TO REZONE PROPERTY
PURSUANT TO INDIANA CODE 36-7-4-605

Dear Members:
The Carmel/Clay Advisory Plan Commission offers you the following report on the application
of the Department of CommlU1ity Services (Docket No. 11-03b Z) to rezone two parcels adjacent
to the Danbury Subdivision from the R-l/Residence District Classifications to the P-l/Parks &
Recreation District Classification.
The Carmel/Clay Plan Commission's recommendation on the petition of the Department of
Community Services is FAVORABLE.
At its regular meeting of July 15,2003, the Cannel/Clay Plan Conunission voted ten (10) in
Favor, zero (0) Opposed, zero (0) Abstaining, to forward to the Common Council the proposed
Ordinance No. Z-405-03 with a Favorable Recommendation.
Please be advised that by virtue of the Plan Commission's Favorable Recommendation, pursuant
to IC 36-7-4-608(f)(4), the Council has ninety (90) days to act on this petition before it becomes
effective as Certified by the Commission. Ninety days from the date of this Certification is

AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA
REZONING DISTRICT CLASSIFICATION
Rezoning two parcels adjacent to the Danbury Subdivisioltjrom the R-l/Residence District
Classifications to the P-lIParks & Recreation District Classification
VVHEREAS, the Carmel'Clay Plan Commission has favorably recommended the rezolling of
the real property, the legal description of which is attached hereto as Exhibit A.
NOW, THEREFORE, BE IT ORDAIl\TED by the Conunon Council of the City of Carmel,
Indiana, as follows:
Section I:
That the Official Zoning Map accompanying and made part of the Zoning Ordinance is hereby
changed to designate the real property from the R-IlResidence District Classifications to the p-
l/Parks & Recreation District Classification.
Section II: All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance
are hereby repealed.
Section III: This Ordinance shall be in full force and effect from and after its passage and signing by
the Mayor.

Legal Description
The following described Real Estate in Hamilton County, State of Indiana, to wit:
Part of the North Half ofthe Northwest Quarter of Section 19, Township 18 North, Range 4 East
of the Second Principal Meridian in Clay Township, Hamilton County, Indiana, more particularly
described as follows:
Commencing at the Northeast corner ofthe Northwest Quarter of Section 19, Township 18
North, Range 4 East; thence on the line common to the East line of said Northwest Quarter and
the West line of Foster Estates-Section 1, the plat of which is recorded in Plat Book 16, pages 35
and 36 in the Office of the Recorder of Hamilton County, Indiana, South 00 degrees 28 minutes
56 seconds East (assumed bearing) 795.50 feet to the beginning Point of the real estate herein
described on the approximate centerline of Cool Creek as located on the easterly line of Block
"A" common area in Danbury Estates-Section 1, the plat ofwhicb is recorded as Instrument

NOTICE OF ADOPTION OF
AN AMENDMENT TO THE CARMEL/CLAY
ZONING MAP
Notice is hereby given to the taxpayers of the City of Carmel and Clay Township, Hamilton County,
Indiana, that the proper legal officers of the City of Carmel met at their regular meeting place, Cowlcil Chambers,
Carmel City Hall, One Civic Square, Carmel, TN 46032, at 7:00 p.m. on Monday, the 15th day of September, 2003,
and adopted the following:
Ordinance No. Z-405-03, rezoning Tax Parcel J.D. Nos.16-10-19-02-cP-OOl.OOO and 16-10-19-00-00-
001.000 (commonly known as parcels next to Danbury Common Area) generally located southeast of the
intersection of 146th Street and Dublin Drive from the R-lIResidence District Classification to the P-
IlParks & Recreation District Classification.
Ordinance No. Z-405-03 affects only the aforementioned Tax Parcels.
Ordinance No. Z-405-03 does not am~nd any provision of the CarmelfClay Zoning Ordinance regarding
penalties or forfeiture prescribed for a violation ofthe ordinance.

NOTICE OF PUBLIC HEARING
TO AMEND THE CARMEL/CLAY
ZONING ORDINANCE
Z-405-03
Notice is hereby given to the taxpayers of the City of Carmel and Clay Township,
Hamilton County, Indiana, that the proper legal officers of the City of Carmel will meet at their
regular meeting place, Council Chambers, Cannel City Hall, One Civic Square, Carmel, IN
46032, at 7:00 p.m. on Monday, the 4th day of August, 2003, to consider the following:
Petition of the City of Carmel Department of Community Services to rezone land from R-
l/Residence to P-IJParks and Recreation District (Carmel/Clay Plan Commission Docket No.
11-03b Z). The property is bounded generally by 146th Street to the north, Common Area within
the Danbury Subdivision to the west, and lots within the Foster Estates Subdivision to the east
within Clay Township, Hamilton County, Indiana.
Taxpayers appearing at the meeting shall have the right to be heard.
