With respect to the proposed detention pond (the "Pond") setback, if the 100 year elevation at the top of the bank of the Pond is less than fifty feet (50') from the right-of-way of the future loop road (based upon the final alignment of the roadway) the Owner shall install, at Owner's cost, in accordance with plans approved by Carmel, a barrier or guardrail between the right-of-way and the Pond. 4. Owner shall comply with the Carmel Thoroughfare Plan requirements respecting contribution to the cost of improvements along Old Meridian Street, which has generally been estimated at an amount equal to One Hundred and Nine and no/100 Dollars ($109.00) per lineal foot of frontage of the Real Estate along Old Meridian Street. These COMMITMENTS shall be binding 011 the Owner, subsequent owners of the Real Estate and other persons acquiring an interest therein. These COMMITMENTS may be modified or tenninated by a decision of the Cannel Plan Commission made at a public hearing after proper notice has been given.
