your office development. The drawings submitted are dated 12/19/02 and include
the civil, structural, architectural, plumbing, mechanical and electrical engineering for
the project. The documents submitted reflect the schematic design approvals
granted by the Carmel Redevelopment Commission. This letter is to serve as your
approval for your construction documents for the project. We request that a color
palette be submitted for the exterior materials only so that we can review and

Following are the Department of Community Services comments regarding the draft project
agreements for Parcel #2. I hope these comments are helpful for you and the commission as you
final ize each of the project agreements. If you have any questions regarding the comments, do
not hesitate to contact me.
I. The Department recommends that all buildings on the north half of the north parcel front
on City Center Drive in order to maintain a continuous building fayade at the street. The
frontage place could be shifted south of the building to accomplish this objecti ve and still
allow for the same level of access to those buildings.
2. A Change Order, as defined in the project agreements, may only be executed by the CRe
or Developer. Section 12 ofthe agreement states that the only changes that can be made
to the approved plans are from Change Orders. Because changes may be requested in the
zoning approval process for technical and aesthetic reasons, the definition should be
expanded to allow for changes as required during the zoning approval process.
3. The definition Final Documents and Drawings refers to drawings finalized and approved
by the eRC but does not mention the C-l Development Plan (DP) or Architectural
Design, Landscaping, Lighting or Signage (ADLS) approval processes.
4. 111 Section 8, (h) Required Permits, it states that the Developer shall have obtaincd or bc
able to obtain all Required Permits by the Due Diligence Date. [fzoning approvals and
building permits are included in the definition of Required Permits then it is nearly
impossible to accomplish this with a Due Diligence date of September 10. These
approvals can only be granted after final construction drawings are pn:pared and
reviewed in conformance with the C-l zoning process and provisions in Section 12.
5. Section 12, Developer Construction, of the project agreements does not in any way
include the zoning approval process specified in the C-l district zoning ordinance. It

leaves out an essential part of the approval process and the ability for the DPI ADLS
process to be meaningful and effective. This process should be woven into the process
stated in Chapter 12 in order to ensure compatibility with the zoning regulations and
clearly layout the development approval process for all involved.
6. Section 12, (g) Permits, states that the Developer will obtain and pay for all Required
Permits, IS this the case? Exhibit B (CRC Scope ofImprovements) states that the CRC
will assist the developer in obtaining all permits. This should be clarified so
responsibilities of each party are clearly understood. Also ill Section 12 (g), it states that
the developer will submit all permits to the CRC for review. What is the purpose of this
review?
7. In Exhibit B (CRC Scope of Improvements), the ,section titled Description, it is stated
that Amli has first rights to excess topsoil stacked on the south edge of Parcel 2. The
PEDCOR agreement then states that they have access to left over material. The Kosene
agreement states the same thing. Who has precedence after Amli?
8. The Development Gu:idelines for the Property (Exhibit F) need to be updated.
A. The existing conditions are out of date for both agreements.
B. Section 4.B states that the developer wi]) meet a minimum of 3.5 spaces per 1000
exclusive of on-street parking. From our understanding ofthe proposals, the
ratio of 3: 1000 will be met This should be clarified.
C. Section 4.B states that the buildings should be close to the street. The site plan
for the North parcel does not COnfOffi1 to that principle.
D. In 4.D and 6.F, it.states that landscaping will be according to the regulations of
CarmeL Typically, the projects fall shortofthe bufteryard standards of the City
therefore this should be removed or refer to standards set by the eRe.
E. In 4.F, it is stated that the City will provide assistance in obtaining permits; this
conflicts with statements elsewhere in the agreement. Please see comment 7
above.
F. Tn 5.A, itstates a minimum building height of 2 stories and maximum height of 3
stories. This should state a minimum of 3 stories in order to be in conformance
with the definitions set forth in the text of the project agreement.
9. Signage, lighting and landscaping have not been specifically addressed in either the
project agreement text or exhibits. Will this be part of the project agreement?

Hello everyone:
Following are CTRWD comments on the agenda items effecting our sanitary sewers or service
area for the November 20, 2.002 TAC meeting. Please feel free to copy and distribute this
email or attach it to your meeting minutes. We have also created a new page on our
website linked to the "Construction" page where we have posted all CTRWD TAC comments from
2001 and 2002 meetings held to date. We will continue to add to this page every month so
please let everyone know they can view our comments online now too.
Proposed Wireless communication Towers-Crooked Stick Golf Course Special Exception
Application
The District has not received any plans for this proposal. Building permits should NOT be
issued unless the District has issued connection permits.
Hamilton Crossing Building #6 (Development plan)
The plans that the District received are in accordance with the District specifications.
Building permits should NOT be issued unless the District has issued connection permits.
Pennsylvania and 122nd Street-Northeast Corner (Rezone)
The District has no comments on the rezone unless it affects the sanitary sewers in this
development.
Lakeside Park, Section Two (Secondary Plat and Construction Plan~)
The plans received by the District do not contain the most recent version of the
District's Sanitary Sewer Specifications. Revised plans need to be submitted. A
preconstruction meeting will need to be held before the construction of the proposed
sanitary sewers. Building permits should NOT be issued unless the District has issued
connection permits.
.Please remind all TAC applicants to provide plans directly to the District at our main
office address in care of Andy Kern at:
