The concern cited that a possible commercial greenhouse or plant nursery business was being operated at this property, which is zoned residentially (S-2). As per Appendix A, Schedule of Uses, of the Cannel/Clay Zoning Ordinance (see attached), a commercial greenhouse or plant nursery businesses are both considered Special Uses under the S-2 zoning classification and, thus would require approval from the Board of Zoning Appeals in order to continue to operate in this location. This department performed an initial site inspection of the subject property and documented an illegal sign that had been placed on the property to advertise this illegal commercial use of the property, as well as several structures and vehicles which could be construed as commercial in nature. To avoid further enforcement action, please file an application for a Special Use Variance no later, than May 9, 2008. Christine Barton -Holmes, a Planner in the Department of Community Services (Planning and Zoning Division), can help you with this process. She is available weekdays by telephone at (317) 571-2417. It is also requested that you remove the illegal sign immediately until you have secured the approval of the Board of the Zoning Appeals for the Use, and the subsequent sign permit required for the signage on the site. All signs located in Clay Township are required to have sign permits according to Section 25.07.07 of the Carmel/Clay Zoning Ordinance which states the following: Except as other -wise provided in this Ordinance, it shall be unlawful for any person to establish any sign within the jurisdictional area of this Ordinance, or cause the same to be done without first obtaining a sign permit for each sign from the Administrator as required by this Ordinance. Please bring this, site into full compliance with these ordinances. The failure to bring this siteinto compliance will result in further enforcement action which may include court appearances and fines.
