ORDINANCE NO. Z-406-03
AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA
REZONING DISTRICT CLASSIFICATION
Rezoning a property located along the south side of 146th Street, 1/16 mile east of Dublin Drive
from the B-5/Business District Classification to the R-4/Residence District Classification
WHEREAS, the Carmel/Clay Plan Commission has favorably recommended the rezoning
of the real property, the legal description of which is attached hereto as Exhibit A.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel,
Indiana, as follows:
Section I: That the Official Zoning Map accompanying and made part of the Zoning
Ordinance is hereby changed to designate the real property fi.om the B-5/Business District
Classifications to the R-4/Residence District Classification.
Section II: All prior Ordinances or parts thereof inconsistent with any provision of this
Ordinance are hereby repealed.
Section III: This Ordinance shall be in full force and effect from and after its passage and signing
by the Mayor.

Legal Description
The following described Real Estate in Hamilton County, State of Indiana, to wit:
Commencing at the Northeast comer of the North Half of the Northwest Quarter of Section 19,
Township 18 North, Range 4 East, in Hamilton County, Indiana; thence South 00 degrees 28
minutes 56 seconds East on the East line of said North Half 466.69 feet; thence South 88 degrees
54 minutes 26 seconds West parallel with the North line of said North Half 466.69 feet; thence
North 00 degrees 28 minutes 56 seconds West parallel with the East line of said North Half
466.69 feet to a point on the North line of said North Half located 466.69 feet westerly of the
Northeast comer of said North Half; thence North 88 degrees 54 minutes 26 seconds East on the

Dear Members:
The Carmel/Clay Advisory Plan Commission offers you the following report on the application
of the Department of Community Services (Docket No. 12-03 Z) to rezone a property located
along the south side of 146th Street, 1/16 mile east &Dublin Drive from the B-5/Business
District Classification to the R-4/Residence District Classification.
The Carmel/Clay Plan Commission's recommendation on the petition of the Department of
Community Services is FAVORABLE.
At its regular meeting of July 15, 2003, the Carmel/Clay Plan Commission voted nine (9) in
Favor, one (1) Opposed, zero (0) Abstaining, to forward to the Common Council the proposed
Ordinance No. Z-406-03 with a Favorable Recommendation.
Please be advised that by virtue of the Plan Commission's Favorable Recommendation, pursuant
to IC 36-7-4-608(f)(4), the Council has ninety (90) days to act on this petition before it becomes
effective as Certified by the Commission. Ninety days from the date of this Certification is

NOTICE OF PUBLIC HEARING
TO AMEND THE CARMEL/CLAY
ZONING ORDINANCE
Z-406-03
Notice is hereby given to the taxpayers of the City of Cannel and Clay Township,
Hamilton County, Indiana, that the proper legal officers of the City of Carmel will meet at their
regular meeting place, Council Chambers, Carmel City Hall, One Civic Square, Cannel, IN
46032, at 7:00 p.m. on Monday, the 4th day of August, 2003, to consider the following:
Petition of the City of Carmel Department of Community Services to rezone land from B-
5/Business to R-4/Residential (Carmel/Clay Plan Commission Docket No. 12-03 Z). The
property is bounded generally by Carmel water tower site to the east, 146th Street to the north,
Common Area within the Danbury Subdivision to the south, and lots within the Danbury
Subdivision to the west within Clay Township, Hamilton County, Indiana.
Taxpayers appearing at the meeting shall have the right to be heard.
