The applicant seeks site plan and design approval for a fast food restaurant. The site is located at
10575 N Michigan Rd. and is zoned B-3/Business within the US 421 Overlay. Filed by Charlie
Frankenberger of Nelson & Frankenberger for Yum Brands, Inc.
The applicant seeks site plan and design approval for a fast food restaurant. This is tht:- former site of
Ri tter' s Frozen Custard. The ground sign wil I be moved out of the drainage easement. The bui lding
design has been revised to comply further with the Overlay. The building appears to be 1.5 stories tall,
with the addition of dormers. Also, the building height complies with the Overlay requirements. Due to
the less than 90-1'00t building Itmgth. it does not have to have 8-ft deep far;ade projections and recessions.
The roof slope is 8: 12, which meets the Overlay n:quirements. Anything steeper may cause the dormers to
look askew. The lighting plan foot-candle levels and the parking pole light fixtures comply with the
ordinance. While trash dumpsters are required to be enclosed and screened in the Overlay, the enclosures
arc not required to have roofs. Please see the petitioner's supplemeutal informational packets for

At the June 23 Board of Zoning Appeals meeting, the following variances were approved for:
· Reduction in Parking · Additional wall signs
· Number of Drive-Through Stacking Spaces · Wall signs facing private ROW
· Foundation plantings reduction · WaIl sign size
a Bufferymd reduction · Menu board size
· Parking lot planting strip reduction · Number of menu boards
Monument sign in addition to wall signs
Outstandi ng comments/concerns from Staff:
I) Include the Findings of Fact sheet in the final informational packet.
2) Finalize replat of lot 3.
3) Forestry Dept eomments: the landscape plan has been revised, reviewed, and is acceptable.
4) COllnty Surveyor's Office ConUl1ents: the plan is acceptable.
July 15 Plan Commission meeting, comments:
1. Check Burger King's car stacking. (It has enough room to stack 10 cars in its drive thru area.)
2. Add faux windows on the north/east fa~ades, and add brick patterns for variety to the blank walls.
3. The building is boxy; add more detailing, dormers, and break up the roafline more; see Walgreen's.
4. The site has 3 'frontages' and we should be sensitive to that.
5. Put a roof on the trash dumpster or garage doors on the dumpster (public comment).
6. Make the back sides of the menu board signs brick.
7. Issue of dlive thru traffic flow: perhaps, separate the drive thru from the parking area.
8. Provide more detail on the variances granted.
At the August 5 Committee meeting:
1. Architecture and drive thru modifications were made, Also, screening of dri ve tl1m and trash
du mpster wi II be made.
2. The distance between Wendy's trash area and this drive thm lane was modified.
3. Photos of Walgreen's and Wendy's will be presented at the Augusl19 meeling.
The Departmeut of Community Services recommends the Commission votes to approve this item,
after all concerns/questions are addressed.
