HomeMy WebLinkAboutPacket August 14, 2008 Board of Zoning Appeals Cannel, Indiana Re: Beriault, Greg and Ann: Variance Request as to Development Standards (Informational Packet) Gentlemen: A TT ACHMENTS-Attached hereto please find: Application for Variance Findings of Fact (ballot sheet) Findings of Fact (question sheet) Location Map Site Plan to be Approved ST A TEMENT OF V ARIANCE- The Petitioners desire to install an in ground pool and concrete deck located as shown on the Site Plan attached hereto ("Site Plan"). This location was determined by the Petitioners and their design professionals as being the ideal location. In order for the Petitioners to proceed with their plan, they request the following two variances of developmental standards: 1. The current rear setback is 20' and Petitioners request that they be allowed to build within 10'. (7.04.03 (D)(1)) 2. Carmel requires that structures such as a pool be setback 3' from an easement and Petitioners request that they be allowed to build to the easement line. (25.01.0 1.B.3 (b )(l)) STATEMENT OF SUPPORT-The proposed location of the pool is ideal for the best use of the Petitioner's property and it will not be detrimental to adjacent property owners. The only potentially affected neighbor is the neighbor to the west ofthe property. However, dividing the pool from this neighbor is an existing lineof25'+ pine trees which will not be affected by construction; thus, the pool will not be visible to this neighbor. The pool will also be tucked behind the house and will not be visible from the street. Petitioners will have the easement line marked by a registered surveyor prior to the commencement of construction to insure that the proposed improvements do not encroach on the 10' DUE adjacent to the proposed pool. Proper notices were mailed and published.
