Z-414-03: PC Docket No. 11-03a Z; Danbury Common Area (P-l Rezone)
Petitioner seeks a favorable recommendation of a rezone from R-lIResidential to p-
l/Parks and Recreation on 7.8:1: acres. The site is located generally south of 146th
Street between Dublin Drive and Jason Street. The site is zoned R-1/Residence.
Filed by the Department of Community Services.
The City is requesting to rezone 7.8 acres generally south of 146lh Street between Dublin
Drive and Jason Street from R-1/Residential to P-1/Parks and Recreation.

The Department of Community Services, as petitioner, requests that the City Council adopt a
request to rezone the above identified property (see attached Ordinance).
The Carmel/Clay Plan Commission forwards this ordinance to the Common Council with a
(8-3) Favorable Recommendation (see attached certification).
The Department recommends that this item be forwarded to the Annexation and Land
Use Committee for further discussion.

AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA
REZONING DISTRICT CLASSIFICATION
Rezoning a Common area within the Danbury Subdivision from the R-IIResidence District
Classification to the P-IIParks & Recreation District Classification
\VHEREAS, the Cannel/Clay Plan Commission has favorably recommended the rezoning of
the real property, the legal description of which is attached hereto as Exhibit A.
NOW, THEREFORE, BE IT ORD.AINED by the Common Council of the City of Carmel,
Indiana, as follows:
Section I:
That the Official Zoning Map accompanying and made part of the Zoning Ordinance is hereby
changed to designate the real property from the R-l/Residence District Classifications to the p-
ItParks & Recreation District Classification.
Section II: All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance
are hereby repealed.
Section III: This Ordinance shall be in full force and effect from and after its passage and signing by
the Mayor.

ON THE PETITION OF THE CITY OF CARMEL
DEPARTMENT OF COMMUNITY SERVICES
TO REZONE PROPERTY
PURSUANT TO INDIANA CODE 36-7-4-605

Dear Members:
The Carmel/Clay Advisory Plan Commission offers you the following report on the application
of the Department of Community Services (Docket No. 11-03a Z) to rezone a Common Area of
the Danbury Subdivision from the R-l/Residence District Classifications to the P-IlParks &
Recreation District Classification.
The Carmel/Clay Plan Commission's recommendation on the petition of the Department of
Community Services is FAVORABLE.
At its regular meeting of August 19, 2003, the CarmellClay Plan Commission voted eight (8) in
Favor, three (3) Opposed, zero (0) Abstaining, to forward to the Common Council the proposed
Ordinance No. Z-414-03 with a Favorable Recommendation.
Please be advised that by virtue of the Plan C~mm.ission's Favorable Recommendation, pursuant
to Ie 36-7-4-608(f)(4), the Council has ninety (90) days to act on this petition before it becomes
effective as Certified by the Commission. Ninety days from the date of this Certification is
