Docket No. 45-03 DP/ADLS; Mark Swanson Building (ADLS ONLY) The applicant seeks to construct a multi-tenant building. The site is located at 550 East 106th Street. The site is zoned B-5/Business and is within the Home Place District Overlay Zone. Filed by Mark A. Swanson. The applicant is requesting approval of the ADLS portion of their project for the construction of an office building. The site is located on the nOlih side of 106lh Street between Park and Ruckle Streets. Please see the revised informational packet distributed with the agenda for this meeting. The Special Study Committee met on May 13 and forwarded this item to the full Plan Commission with a recommendation to approve the DP and return the ADLS back to committee for final action on June 3. The Plan commission approved the DP subject the thte following conditions: 1. That the applicant dedicate right-of-way per the approved plan prior to the issuance of a Building Pemlit. 2. That the applicant prepare and record a commitment to install a ten foot asphalt path along the 106th Street frontage upon request by the Carmel/Clay Plan Commission or Carmel Department of Community Services. That the commitment also require the provision of a cross access easement between the two parking areas and the property to the north at such time as that property is developed. 3. That the plans be amended to include sidewalk along both Park Avenue and Ruckle Street extended to the north property line and providing the appropriate ramps at the drive approaches. 4. That the applicant take one of the following steps to address the building encroachment into the front yard building setback along 106th Street; move the building north removing the encroac1Ullent, amend the bui [ding design eliminating the area encroaching into the setback, or file for a variance to allow the encroachment. All department concerns have been addressed. The Department recommends that the Special Studies Committee approve the ADLS request as amended.
