The applicant seeks approval to construct an 8,000 square foot accessory building. The
site is located at 12156 North Meridian Street. The site is zoned B-6/Business and is
within the US 31 Overlay Zone.

Dear Davis:
I have done a preliminary review of the plans submitted on February 13, 2003. My
comments are as follows:
1. These parcels fall under review within the U.S. 31 Highway Zoning Overlay.
The plans do not meet all the requirements for landscape plan submission.
Please refer to the attached copy of the ordinance, sections 23B.1 0 and 26.4.
Section 23B.10A in particular discusses tree preservation, which does not
appear on the submitted plans.
2. There was no landscape plan submitted for the additional parking planned for
the plat south of the building
Further comments will be made when the corrected plans are submitted. Please contact

A. One-half of an alley abutting the rear ora lot may be included in the rear yard but such
alley space shall not be included for loading and unloading berths.
B. Where tvienty-five percent (25%) or more of the lots of record in a block are occupied by
buildings, the average setback of such buildings shall determine the dimension of the
front yard in the block. .
C. Parking is permitted in the reqUired.frontyard in the Business and Industrial Districts.

26.3 Additional Lot Area and Width Requirements.
26.3.1 Where a lot of record has less area than herein required.in the district in which it is located, and
was of record onDecember 21, 1957, and the owner of such lQt does notovro. any other parcel or
.tract adjacent thereto, said lot may' nevertheless be used for a dwelling or for any non-dwelling use
permitted in the distrlct in which it is located.
26.3.2 In no circumstances, other than on a lot of record, shall the minimum lot width and lot size be less
than that provided by this Ordinance; however, the State Board of Health or the Hamilton County
Board of Health may prescribe ~ increase in those minimums in accordance with their
regulations.
26.3.3 Double frontage lots should not be platted except along arterial streets where lots may face on an
interior street and back up to such thoroughfares. In.that ~vent, a planting strip easement, at least
twenty (20) feet,in width, shall be provided along the back ofthe1ot. .
26.4 Perimeter Buffering Requirements.
26.4.1 YVhere required, perimeter buffering shall be located .along the side and rear lot lines of a lot/parcel
and shall extend the entire length of the side and rear lot lIDes.
26.4.2 Vlhere residential or'other buildings back onto a public thoroughfare, buffer plantings shall occur
outside of the publicright-of..:way, per the Tables below.
26.4.3 Perimeter buffering shall not be located within any portion of a dedicated public screet right-of-
way, private street right-of-way, or County regulated drain easement.
26.4.4 Existing vegetation maybe used to achieve project buffering if:
(a) the vegetation located upon the subject parcel is of a quality and state ofhea1th to achieve
buffering, and, .
(b) . the vegetation is proposed to be preserved using accepted best management practices for
tree protection during construction.
26.4.5. To determine fueapplicable bufferyard requirements:
(a) Use the Table for Bufferyard Determination to identify the land use category of the
proposed project use.

In reviewing the architectural design of building(s) proposed to be built in the U.S. Highway 31 Overlay
Zone, factors to be considered by the Cormnission shall include but not be limited to the following:
A. C":rmtp.xt: AU buildings shall be designed with respect to the general character of the U.S. 31
Corridor and, particularly, with due consideration to buildings located on lots that abut the project
site.
B. SC;'Ilf' :mn prnportioTl: All building fas:ades, including doors, windows, colunm spacing, and
signage shall be desIgned using the Golden Section, represented by the ratio 1: 1.6 or 1.6: 1.
C. A minimum oftbree materials shall be used for building exteriors, from the following list: stone,
brick, architectural pre-cast (panels or detailing), architectural metal panels, glass, ornamental
metal. Large expanses of glass are allowed, up to 70% of the fas:ade area. The building may not be
constructed entirely of a metal and glass curtain wall. Concrete block is not allowed as an exterior
finish material.
D. All buildings shall be designed with a minimum of eight external comers, in order to elinUnate box
buildings.
E. Building penthouses must be incorporated into the building fas:ade design, including exterior
materials specifications.
F. Sloped roofs shall not exceed one hundred (I 00) feet without a change in roof plane, or gable or
dormer. Sloped roofs shall be either standing seam metal or dimensional shingles.
G. F:xnihit!".. The follov;.ing architectural exhibits shall be provided to the Commission in addition to
normal submission requirement of any DP or ADLS application:
(1) A Site Plan showing the proposed building in the context of adjommg buildings,
including buildings across U.S. 31.
(2) Perspective computer-enhanced color renderings showing the proposed building, signage,
parking areas (shovvn loaded) and any displays v;.ithID the context of the actual existing
site conditions, including how it will look from any adjoining residential areas, as well
from as three locations, whose distance is no less than 300 linear feet away nor more than
1000 linear feet away (from the property line), along U.S. 31:
(a) U.S. 31 S01,lthbound lane
(b) Immediately across the highway, from approximately fITst floor level
(c) U.S. 31 Northbound lane
(3) Golden Section analysis, providing building eleyations which define how the proposed
building has been designed utilizmg the proper ratio.
H. W~iv~r~:
The applicant may request a Plan Commission Waiver to the dimensional and quantitative
standards of this Section 23B.9 by not greater than thirty-five percent (35%), consistent with

A Landscape Plan shall be submitted to the Plan Commission for its approval at the same time
other plans (i.e. architectural design, lighting, parking and signage) are submitted. This plan shall:
A. Be drawn to scale, including dimensions and distances;
B. Delineate,all existing and proposed buildings, privatI:': parking areas, walks, ramps for
handicapped, terraces, drive-ways, signs, lighting standards, steps and other similar
structures;
C. Delineate the location, size and description of all plant material and the irrigation system
for all planting areas. Landscape treatment for plazas, roads, paths, service and private
parking areas shall"be designed as an integral/coordinated part of the Landscape Plan for
the entll-e lot.

(1) The Greenbelt along U.S. Highway 31 shall be a minimum of thirty (30) feet in
width and landscaped per the requirements of Section 23B.l0.3.B.
(2) The Greenbelt shall be unoccupiei;l except for plant material, steps, walks,
terraces, bike paths, lighting standards, signs, ;md other similar structures
(excluding a private parking area). Mounding aIld other innovative treatments
are to be encouraged in this area.
(3) A base-planting unit for each one hundred (100) linear foot increment of the
Greenbelt has been designated, as follows:
(a) Five (5) shade'trees;
(b) Three (3) ornamental trees;
(6) Fifteen (15) shrubs or, tbree(3) evergreen trees;

(1) A planting strip, minimum width shall be ten (10) feet, shall be provided
adjacent to a11Y Collector or Arterial Street, or Parkway right-af-way within the
U.S. 31 Overlay Zone.

width of the front of the building plus twenty (20) feet (to extend ten (10) feet

(2) A planting area equal to an area ten (10) feet in depth by the remaining sides of
the building shall be installed on all other SIdes of the building(s).
(3) Sidewalks up to eight (8) feet in width maybe permitted in these areas, but shall

(4) If all approach driveway or sidewalk cuts into a planting area, the area displaced
by the driveway or sidewalk shall be added to the building perimeter planting.
(5) These ad.jacent planting areas need not be rectangular in shape as long as the
required amount of space is landscaped; innovative and original designs are
encouraged.

areas, replacing dead, diseased, or overgrown plantings with identical varieties or a
suitable substitute, and keeping the area free ofrefUse,ci.ebris, rank vegetation and weeds.

may later be materially altered, eliminated or sacrificed, without first obta~g further

Highway 31 Overlay Zone to inspect the landscaping and check it against the approved

Sites with existing trees or stands of trees should make reasonable efforts to protect and
incorporate them into the overall site design. The Landscape Plan must preserve not less than
seventy percent (70%) of all trees that are:

located within the Greenbelt, Planting Strips and perimeter buffering.

23B.11 ~lhlic Art.
Public art that is included as part of a Development Plan shall be displayed in a location that is visually
accessible to the public and visible from either U.S. Highway 31, Pennsylvania Street, Range Line Road, or
Illinois StreetIMeridian Comers Boulevard.
23B.12 P~rki11['; Re'1l1irf~mp,nts.
A. Except as provided in Paragraph E, there shall be no (0) parking between the U.S. 31 right-of-way
and the front build-to line of the building.
(1) The required number of parking spaces is established in Section 27.0, depending upon the
zoning and intended land use.
(2) There shall be an appropriate number of parking spaces reserved for use by handicapped
individuals, per State and Federal requirements.
(3) Direct, articulated pedestrian access shall be provided from the street to the building's
primary entrance.

- (4) A bicycle parking-areashbuld be provided for each building.
(5) Above grade, structured parking facilities shall have on aU- sides architectural features that
are compatible with the principal building(s) with which they are associated.
B. W::!lverR:
The applicant may request a PlanCoIIlIIlission Waiver-to the dimensional and quantitative
standards of this Section 23.B.12, by not greater than thirty-five percent (35%), consistent with
requirements set forth in Section23B.2.G.
23B.13 T iehtinr Reql1irementR.
A. A Site Lighting Plan shall be submitted along- With any DP or ADLSplan. The Site Lighting Plan
shall include the type, standards, layout, spread & intensity of aU site,lighting, including:
(1) parking lot and service/storagearea lighting;
(2) arcrutectural display lighting;
(3) security lighting;
(4) lighting ofpeclestrian and bicycle ways;
(5) arcrutectural and landscape lighting.
B. All site lighting shall be coordinated throughout the project and be of uniform design, color and
materials.
C. The maximum height of light standards shall not exceed the building height proposed,or-twenty-
five (25) feet, whichever is less. However, -When light standards abut or fall withihninety (90) feet
of a residential use, they shall not exceed fifteen (15) feet.
D. All exterior architectural, display, decorative and sign lighting_shall be generated from concealed,
low level light fIxtures.
E. The average ilhnnination for site lighting shall be a maximum of three (3) foot candles.
F. All site lighting shan be designed to not exceed 0.3 foot candles at the property line in business or
manufacturing districts, and 0.1 foot candles at the property lilie of adjoining residential uses.
G. Waivers:
The applicant may request a Plan Commission Waiver to the dimenSional and quantitative
standards of this Section 23.B.13, by not greater than thirty-fIve percent. (35%), consistent with
requirements set forth in Section 23B.2.G.

LETTER OF APPROVAL
The undersigned has reviewed the proposed plans for
Ritz Charles Expansion
and has approved the plans subject to the following:
1. We are requesting that a Knox Box be installed on the proposed building for fire department
emergency access. An application for this secure box can be obtained through our office.
2. Is the proposed building to be sprinklered? If so a meeting will need to be set up for the location
for the fire department connection. We also are requesting an outside entrance to the riser room
for our' access. We are also requiring Knox fire department connection caps for the fire
department connection if the building is sprinklered.
3. Our office is requesting a set of utility plans showing existing fire hydrant locations.
4. If the building is to have a fire alarm system, our office is requesting that a remote enunciator
panel be located at the main entrance of the facility.

Please respond to the above noted condition(s) in writing and submit to our office prior to the
scheduled Technical Advisory Meeting for this project.

Hello everyone:
Following are CTRWD comments on the agenda items effecting our sanitary sewers or service
area for the January 15, 2003 TAC meeting. Please feel free to copy and distribute this
email or attach it to your meeting minutes. We have also created a new page on our
website linked to the "Construction" page where we have posted all CTRWD TAC comments from
2001 and 2002 meetings held to date. We will continue to add to this page every month so
please let everyone know they can view our comments online now too.
West Carmel Center, Block B - The Goddard School (Development Plan)
The District has not received any plans for this proposa.l. Building permits should NOT be
issued unless the District has issue4 connection permits.
West Carmel Center, Block B - Unique - The Specialty Group (Development plan)
The plans received by the District need to be revised to show labeled sewer profiles and
manhole, lateral and bedding details which are in accordance with District specifications.
Revised plans need to be submitted. A preconstruction meeting will need to be held before
the construction of the proposed sanitary sewers. Building permits should NOT be issued
unless the District has issued connection permits.
Village of West Clay, Section 10004-A
The District's most recent version of sanitary sewer specifications needs to be included
on the plans. Revised pla.ns need to be submitted. A preconstruction meeting will need to
be held before the construction of the Building permits should NOT be issued unless the
District has issued connection permits.
Ritz Charles (Amended Development Plan)
The District has not received any plans for this proposal. Building permits should NOT be
issued unless the District has issued connection permits.
