4i. Docket No. 45-03 DP/ADLS; Dixie Highway Addition, Lot 25 - Mark Swanson Building
The applicant seeks to construct a multi-tenant building. The site is located at 550 East 106111
Street. The site is zoned B-5/Business within the Home Place District Overlay Zone.
Filed by Mark A. Swanson.
The applicant is requesting approval of a Development Plan and ADLS for the construction of an
office building. The site is located on the north side of 1061h Street between Park and Ruckle
Streets. Please see the informational packet prepared by the applicant and distributed prior to the
April meeting for an overview of the site and proposed building elevations.
The Special Study Committee met on May 13 and forwarded this item to the full Plan
Commission with a recommendation to approve the DP and return the ADLS back to committee
for final action on June 3.
The Department recommends approval of the DP application subject to the following
conditions:
1. That the applicant dedicate right-of-way per the approved plan prior to the issuance of a
Building Permit.
2. That the applicant prepare and record a commitment to install a ten foot asphalt path
along the 106th Street frontage upon request by the Carmel/Clay Plan Cormnission or
Cannel Department of Community Services. That the commitment also require the
provision of a cross access easement between the two parking areas and the property to
the north at such time as that property is developed.
3. That the plans be amended to include sidewalk along both Park Avenue and Ruckle Street
extended to the north property line and providing the appropriate ramps at tbe drive
approaches.
4. That the applicant take one of the following steps to address the building encroachment
into the front yard building setback along 106th Street; move the building north removing
the encroachment, llillend the buildii1.g design eli.L'TIinating the area encroaching into the
setback, or file for a variance to allow the encroachment.
The Department recommends that the .Plan Commission forward the ADLS petition back
to the Special Study committee for final action on June 3,2003.
