~ Based upon all the evidence presented by the Petitioner and upon the Department
Report of the Department of Community Services, dated, we determine that the
Development Plan complies with the Standards setforth in the Carmel/Clay Zoning
Ordinance.

Section Waiver: Section 23.B8.7 US 31 Overlay Ordinance
Brief Description of Waiver: Minimum Building Height
In deciding whether or not the applicant has presented sufficient proofto permit the granting of a waiver,
the Plan Commission shall consider the following:
. The proposal is in harmony with the purposes and the land-use standards contained in the US 31
overlay Ordinance, Z-340.
. The proposal enhances the overall development plan, the adjoining streetscapes and
neighborhoods, and the overall US 31 Overlay Zone.
Go The proposal does not produce a site plan or streetfcirculation system that would be impractical or
detract from the appearance of the development plan or the US 31 Overlay Zone, and does not
adversely affect emergency vehicle access or deprive adjoining noncorrnnercial properties of light
and air.
