Request for Administrative Variance
Dear Mr. Duncan:
Per this letter, we are requesting an administrative variance from the City of
Carmel Stormwater Technical Standards Manual. . Our request pertains to
Chapter 300.07.1 which requires that facilities with permanent pools or'
containing permanent lakes shall have a water area of at least one-half (0.5) acre
and a minimum depth of 8 feet, and Chapter 300.06.12 which requires that
detention basins shall be sized to detain the runoff from the fully developed right-
of-way per the City of Carmel 20-year Thoroughfare Plan.
We are proposing a wet pond BMP in the southeast corner of the property which
will have a normal pool surface area of approximately 6,500 square feet (0.15
acres) and a depth of at least 8 feet. The small size of the property (2.38 acres)
as well as the configuration of the lot does not allow for a larger pond to be
constructed on this site. Also by having the pond wet and adding wetland
plantings to the safety shelf the pond serves as the second BMP for the
proposed site. In addition we are also proposing that the volume of water trom
the fully developed right-at-way be detained within the two feet of freeboard in
the pond.

Thanks Gary. We should be ok for the Plan Commission meeting this evening. We've modified most of the plan
sheets and will work on the remaining items.
For the downstream analysis, does the City have any drainage reports (maps and calculations) as well as plans for
the improvements last made to Old Meridian? Those would be very helpful in extending our downstream analysis.

Detention Facility 'Issues
1. As it relates to the pond setback, if the 1 aO-year elevation or the top of bank of the proposed pond is less than
. 50-feet from the future right-af-way (based on the final alignment of the roadway) the City will require the property
owner to iristall a barrier or guardrai~jacent to the existing pon,d. This should be formalized in a commitment <
also.
Thoroughfare Plan
1. The Department has discussed with the petitioner that compliance with the Thoroughfare Plan requires ~
construCtion of half of the improvements stipulated by the Plan across each frontage. This item needs to be "
formalized in any commitment concerning the use of the Real Estate.

Angie,
The Stout's Shoes Building signage is rather interesting. On one of the color renderings, it shows a sign up on the second
floor. This sign is not shown in the proposed drawings where they state the colors and sizes, etc. I don't necessarily think
there's enough room up there for a wall sign. I would almost rather propose a projecting sign like Noodles and Co. has for
the upper story tenant.
As for the sign band area on the Stout's building (dark brick, two story bldg.), I think this is ok, but not great. For example,
they have Stout's shoes as the end tenant and put their sign in the middle of the sign band area because they took up two
tenant spaces. (And it's a short logo/name, so it doesn't take up enough room) But on the others, they show how it could
have two signs, one above each tenant space. I think where there will be two signs in one sign band area, there should be
more distinction separating the signs. Perhaps more molding or a cut out panel with decorative edges and a different
color. (Look at the rendering I printed out.) Also, the sign band areas are 96 sq. ft., 126 sq. ft. and 96 sq. ft. However, the
~tenants would be limited to 35 sq. ft. of signage if their tenant space is under 50'. If it is over, they will be allowed 60.
Thank goodness there is the 80% length limit and a 3' height limit. It's a big jump between tenant spaces.
Speaking of the 80% length limit...the sign specifications detailed on the drawings are ok - except for the color part. It
says they will respect the colors of each tenant and not limit them. It does limit the lighting style to either back lit or
gooseneck lit - which is good. But not limiting the colors might not go over so well. Perhaps we should have them pick a
palate of colors. What do you think?
I like the proposed signage for the second building (light colored brick) much better. The sign band areas are each only 48
sq. ft. and would most likely be limited to 35 sq. ft. for a single tenant sign. One issue I see is if there is a large tenant that
takes up two spaces and wants to put one big sign up on the pseudo second story where it is specified to show two
separate signs (or on the south end where the same could happen). We might want to advise them to show another
version which would allow for one sign up there.
The signs they have proposed facing north and south on the end caps - these would require variances, would they not? I
don't think these are necessary...especially if we can talk them into projecting signs for the second story.
Awning signs in the back to identify store names would be ok (but would really require a variance) - so long as it does not
exceed the total allowable square footage for the tenant space. Perhaps they could have small blade signs under the
awnings facing Old Meridian St. for pedestrian traffic. This would also be instead of signs on their awnings in the front.
Let me know if you have any other questions or what your thoughts are on all of this. I will bring the drawings in for you to
look at.

Gentlemen,
After 0 discussion with Brad Stout, we have the following to present as a solution to the driveway issues that hove
been raised. .
1. South Drive.: As sll9gested, we will move the drive north such that the north face of curb will line up with
the.south edge of the 8' walk. The parkingwill be reconfigured accordingly.
2. North Drive: Please refer to the attached" drawing provided by Angle and created by St. Vincent. It
appears that some type of bui Iding is to be constructed in the future "to the north of our property with a
drive entrance between the stout property and the St. Vincent property. We imagine this drive entrance
will be either the loop road as shown or more likely a commercial entrance of some kind. We would like to
make a commitment to work with St. Vihcent or the future property owner to connect to this drive/loop road
and close our north drive at that time, subject to the approval of St. Vincent. The timing for the
development of the property to the north is unknown, and the costs associated with this future work are
unknown as well. The benefits to this are as follows.
a. A green area for landscaping between the two properties is retained.
b. A variance from BZA to eliminate the required landscape yard aiong Stout's north property line is not
required.
c. Our progress through the approval process is not delayed.
We would like to have a r.esponse as soon as possible So that we con work out the wording of the commitment on
Monday prior to Plan Commission.

Steve,
I'm hoping you can help me with something, We have a commercial development that is proposed on Old Meridian Street
just north of Main St. The City, several years ago, developed a master plan for the old meridian district that incorporated
land use planning and architectural design and lighting concepts that were desired in the Old Meridian District. Mike
Hollibaugh, director of planning, has a conceptual sketch of the lighting that was contemplated by our architectural
consultant. We were wondering if you might be able to show us some real products that would be similar in style to those
conceptualized in order that we might provide that information to the developer to include in the site development.
Mr. Hollibaugh will send you the conceptual sketches to get you started.

I do not believe that the street lights that you have attached in your initial email to Steve are the lights that planning dept.
had envisioned for the Old Meridian District. They are more specific to old town and the Rangelirie Rd. corridor. The
attached exhibit is a concept that was deveioped by the consultants under the direction of the planning dept.. and I believe
is more representative of what is desired in the Old Meridian Corridor. I willie! Mr. Hollibaugh correct me if I am wrong.
I've asked Steve Bates to assist in providing a lighting option thafis consistent with the style depicted in the attached
sketch.

Dik: Prior to receiving your below e-mail Mike McBride and I looked over the plans and have the following
comments: We would desire to see you move the southern entrance north approximately 60' to a spot where
the drive's northern edge would match up with the proposed 8' sidewalk. Parking should be able to be
transferred to the southern side of the drive and there should be enough "flex" in the drive alignment for
provision of access to the outlot south of your tract.
The northern entrance has a couple of options which might be considered. One is to work with the owner of
the tract to your north (St. Vincent) to create a drive which would center on the property line. The second is to
construct the drive on the northern portion of your tract, commitment to a future "shared" drive agreement with
the current or future property owner to the north during future development and commit to modifying your drive
to work with the north tract when future development does occur there.
The street lighting was discussed with the Department of Community Services this morning and a street
lighting fixture for that area is being sought for preference by all parties. This fixture would be detailed for your
use upon said agreement.

I spoke with Dave Barnes of the Engineering Department late yesterday, and based on his meeting with Mike
McBride and Gary Duncan, he presented me with the Engineering Department's comments regarding the Stout
project and the issues still outstanding. The items addressed were as follows.
1. South Drive: The Engineering Department would like to have this drive moved to a point that is 200 feet
north of the round-a-bout. Dave and I looked at the plan, and we believe we can utilize the drive servicing
the parking on the south side of the south building as the entrance to the site without causing a significant
change to the site. We would need to revise the following with ramifications as noted below.
a. Maintain the 8 spaces on the north side of the drive (south end of the building).
b. Add 5 more spaces on the south side of the drive.
c. Determine how to adjust future bank drive-through in the future...this could include losing a portion of
the 5 new spaces in the future. If there isn't a drive-through in the future, this becomes moot.
d. Lose two on-street parking spaces.
e. Reconfigure the streetscape (island at midpoint and retaining wall columns) to make it more
symmetrical as it's shown today.
f. Adjust the landscaping as necessary at the new entrance area.
2. North Drive: The Engineering Department would like to move this drive to the north and center it on the
north property line. The ramifications are as follows.

a. The sidewalk area on the north end of the building would be about 24 feet wide.
i. Possible outdoor seating area.
II. Possible additional planting area between parking and building
III. Possibly increase the distance between the buildings which might necessitate another
appearance before the BZA and Special Studies Committee and change the elevations
between the buildings again.
b. Add two on-street parking spaces that were lost on the south end.
c. Parking count in this off-street parking area can remain the same.
d. Eliminate nearly all of the landscaping along the north property line.
e. PROBLEM: We will be working on the adjoining parcel and would need the owner's
cooperation/permission since we do not control that property. This will create a significant delay in
the start of construction and would delay approvals from the City.
r. RECOMMENDATION: Allow the drive to remain as currently located. This eliminates having to
obtain the cooperation/permission of the adjacent land owner, eliminates any delays in the project,
and contains everything within the limits of the property under development.
2. The Engineering Department thinks we should be the ones who determine if the outlet pipe has capacity.
They stated there are no current drainage problems/issues with this pipe. Our drainage report states that
the pipe has sufficient capacity.
J. The Engineering Department believes the lighting fixture should be specified by the Planning Department to
ensure consistency with the street lighting previously specified by the Planning Department for uSe in this
area.
4. The Engineering Department believes the conflicts with the Master Plan should be resolved by the Planning
Department.
I would like to set up a meeting between the engineering and planning departments and us to finalize what needs to
be done with this site and gather the information we need to accomplish this task. Because of the short amount of
time we have left between now and the August 19th Plan Commission meefing, I would like for this to happen no
later than Friday morning. Both Bob McGill and I will need sufficient time to make whatever changes are necessary
to present a final product to the Plan Commission.

currently hove. I will have a letter of explanation for Thursday's submittal outlining the remaining unresolved
issues. After that, we have no choice but to either be continued by the Plan Commission for a month of lost time

I'll verify with Mike Cook, but I believe that we haven't changed the buildings since the last submittal, and the only
changes are the oneS involving the site, landscaping, and lighting. As you know, Scott Brewer waS on vacation, and
we have a meeting with him on Monday. We're still waiting on additional information from the engineering
department. That information includes the lighting fixtures to use on the street which affects our lighting plan,
verification of the outlet for storm, whether or not they will allow the south drive, and the resolution of the
master plan issues they brought up which could have a significant impact upon the site.

favorable approval to appear before the August 19th Plan Commission. However, it was mandated that prior to this
appearance we must receive approval from the Engineering Department of our plans for which there are a few

In other news, the Committee asked for a lot of commitments and conditions last night... .i've deciphered my notes and
summarized them, below. (not including the sign petitions)
1. Glass Chimney - subject to landscape plan .
2. Stout's Shoes - must have final lighting plan and final drainage/pond approval from DOE at full Commission, also
final landscape approval (I suggested grass-crete or similar for the area adjacent to the parallel parking, instead of
the grass ~ concrete - grass they were proposing) and full sign package. The committee also wanted a front
elevation that clearly shows the grade change between the parking and the buildings/plaza, and for some provision
to be made for rear signage, like door signs.
3. Taco Bell/KFC - The committee wanted copies of Carol's photos of Walgreens and Wendy's at the full .
Commission, and Charlie and Scott and I are going to try to work out better screening for the drive-through area.
They're re-designing it slightly at Rick's request, to provide more landscaping on the bulb at the south end, and
more around the dumpster, to try to visually separate their Drivethrough from Wendy's. As soon as I get that
meeting set up, I'll let you know, and they're going to get revisions to you no later than Monday, Friday if they can.

As it relates to the future roadway to the northeast, we are also reviewing access from this future roadway into
the site as it relates to the planned northernmost access from Old Meridian. As we discussed, it is likely that we
would accept a commitment that the northernmost Old Meridian cut be aQandoned at such time as the access
is provided from the future roadway. As it relates to the pond setback, if the 1 DO-year elevation or the top of
bank of the proposed pond is less than 50-feet from the future right-of-way (based on the final alignment of the
roadway) the City will require the 'property owner to install a barrier or guardrail adjacent to the existing pond.
This should be formalized in a commitment also.
As we discussed, compliance with the Thoroughfare Plan requires construction of half of the improvements
stipulated by the Plan across each frontage. Considering construction of just the improvements indicated on
the Thoroughfare Plan, this equates to approximately $130/lf of frontage. This includes the construction of the
.asphalt path. Since path will be installed with this project, this would satisfy that portion of the requirement. By

Hi Dik- thanks for the productive meeting this morning.
I confirmed with Mike H. that you will not need additional ~ariances regarding the adopted
Old Meridian District master plan; the plan I submitted to you today only applies to
properties zoned mixed medical in that area. As long as the street that runs along the
north and west side of your side is constructed in the future by you or whomever, then it
is not an issue. However; you probably will have to work with the engineering dept and the
board of works on any approvals/variances required from them, for the proximity of the
retention pond to the proposed street east of your site, curb cut locations, and so on. . .
We also .discussed SOme ways to provide street trees, such as bump outs between some of the
on street parking spacing, tree-wells, etc. We would like to see your revisions on that_
The landscape plan will ultimately be reviewed/approved by Scott Brewer, and so you will
have to work with him on his comment about the conflict of planting areas and easements.
He will be out until august 4, though.
Several pending review comments from planning/zoning are below:
Comment 13- please provide an aerial photo with a site overlay.
Comment 22- on the new plans, it is still hard to see the sidewalk/path extending up to
the north property line, north of the northern driveway.
Comment 28 - a revised lighting plan was never submitted showing street lighting along old
meridian, per the adopted city style.
Comments 30 & 31 - foot-candle measurements on the lighting plap cannot exceed 0.5 at the
property lines; your lighting plan does not show foot-candle limits at the property lines.
Does this mean the foot-candle measurement is zero?
Comment 40- provide an update on the city forester's requirement of a tree inventory
and/or a tree preservation plan.

20. A drainage report will be provided once the City Engineer's Office has
completed its review and detennined the allowable release rate from the contemplated
outlet. Please see comment 44d from the comment letter provided by the City of Carmel,
Department of Engineering, attached herein.
21. The elevation plans currently depict an example of proposed tenant signage
on the building fayade. The color, design, dimensions and sign material will be finalized
and submitted for approval at a later date after the final architectural design has been
approved by the Plan Commission and in accordance with the needs of future tenants.
22. The site plan (please see attached Sheet C2.0, revised July 14,2008) now
shows the requested improvements. This plan is submitted for purposes of the informal
Plan Commission meeting, and a set of revised plans for the entire site will be submitted
once this proj ect has been to T AC on J uJy 16th.
23. A lighting plan was submitted to your office on July 2,2008. The lighting
plan included the foot-candle detail and specifications. The project will not incorporate
any sconce lighting.
24. Please refer to comments 42 a through 42g and comments 43a through 43k
of the comment letter provided by the City of Carmel Department of Engineering
contained in this submittal which indicate the Department of Engineering is going
through the process of verification and acceptance of the proposed drives.
25. It is apparent that the DOCS is requiring on-street parking for this site as a
condition of approval. The site plan (please see attached Sheet C2.0, revised July 14,
2008) now shows the requested improvements. This plan is submitted for purposes of the
infomlal Plan Commission meeting, and a set of revised plans for the entire site will be
submitted once this project has been to TAC on July 16111.
26. The site plan shows and labels the location for concrete sidewalks in front of
the building. The sidewalk is not proposed to include pavers.
27. The EIFS top was switched eliminated on the south end of building as
shc)\vn on the elevations submitted to your office on July 2,2008.
28. A revised site lighting plan showing the required lighting fixtures with the
revised plans addressing T AC comments will be provided following the T AC meeting.

non-hazardous construction debris. Petitioner will choose materials with recycled
content. Petitioner will choose materials and products that are extracted and
manufactured \vith in the region to reduce transportation costs. All buildings will be
smoke free. There will be ventilation system monitoring to help sustain occupant
comfort while maintaining efficiency. There will be a high level oflighting and HV AC
system control to help sustain occupant comfort while maintaining efficiency.
33. The parking area will consist of asphalt pavement.
34. Please see the attached revised site plan showing the locations for bicycle

35. All mechanical equipment will be located within the buildings and will not

1. 20G.05.04 F(3) states that "On-site parking lots or structured parking adjacent to a public street must be
separated from the street right-of-way with landscaped strip, no less than six (6) feet wide, containing
shade trees, and shrubs or low fence/walls up to four (4) feet high. This plan appears to lack this feature.
2. There are apparent utility conflicts in the parking lot with landscape material. All utility lines and
easements (including any drainage.easements) should appear on the landscape plan to eliminate
conflicts.
3. Structural soils have been required to fulfill proper rooting volumes for street trees in other locations
along Old Meridian Street, these should be engineered and planned for in this instance. The planting
area in the right-'of-way including soil volumes should be graphically planned in the set, since the street
trees in the ROW are required on the plan.
4. The plan shows several trees being planted below top of bank in the storm water retention area. The
County Surveyor's Office will not allow plantings below top of bank, and Carmel City Engineering also
discourages it.
5. 20G.04.06 E says that" Sites with existing trees or stands of trees shall protect and incorporate them into
the overall site design." Tree Preservation methods must be called outgraphically on the plans and
established on the site plan. Any tree preservation information such as a plan or tree inventory should be
submitted to the Environmental Planner in the Department of Community Services.

Hi Michael - as you saw by my May 23 email, the stout shoes item is on the June 3 committee agenda for feedback only.
Also, I want to clarify dates and deadlines, since your engineer told me he was working on construction plans all weekend:
When I last spoke to you on the phone and tried to explain the Plan commission approval process, I mentioned that the
last filing deadline was May 16 to get on the July 15 plan commission agenda and the June 18 T AC agenda. Since you
missed the tac filing deadline by a long shot, your item will be placed on the July 16 tac agenda. I did get your adls
application on May 23, but I did not get a development plan (DP) application. I will need that asap.
(If you were not aware, the TAC filing deadline is approximately 30 days prior to the TAC meeting date, rather than the 15
days it was last fall. Please see attached 2008 plan commission calendar for more detail).
I have come up with this timeline for y:ou that should still satisfy your urgent timetable (the tac meetinq will occur after the
first plan commission meeting. which is not typical):
July 16 -TAC meeting (June 20 is the filing deadline for this, but it looks like your engineer mailed out plans today, May

I received your preliminary comments regarding the Stout Shoes site and have some questions that perhaps you
can help me with.
One of the comments was regarding the proposed 60'-half R/W for both Main and Old Meridian. We understand
this is a requirement of the Thoroughfare Plan; however, is that amount of R/W really necessary? The Old
Meridian improvements were just made giving Old Meridian 2 lanes in both directions with a grossed median which
fits well within the existing 50'-half R/W. Does Carmel believe that additional lanes in the future will be
necessary? Old Meridian continues north for perhaps a half-mile and then connects into U.S. 31. Main Street
currently has a 40'-half R/W, and looking at the locations of existing buildings to the east, it would be difficult for
Carmel to improve that street to anything more than what Old Meridian now has. How do we go about asking for 0
reducf'ion in the Thoroughfare Plan R/W requirements? I've never done it in Carmel before, and my only
experience in that sort of thing is with Indy where you request a reduction in writing from DPW.
The humber of drives is something that we'll probably need to discuss further. We think that the site will support
3 drives,and there are currently 5.

Another c9mment you had dealt with the multi-use paths. Carmel just placed asphalt paths along Old Meridian with
the new improvements. Are you sure we need to tear out those paths and place new ones?
