This letter is written to inform you of a detenninatloll made by the Director of (~ommunity Services,
pertaining to the above referenced.matter. Pursuant to the authority gTanted in Section 29.04 of the
Carmel Zoning Ordinance, 1 have reviewed the issues and details involved in your Landscape Buffer
Agreement (the Agreemcnt), and find the following:
1. The Landscape Buffer agreed to by the parties in the Agreement (the "Landscape Buffer") shall be
approximatelysi:x hundred seventy (670) linear feet-in length, and Consist of a tcn foot wide
planting strip of twelve (12) foot tal1evergreen trees, of not less than four (4) varying species
plamed upon a two (2) foot high earth bGrm.
2. The Landscapc<Buffer is hereby oetermined. to be incompliance with the Perimeter Buffering
Requirements found in chapter 26.0 of the Carmel. Zoning Ordinal1ce, per the foIlo wing findings:
a. T!1.e Buffer is. ten (lO)feet in width, consistent with the bufferyard "A" requirement for
single-family residential subdivisions.
b. The Buffer is located.adjacent to a Legal Drain Easement, thirty (30) feet in width, which
is part of the Hamiltori COlmty Surveyor's office Legal Drain system.
c. The combined Buffer/lega:1 drain is forty (40) feet in width \vhich far exceeds the
minimum bufferyard standards per chapter 26.0 of the Carmel ZOQ;ng Ordinance for
abutting single family residential subdivisions.
d. The plantings cdntaincd in the buffer are twelve (12) footlall e\iergreen trees, which far
exceed the normal minimum planting height of residential bufferyards.
J. The Hamilton County Surveyor's office does not allow the planting of trees and shrubs within a
legal drain easement, thils negatingimp1ementation of the original landscape buffer condition as
required by the Carmel P1arlCornmission in connection with the approval of the primary plat of
subdivision of Westwood Estates (docket no. 151-02 PP),
In consideration of the details above, iUs hereby determined that the Lalidscape Buffer, while located
fully upon the Crook propertypcr the Agreement, is designed to substantially Comply with the original
landscape buffer required to beinstalied lJy Justus Home Builders, Inc. as a condition to the approval

of the primary plat of subdivision for Westwood Estates by the Carmel Plan Commission
(Commission) and is herebx approved and determined to replace, satisfy an<i fulfill that condition,
notwithstanding that the Landscape Buffer may be modified, rCfJlaced or removed by Mr. and Mrs.
Crook or any succeeding owner Clfthe Cl"ook property.
It is also detennined the Landscape Buffer shall fulfill the zoning requirement for perimeter buffering
on the Crook property, or its successors, when or if should a petition 'for an S-l Residential
subdivision be submitted for Commission approvaL
Thcse Director's deteqninations may be appealed to the, Carmel B(}::trd of Zoning AppeaJs by
you Or any other interested party pursuant to Chapter 30.0 of the Carmel Zoning Ordinance.
Such appeals must occur within thil:ty (30) (Lays of issuance of this letter, or the determinations
are final.
Further. the determinations in this letie( shall bepresl.;.'11ted to the Carmel Plan Commission's
Executive Committee on January 24, 2008, in order that they vote to affirm the detetminations, or to
appeal the determinations to the BZA.

This evaluation is intended to assess the level of compliance with 327 lAC 15-5 (Rule 5). It is also intended to identify areas
where additional mea.~ures may be required to control erosion and sedimentation. All practices recommended in this report
should be evaluated as to their feasibility by a qualified individual with structural practices designed by a qualified engineer.

Current Site Information: Mass grading continues. The lake at the front and the back of the property are completed. Work
has started on the large lake in the middle of the project. Pond banks have not been stabilized. The temporary swale
along the south property line has not been installed nor has the sediment basin as shown on the erosion control plan.
Rock dams have been installed at the east property line. The contractor has tried to contact me once on this project.

We have the following additional ~l1UJlents r~garding this project:
1. Jfthe existing tile across the off site area is to be left in place. set a breather at your
property line.
2. For the calculations, change the IMt sentence in section 3.2 to show that your site also bas
the restriction. Then in the Post Developed Drainage Ana.lysis, change the number in the
Allowable Release section.
3. For the Drainage Board approval. have everything back to me by noon On March 19th.
Then the public hearing can be set at the March 24lh meeting. Thepubtic hearing would
be on April 28th. A public hearing is required. For the Reconstruction and Relocation
petition, the owner of your sito can sign it. The owner of the off-site property does not
have to sign it.
4. For the clearing detail, clear 25' from top' of bank.
5. The clearing will need to be done to 136ih Street as you have shown on your current off
site plan. This does not require any approval from this owner.

We have reviewedthe secondary plat, construction plans and drainage report submitted to the
Hamilton County Surveyor's office on Februnry 5, 2003 and have the following CQl11ments:
1. Fi Ie the two petition~ that we~ given to YOLl at the T AC meeting.
2. File the non"enforcement permit application and $100 fee payable to the Hamilton
County Treasurer.
3. Provi.de a copy of the recorded easement for the new offsite drainage.
4. Submit a copy of the engineer's estimate (or contract) specifying the costs ofmonwnents
and markers, the costs of the proposed drain including construction, and costs of erosion
control,
5. The developer will provide to the Hamilton County Board of Commissioners a
performance bond or letter of credit payable to the Board, in an amount not less than the
abOve estimates or bid. The provided surety should individually list the separate drainage
improvement components. The bond must be conditioned on the faithful performance of
the contract and the payment of all expenses and damages incurred under the contract,
including payment of all suppliers, laborers, and subcontractors. All forms of surety
remain effective for not Jess than one year from the date of issue, liamilton County shall
release submitted sureties priof to one yeaJ:" from date of issue provided the project
satisfa.ctorily completes final inspection.

6. An onsite meeting will need to be scheduled by the developer where the developer,
contractor and the COlUlty Surveyor's office shall discuss construction oftht:; new
regulated drain and. downstream improvements.
7. Upon discussion with Kent regarding the surrey of the open channel, the survey wHl
need to be completed and shown on your construction plans prior to cur approval. It
cannot be done at a later date like we discussed.
8. Provide a note on the Existing Conditions and Demolition Plan, and Site Development
Plans stating the Thomas A. Stultz and Anson W. Almond legal drain is to be crushed
and destroyed and no work is to occur within the existing regulated drain easement until
plans are approved and the hearing is held before the Hamilton County Drainage Board.
9. Provide a note on the Existing Conditions and Demolition Plan, Site Development Plans
and Off-Site Ol"ainage Improvements Plan stating any private field tiles found are to be
outletted into an acceptable outh:t, .
10. On sheet C2.2, the IS' (14 LF) storm sewer from Detention Pond 3 needs to be extended
so that it does not enter the ditch at such a harsh angle.
11. On the Site Dl;velopment Plall. and Storm Sewer Pbm and Profiles, call out the type of
pipe.
12. The SSD in the swales needs to be 6".
13. Show SSD riser locations at boginning, connectlons and every 300'.
14. Show SSD to each lot.

TAC urban Forestry notes I will not be in TAC due to the Indiana Urban Forest Council's Winter Meeting. We are hosting
at Village of West Clay.
Westwood Estates - Plans are ok
THe Anderson Corp- I have reviewed initial landscape and open space plans with David Barnes, but do not have a copy of
those plans yet.
West Carmel Center, Block S, Lots 3&4, Block F - have only received Primary Plats, no other plans.
The Ridge at Hayden Run Sections 1 &2 - plans ok
Clay Terrace - have met with Mr. Jang, but have not received final revised landscape plans yet.
Clarian Hospital North - have reviewed plans, but review letter is not out yet.
11300 Block of North Michigan Road - Have not received any plans. This rezone should require open space plans
including woodland analysis, and at least preliminary landscape plans. There is a substantial woodland at stake.
Cherry Creek Estates - Have reviewed the plans, but comment letter is not out yet.
Hazel Dell Corner Lot 1, The Overlook - initial comment letter has been faxed.

Following are CTRWD coments on the agenda items effecting our sanitary sewers or service
area for the February 19t 2003 TAC meeting. Please feel free to copy and distribute this
email or attach it to your meeting minutes. We have also created a new page on our

2001 and 2002 meetings held to date. We will continue to add to this page every month so

- Westwood Estates (Secondary Plat and Construction Plans)
The District has received the plans fo~ this project. These plans have been reviewed and
forwarded to IDEM for permit approval.
The Anderson Corporation (Primary Plat)
The plans received by the District need to be revised to show labeled sewer profiles and
manholet lateral and bedding details which are in accordance with District specifications.
The plans also need show the most recent version of the District specifications. Revised
plans need to be submitted. An IDEM permit will be required and the submittal packet
should be sent to the District for review. The District will then submit the project to
IDEM for permit approval. A preconstruct ion meeting will need to be held before l:he
construction of the proposed sanitary sewers. Building permits should NOT be issued
unless the District has issued connection permits.

4A. I would like to see temporary seeding immediately after rough grading and before utilities are installed.
I would also recommend the common,area on the west side be seeded this spring before or during the start
of mass grading. A warm season native grass mix with wildflowers is an alternative planting.
4C. To better capture all the onsite stormwater I would suggest the following:
Eliminate basin #3 and install a diversion swale along the south property line to basin #2.
Expand basin #2 by extending the dam north to contour 904 and eliminate basin #1.
An elevation is needed for the weir on the stone horseshoe dams. Please label the horseshoe dams as
identified in the detail sheets.
4F. Structure 145 discharges into pond #1. Provide evidence that the riprap armoring will be stable. A cross
section is needed. I am concerned about the channel stability between pond #2 and #3. Provide evidence that
this channel will remain stable. Cross sections and profiles of the emergency outlets are needed. The outlet
sections need to be stable.
Note: The rock check dams in the rear swales are overkill. Polyethylene berms or bio logs are alternatives
that would be easier to remove when the check dam is no longer needed.
