On August 19, 2008, representatives of Browning Associates, LLC (" Browning"), will appear
before you to present an Application for rezoning the existing residential subdivision, North
Meridian Heights. The 21.9:t acre subdivision, consisting of 47 lots, is located on the north
side of 131st Street, between U.S. 31 and Old Meridian.

Browning currently is developing the "Meridian & Main" commercial development
immediately west of the site (at the north east corner of US 31 and 131$t Street). After the
Meridian & Main development was approved, residents of North Meridian Heights formed
a "Buyout Committee" and approached Browning about purchasing their properties for
redevelopment, too. As a result, Browning has entered into Option Agreements with a
majority of the landowners, and continues negotiations with the remaining parties. The
entire neighborhood has been included in the rezoning petition (only 50% of the owners
are needed to file the rezoning petition) so that the entire area can be planned and all
landowners can benefit from the zone change, while, at the same time, those homeowners
who do not want to sell now can continue to occupy their properties.

The properties currently are zoned S-2 Residential, and Browning is requesting
a rezoning to the B-6 Business classification to permit office and retail uses (which is
consistent with the City's Land Use map located at Tab 3). Approximately one half of the
subject property lies within the U.S. 31 Corridor Overlay District.

The site is located near the future Grande Boulevard. An interior north/south access
drive will be added imrnediately west of the site to connect the future Grande Boulevard to
Old Meridian. As a result, Browning expects Grande Boulevard to have a positive impact
on the site by providing improved access from Old Meridian. The Old Meridian area is
undergoing significant change. As demonstrated on the Old Meridian Subarea Plan (located
at Tab 4), the Meridian & Main II Development is surrounded by a significant amount of
recent and planned investments. The Meridian & Main II Development is an important
piece in the redevelopment of the Old Meridian area.

The site is located within the US 31 Corridor sub-set of the Regional Conunercial ! Employment Area
recommendation of the 1997 Cannell Clay Township Compre11ensivc Land Use Plan. The current primary or
tUlderlying <,.oning classification for the site is S-Z, which provides for single family development. However, the site
is also located in US 31 Corridor Overlay Di~trict which prohibits further residential development. Therefore, tbe
site must be rezoned 10 accommodate future development. The requested rezoning to the 8-6 classification would
allow for high intensity office, hotel or retail development consistcnt with the 1997 Cannd I Clay Townsllip
Comprehensive Land Use Plan rccommendations and the CanncVClay 2020 Vision plan reconunendations. Future
development of the site would Ix: subject to future ADLS review and approval by the Plan Commissiun at the time
of development.
