1 MEETING MINUTES
MONDAY, AUGUST 18, 2008 - 6:00 P.M.
COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE
MEMBERS PRESENT:
Mayor James Brainard, Council President Richard L. Sharp, Council Members W. Eric Seidensticker,
John V. Accetturo, Joseph C. Griffiths, Luci Snyder, Ronald E. Carter, Kevin Rider, Clerk-Treasurer
Diana L. Cordray and Deputy Clerk-Treasurer Lois Fine.
Mayor Brainard called the meeting to order at 6:01 p.m.
Senior Pastor, Joe Flatt, First Baptist Church, pronounced the Invocation. Mayor Brainard informed the
Council and citizens that the First Baptist Church was providing lunch once a week for the construction
workers on the 126th & Keystone project.
Mayor Brainard led the Pledge of Allegiance.
1 RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
There were none.
APPROVAL OF MINUTES:
Councilor Snyder made a motion to approve the Minutes from the August 4, 2008 Regular Meeting.
Councilor Griffiths seconded. There was no Council discussion. Council President Sharp called for the
question. Minutes were approved 7-0.
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE. COUNCIL:
Pastor Linda Handy, White Chapel Church, 1849 E. 110'u' Street, Carmel, IN., addressed the Council
regarding the City of Carmel parking guidelines.
Edward Purcell, 5250 E. 116 n Street, Carmel, IN., addressed the Council regarding parking at White
Chapel Church.
COUNCIL MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
Councilor Griffiths announced that the Carmel High School Student Government and sponsor Katie
Overbeck will be hosting a Tailgate for Life fundraiser on.Saturday, August 23, 2008 from 9:00 a.m.
until 11:30 a.m. prior to the high school football game.
Councilor Snyder presented the Council with a handout regarding the 2008 Activity Retention and
Expansion data provided by the Hamilton County Alliance.
Councilor Carter announced that the Firehouse cook-off would be held on Saturday, August 23, 2008 at
the Farmers Market.
Councilor Rider reminded the citizens to support the Carmel Community Players.
Councilor Sharp recognized Michael Klitzing, Assistant Director of Carmel Clay Parks & Recreation,
for his recent National Recreation and Park Association/American Park and Recreation Society 2008 New
Professional of the Year award.
ACTION ON MAYORAL VETOES:
There were none.
CLAIMS:
Councilor Griffiths made a motion to approved claims in the amount of $1,928,981.73. Councilor Rider
seconded. There was no Council discussion. Claims were approved 7-0.
COMMITTEE REPORTS:
Councilor Snyder reported that the Finance, Administration and Rules Committee had not met. The next
meeting will be held on Thursday, August 21, 2008 at 5:00 p.m.
Councilor Griffiths reported that the Land Use, Annexation and Economic Development Committee met
and discussed Ordinance Z-519-08 which was forwarded to the Council with a 3-0 favorable
recommendation.
Councilor Carter reported that the Parks, Recreation and Arts Committee had not met.
Councilor Seidensticker reported that the Utilities, Transportation and Public Safety Committee met and
discussed Ordinance D-1908-08 which was forwarded with a 3-0 favorable recommendation to the
Council with proposed amendments.
OLD BUSINESS
Council President Sharp announced the Second Reading of Ordinance D-1908-08; An Ordinance of the
Common Council of the City of Carmel, Indiana, Amending Chapter 8, Article 5, Section 8-47(a)(35) of
the Carmel City Code (No Parking Areas). Councilor Seidensticker made a motion to submit proposed
Amended 08-18-08 - VERSION A and read the proposed amendments starting on page 1, lines 25
through 30 (inclusive). Councilor Griffiths seconded. There was no Council discussion. Council
President Sharp called for the question. The motion was approved 7-0. Councilor Carter made a motion
to approve Ordinance D-1908-08 As Amended. Councilor Seidensticker seconded. There was no
Council discussion. Council President Sharp called for the question. Ordinance D-1908-08 As
Amended, 08-18-08 - VERSION A was adopted 7-0.
Council President Sharp announced the Second Readine of Ordinance Z-519-08; An Ordinance of the

Council President Sharp announced Resolution CC-08-18-08-01; A Resolution of the Common Council
of the City of Carmel, Indiana, Approving a' Ten-Year Real and Personal Property Tax Abatement for the
Capital Group Companies, Inc. Located at the Northeast Corner of Carmel Drive/1261h Street and North
Meridian Street. Councilor Griffiths made a motion to move this item into business. Councilor Snyder
seconded. Councilor Snyder presented this item to Council and referred to Larry Gigerich, Managing
Director, Ginovus, to address the Council. There was brief Council discussion. Mayor Brainard
addressed the Council. Council President Sharp opened the Public Hearing at 6:27 p.m. Seeing no one
who wished to speak, Council President Sharp closed the Public Hearing at 6.28:15 p.m. There was no
Council discussion. Councilor Snyder made a motion to approve Resolution CC-08-18-08-01. Councilor
Carter seconded. There was no Council discussion. Council President Sharp called for the question.
Resolution CC-08-18-08-01 was adopted 7-0.
Council President Sharp announced Resolution CC-08-18-08-02; A Resolution of the Common Council
of the City of Carmel, Indiana, Approving a Ten-Year Personal Property Tax Abatement for Pharmakon
Long Term Care Pharmacy, Inc. and Pharmakon Compounding Pharmacy Located at 801 Congressional
1 Blvd. Councilor Griffiths made a motion to move this item into business. Councilor Snyder seconded.
Councilor Snyder presented this item to Council. There was no Council discussion. Council President
Sharp opened the Public Hearing at 6:30 p.m. Katie Culp, Senior Vice President, Colliers Turley Martin
Tucker, representing the petitioner, addressed the Council. Seeing no one else who wished to speak,
Council President Sharp closed the Public Hearing at 6:31 p.m. There was no Council discussion.
Councilor Griffiths made a motion to approve Resolution CC-08-18-08-02. Councilor Rider seconded.
There was no Council discussion. Council President Sharp, called for the question.
Resolution CC-08-18-08-02 was adopted 7-0.
NEW BUSINESS
Council President Sharp announced the First Reading of Ordinance D-1905-08; An Ordinance of the
Common Council of the City of Carmel, Indiana, Fixing Salaries of Appointed Officers and Employees of
the City of Carmel, Indiana, for the Year 2009. Councilor Seidensticker made a motion to move this item
into business. Councilor Griffiths seconded. Council President Sharp passed the gavel to Councilor
Snyder to present this item to Council. There was brief Council discussion. Councilor Snyder referred
this item to the Finance, Administration and Rules Committee for further review and consideration.
Council President Sharp reclaimed the gavel from Councilor Snyder.
Council President Sharp announced the First Readine of Ordinance D-1906-08; An Ordinance of the
Compton Council of the City of Carmel, Indiana, Fixing Salaries of Appointed Officers and Employees of
the Carmel City Court for the Year 2009. Councilor Griffiths made a motion to move this item into

business. Councilor Seidensticker seconded. Councilor Griffiths presented this item to Council and made
1 a motion to submit proposed Amended VERSION A - 8/18/08; line 23, change $1689 to $1690; line 25,
change $1566 to $1422 and to strike line 26. There was brief Council discussion. Council President
Sharp requested that Councilor Griffiths submit VERSION B 08/18/08 with the amendments to the
Committee. Councilor Rider seconded. There was no Council discussion. Council President Sharp
called for the question. The motion was approved 6-0 (Councilor Accetturo abstained). There was no
Council discussion. Council President Sharp referred Ordinance D-1906-08 As Amended to the Finance,
Administration and Rules Committee for further review and consideration.

Common Council of the City of Carmel, Indiana, Fixing Salaries of Appointed Officers and Employees of
the Clerk-Treasurer, City of Carmel, Indiana, for the Year 2009. Councilor Griffiths made a motion to
move this item into business. Councilor Seidensticker seconded. Councilor Seidensticker presented this
item to Council. There was brief Council discussion. Mayor Brainard addressed the Council. Clerk-
Treasurer Diana L. Cordray addressed the Council. Council President Sharp referred Ordinance
D-1907-08 to the Finance, Administration and Rules Committee for further review and consideration.
Council President Sharp announced the First Reading of Ordinance D-1910-08; An Ordinance of the
Common Council of the City of Carmel, Indiana, Enacting and Adopting a Supplement to the Code of
Ordinance of the City of Carmel, Indiana (P Quarter 2008 Codification). Councilor Griffiths made a
motion to move this item into business. Councilor Seidensticker seconded. Councilor Snyder presented
this item to Council and made a motion to suspend the rules and not send this item to committee and vote
this evening. Councilor Seidensticker seconded. Council President Sharp referred to Doug Haney, City
1 Attorney, for his report. Mr. Haney did not think his department received the draft to review. Clerk-
Treasurer Diana Cordray verified that their department did receive the draft. Mr. Haney stated he would
like time to review with his staff and provide his report at the next meeting. Councilor Snyder withdrew
her motion to suspend the rules and not send this item to committee and vote this evening. Council
President Sharp informed the Council that he would not send this item to a committee and will receive a
report from the Department of Law at the next meeting:

Common Council of the City of Carmel, Indiana, Adding Chapter 2, Article 6, Section 2-187 to the
Carmel City Code (Encumbrances). Councilor. Seidensticker made a motion to move this item into
business. Councilor Snyder seconded. Councilor Seidensticker presented this item to Council and
referred to Councilor Snyder to present additional information to the Council. Councilor Griffiths
referred to Clerk-Treasurer Diana L. Cordray and City Attorney Doug Haney, for clarification. There was
brief Council discussion. Clerk-Treasurer Diana L. Cordray addressed the Council. Council President
Sharp referred Ordinance D-1911-08 to the Finance, Administration and Rules Committee for further
review and consideration.
