STATEMENT OF COMMITMENTS
COMl\UTMENTS CONCERNING THE DEVELOPMENT OF REAL EST ATE MADE
IN CONNECTION WITH PLAN APPROVAL
The owner ("Owner") of the real estate located in the City of Carmel, Hamilton County, Indiana
("Cam1c1"), which is described below, makes the following COMMITMENTS conceming the
use and development ofthe Real Estate:
Legal Description: See Exhibit "A" attached.
Statement of COMMITMENTS:
1 . Plans respecting building signage, both within the proposed sign band and
otherwise, shall be in compliance with applicable ordinance requirements (and/or variances
granted by the Board of Zoning Appeals) and othenvise subject to the approval of the Director,
Cannel Department of Community Services.
2. Upon request by applicable governmental authorities once the location of the
proposed future loop road (the "Road") as generally depicted on the Old Meridian District
Master Plan is established and constructed, the Real Estate shall be connected by driveway to the
Road, subject to access being provided by easement or other right, and the Owner shall close (or
modify if a common access is provided at the property line with adjacent property to the north)
the north drive othenvise depicted as a part of the approved development plan.
3. With respect to the proposed detention pond (the "Pond") setback, if the 100 year
elevation at the top of the bank of the Pond is less than fifty feet (50') from the right-of-way of
the future loop road (based upon the final alignment of the roadway) the Owner shall install, at
Owner's cost, in accordance with plans approved by Carmel, a barrier or guardrail between the
right-of-way and the Pond.
4. Owner shall comply with the Carmel Thoroughfare Plan requirements respecting
contribution to the cost of improvements along Old Meridian Street, which has generally been
estimated at an amount equal to One Hundred and Nine and no/100 Dollars ($109.00) per lineal
foot of frontage of the Real Estate along Old Meridian Street.
These COMMITMENTS shall be binding 011 the Owner, subsequent owners of the Real Estate
and other persons acquiring an interest therein. These COMMITMENTS may be modified or
tenninated by a decision of the Cannel Plan Commission made at a public hearing after proper
notice has been given.
COMMITMENTS contained in this instrument shall he effective upon the approval of Docket
No. 08050033 DP/ADLS Stout Shoes Building by the Carmel Plan COlllil1ission, and shall,
unless modified or changed as herein provided, continue in effect for as long as the above-
described Real Estate remains zoned Old Meridian District/Mixed Use.

These COMMITMENTS may be enforced by The CllIDel Plan Commission and Owners of all
parcels of ground adjoining the Real Estate to a deptb of two (2) o\\'nerships, but not exceeding
six-hundred-sixty (660) feet from the perimeter of the Real Estate;
The undersigned hereby authorizes the Department of Community Services to record these
Commitments in the office of the Recorder of Hamilton County, Indiana, upon final approval of
Docket No. 08050033 DP/ADLS.

The compact, aerodynamically designed
housing allows wind to flow easily around
the fixture with minimum resistance, thus
providing dramatically lower EPAs than
traditional shoebox or larger contemporary
fixtures. This allows for the use of lighter
gauge poles, thus reducing initial cost and
total cost of ownership.
. Tool-less Entry - Neatly blended into
the fixture design, the over-center latch
offers easy entry to the lamp, reflector,
and, if necessary, the ballast compartment
A specially designed door hinge bracket
allows the door to open for easy lamp
replacement without physically removing
the door.
. Premium-grade PosiSeal Lens and
Door Gasket - Only premium-grade,
one-piece extruded silicone gaskets are
used around the Patriot lens and in the
doorframe. These compression seal
gaskets create a tight, impervious barrier
to insects, moisture and debris.
. Ballast - The ballast is separated from
the lighting compartment by a specially
designed heat shield. Located in the
housing, the ballast is readily accessible.
As an option, all electrical components
can be mounted to an easily removable
power panel with primary and secondary
Quick Connect plugs.

coat finishing process. The DuraGrip
