And we have discussed this. But at this time, there are no woods on the property. They have been cleared and chipped. Since the existing trees have all but disappeared on the entire north side of the property, we should discuss 26.05 bufferyard requirements. The church is now surrounded by the asphalt ofa commercial shopping and office center and should be buffered from that use. We offer the following comments: GENERAL INFORMATION I. These commentsrepresent the Department of Engineering's firstreview of the phase III design development plans for this project. We reserve the right to provide additional review comments when certified construction drawings are provided for Phase III. 2. Many of these comments will also apply to Phase III construction plans when they are submitted. 3. We requestthat all responses to our future comments be provided in writing and be accompanied by drawings reflecting the requested revisions. We will share Crossroad's comments as they are received. 6. -Final drawings will not be approved for construction until: a. All Engineering Department and Utility Department and Hamilton County Surveyor issues have been resol ved. b. All bonds and performance guarantees are posted. c. All Board of Public Works and Safety approvals and any other governing agency approvals (if required) are obtained. d. All off-site easements necessary to install utilities to serve the development are secured. e. Any required fees are paid in full. f. Required digital files have been submitted. 7. The Department reserves-the right to provide additional comments based upon subsequent reviews as more detailed information is submitted. 8. An approved Storm Water Management Permit is required prior to commencing any earth disturbing activity. 9. An approved right"of-way permit is required prior to commencing any work in the public right-of-way. 10. lfit will be necessary to relocate existing utilities or other infrastructure, the costs for sllch relocations are to be borne solely by the developer. Any utility poles required to be relocated within the right-of-way shall be relocated to within one foot of the proposed right-of-way. 11. Typically, developers provide a commitment equal to the value to construct these improvements for deposit into the City's non-reverting thoroughfare fund. 12. The Department requires that the construction drawings be developed in accordance with the City of Cannel digital submission standards and that all required submittals for primary plat, secondary plat, and construction drawings be made. The digital files must be submitted to the Department of Engineering prior to the approval of the construction plans. Please contact the City GIS Department for the requirements. 13. Jurisdictions: a. The project site is located within current City of Carmel Corporate Limits. b. Streets and Right of Way - City of Carmel (131 st Street and Grand Boulevard Right of Way) c. Water - City of Carmel Utilities d. Sanitary Sewers - City of Carmel Utilities e. Storm Sewers/Drainage - City of Carmel. f. Legal Drains - Hamilton County Surveyor's Office. 14. Drawings submitted for approval: a. The design engineer must certify all drawings submitted for final approvaL b. This office will require a minimum 0[9 sets of certified construction drawings for approval after all issues have been resolved. The drawings will be stamped as approved and signed by the City Engineer and by Carmel Utilities. The Owner will receive 3.sets, 1 of which must be maintained on the construction site at all times. 15. Carmel Utilities will provide separate reViews of this project [01: water and for sanitary sewer issues. Water and Sanitary Sewer Fees BOARD OF PUBLIC WORKS AND SAFETY 18. [ am enclosing a schedule for Board of Public Works and Safety meeting dates and agenda deadlines for your use. Please use the Engineering Department deadlines for submissions to the Board. 19. Any submission to the Board requires prior approval by the Carmel Clay Plan Commission and/or the Board of lAming Appeals (if applicable) and completion of review by tbe Technical Advisory Comm ittee. All written requests to be placed on the Board's agenda must include the appropriate Docket Number and the date (or dates) of approval by the Plan Commission and/or the Board of Zoning Appeals (if applicable). 20. Sanitary Sewer Availability (EDU) approval from the Board- This will not be applicable to Phase III construction. Water A vailability approval requirements are under review by Carmel Utilities. Commercial Curb Cut Approval and/or Temporary Construction Entrance - The only BPWS curb cut approval this project has received was for a temporary construction entrance for Phase I that utilized an existing residential drive. That approval indicated that this temporary entrance would only be utilized for Phase I construction. Therefore, it would appear that if the permanent entrance/exit to this site is in the location indicated on the plans (utilizing the Grand Boulevard right of way), formal approval should be pursued through the Board of Public Works and Safety. Additionally, a Consent to Encroach Agreement may be required for the driveway r/w encroachment 22. We believe that all right of way dedications required for this project have been obtained. 23. Sanitary Sewer Availability forthe entire site was approved by the BPWS on April 21, 2004. Additional Sanitary Sewer Availability approval will not be required. Although this site is currently served by Carmel Water, at the time of the original pf(~ject approval it was served by Indianapolis Water, therefore Water Connection and Availability Fees were not assessed initially. Carmel Utilities reserves the right to review the issue regarding water fees. Please contact them directly regarding water fees. 24. The installation of any permanent, privately owned and/or maintained improvement (signs, decorative street signs, walls, streetlights, etc.) within dedicated right of way or dedicated easements requires the execution of a Consent to Encroach Agreement between the Owner and the City of Carmel. Such agreements are executed by the Board of Public Works and Safety. The City Engineer may approve irrigation system agreements. 25. Secondary Plat approval if applicable. All performance guarantees must be posted prior to submission of secondary plats for Board of Public Works and Safety approval. BONDING REQUIREMENTS 26. Upon initial review, it appears Perfomlance Guarantees shall be provided for the following: a. Right of Way Improvements including the Asphalt Path b. Erosion and Sediment Control and Stonn Water Quality. Please contact Amanda Foley, Engineering Department Stormwater Administrator, for details regarding engineer's estimates/performance guarantee requirements for these items. 27. The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for 100% of the cost of labor and materials to construct the individual improvements, to be provided by the design engineer. Please provide detailed Engineer's Estimates for each improvement including quantities, unit costs, pipe sizes and materials, etc. 28. Upon completion and release of individual Performance Guarantees, a three-year Maintenance Guarantee will be required. The Maintenance Guarantee amount is based upon 15% of the Performance amount for Streets and Curbs and 10% of the Performance amount for all other improvements. 29. Pcrfonnance Guarantees may be Performance or Subdivision Bonds or Irrevocable Letters of Credit. 30. Please reference the available enclosures for more detailed explanation of our procedures. RIGHT OF WAY PERMIT AND BONDING 31. Any work in the dedicated right of way of 131 st Street or Grand Boulevard will require an approved Right of Way Permit and a License & Permit Bond. 32. The bond amount is determined by the number of instances of work in the right of way at $2,000.00 per instance. However, ifthe work is included in the scope of work ofa required and posted Performance Guarantee, the Performance Guarantee may be used to satisfy the bond requirements ofthe Right of Way Permit. 33. Please contact our Right of Way Manager, Fred Glaser, to arrange right of way permitting and bonding. AVAILABILITY AND CONNECTION FEES .( Mr. Nicholas N. The Church received approval to pay Sanitary Sewer Availability (acreage) and Connection Fees as each phase was constructed. These fees have been paid for Phase r and Phase II. Phase III Fees are as follows and must be paid prior to fmal Phase III project approval: Sanitary Sewer Availability -$4,346.00 Sanitary Sewer Connection - $1.060,00 Total Fees $5,406.00 DESIGN DEVELOPMENT PLAN REVIEW COMMENTS 35. Stonn Water Management a. This project is subject to the City's Storm Water Manangement and Storm Water Quality Ordinances. b. Please contact Amanda Foley to review storm water quality/treatment requirements, 36. There are what appear to be numerous stray symbols on Sheet C4.0 1, Phase 3 Overall Plan. If they are stray symbols, please remove them from the plan sheet. If they are not stray symbols, please either label them or reference them with keynotes or a legend. 37. Please provide a dimension fr.om the centerline of the existing 131st Street pavement to the right"of-way line on all appropriate sneets. 38. When will certified Phase III construction plans be submitted for review?
