HomeMy WebLinkAboutD-1911-08 Encumbrance GuidelinesSPONSOR(S): Councilor(s) Sharp, Seidensticker and Snyder ORDINANCE D-19.1.1=08 AS'AMENDED AN ORDINANCE OF`THE COMMON COUNCIL OF TIME CITY OF CARMEL, INDIANA, ADDING CHAPTER 2, ARTICLE 6, SECTION 2-187 TOITHE CARMEL CITY CODE WHEREAS, the Common Council of the City'of-Carrnel,-Indiana has the authority to adopt ordinances, orders„ resolutions, and motions for tfie government of the city, the.control of the city's property and finances, and the appmpriaimn-of money (IC-36-4-6-1 8); and WHEREAS, the Corr iiomCouncil of the City of Cai-rne[ desires, to antend'Chap(er 2°1o establish additional guidelines for the, expenditure of the annual budget. NOW, THEREFORE,, BE. IT ORDAINED; by the. Common Council of the City of Carmel, Indiana, as follows: Section 1. Chapter 2„Article 6, Section.187 is hereby addedlo the Carmel City Code and shall read as follows: Sec. 2-18TEncumbrances. (1) All City departments; the office of the Mayor, Clerk-Treasurer; Common Council, and City Judge may not encumber funds into a suttsequent budget year:,from the current year appropriation except when the Encumbrance is, assigned to a contract, purchase-order or other orgeirg contractual. obligation(s) excepting on-going service agreements. (2) A,list of Encumbrances shall be provided tc.the Office of the Clerk-Treasurer before the end of each budget year at a.timerand format decided by the fi=afofflcer If 'a.llsIt is not received on a timely basis all, funds shall be returned to their original!rlg'fund. The only exception will be invoices which, remain in dispute" or "inquiry" status, or invoices received after 'the last annual council meeting. (3).All'capital fund projects (Cum Cap Development Cum'.Cap. lmprcvement, and Cum Cap Sewed) as,well as Cocal'Road and Strset.Fund, projects that have been encumbered may not be used,for any project or purpose different than that established by the original Encumbrance. If it is deemed necessary to change, the. scope of the Encumbrance; a resolution must .,be, presented to and approved by the Common Council. This Ordinance shall helve rio affect on any other portions of City Code Section 2-1187, which remain in full force and effect. Section 2. All prior ordinances or parts thereofiinconsistentwith any provision of.this Ordinance are hereby repealed. Section 3.
