel/Clay Plan Commission has favorably recommended the rezoning
of the real property, the legal description of which is attached hereto as Exhibit A.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel,
Indiana, as follows:
Section h
That the Official Zoning Map accompanying and made part of the Zoning Ordinance is hereby
changed to designate the real property t~om the R-l/Residence District Classifications to the P-
1/Parks & Recreation District Classification.
Section II: All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance
are hereby repealed.
Section III: This Ordinance shall be in full force and effect from and after its passage and signing
by the Mayor.

Legal Description
The following described Real Estate in Hamilton County, State of Indiana, to wit:
Part of the North Half of the Northwest Quarter of Section 19, Township 18 North, Range 4 East
of the Second Principal Meridian in Clay Township, Hamilton County, Indiana, more particularly
described as follows:
Commencing at the Northeast comer of the Northwest Quarter of Section 19, Township 18
North, Range 4 East; thence on the line common to the East line of said Northwest Quarter and
the West line of Foster Estates-Section 1, the plat of which is recorded in Plat Book 16, pages 35
and 36 in the Office of the Recorder of Hamilton County, Indiana, South 00 degrees 28 minutes
56 seconds East (assumed beating) 795.50 feet to the beginning Point of the real estate herein
described on the approximate centerline of Cool Creek as located on the easterly line of Block
"A" common area in Danbury Estates-Section 1, the plat of which is recorded as Instrument
#9429324 in Plat Cabinet 1, slide No. 435, in the Office of the Hamilton County Recorder
aforesaid; continuing thence of the East line of sa/d Northwest Quarter Section, South 00 degrees
28 minutes 56 seconds East 532.81 feet to the southeast comer of the North Half of said
Northwest Quarter; thence on the South line thereof South 89 degrees 03 minutes 16 seconds
West 554.06 feet to the easterly line of said Block "A" on the approximate centerline of Cool
Creek; thence (the following eight courses are on said easterly line) North 36 degrees 23 minutes
23 seconds East 160.19 feet; thence North 52 degrees 45 minutes 12 seconds East 83.77 feet;

PLAN COMMISSION'S RECOMMENDATION
ON THE PETITION OF THE CITY OF CARMEL
DEPARTMENT OF COMMUNITY SERVICES
TO REZONE PROPERTY
PURSUANT TO INDIANA CODE 36-7-4-605
ORDINANCE No. Z-405-03

Dear Members:
The Carmel/Clay Advisory Plan Commission offers you the following report on the application
of the Department of Community Services (Docket No. 11-03b Z) to rezone two parcels adjacent
to the Danbury Subdivision fi.om the R-l/Residence District Classifications to the P-l/Parks &
Recreation District Classification.
The Cannel/Clay Plan Commission's recommendation on the petition of the Department of
Community Services is FAVORABLE.
At its regular meeting of July 15, 2003, the Carmel/Clay Plan Commission voted ten (10) in
Favor, zero (0) Opposed, zero (0) Abstaining, to forward to the Common Council the proposed
Ordinance No. Z-405-03 with a Favorable Recommendation.
Please be advised that by virtue of the Plan Commission's Favorable Recommendation, pursuant
to IC 36-7-4-608(f)(4), the Council has ninety (90) days to act on this petition before it becomes
effective as Certified by the Commission. Ninety days from the date of this Certification is

TO AMEND THE CARMEL/CLAY
ZONING ORDINANCE
Z-405-03
Notice is hereby given to the taxpayers of the City of Carmel and Clay Township,
Hamilton County, Indiana, that the proper legal officers of the City of Carmel will meet at their
regular meeting place, Council Chambers, Carmel City Hall, One Civic Square, Carmel, IN
46032, at 7:00 p.m. on Monday, the 4th day of August, 2003, to consider the following:
Petition of the City of Carmel Department of Community Services to rezone land from R-
1/Residence to P-l/Parks and Recreation District (Carmel/Clay Plan Commission Docket No.
11-03b Z). The property is bounded generally by 146t~ Street to the north, Common Area within
the Danbury Subdivision to the west, and lots within the Foster Estates Subdivision to the east
within Clay Township, Hamilton County, Indiana.
Taxpayers appearing at the meeting shall have the right to be heard.
