Ste. 260 Carmel, Indiana 46032 RE: CITY CODE VIOLATION — UNSAFE STRUCTURE Dear Sir or Madam: This letter is being provided to inform you that the Department of Building & Code Services recently performed an inspection on property listed under your ownership at 9815 Westfield Blvd., after receiving several complaints about the condition of the property. These complaints were in regards to the safety of the structure and surrounding property. The inspection revealed that there are several violations of the Carmel City Code, in particular: § 6-79(f); § 6-159(h); and, § 6-88. § 6-79 specifically states: (t) All buildings or structures so old, dilapidated or out of repair as to be dangerous, unsafe, unsanitary or otherwise unfit for human use; or shall be an invitation to children and endanger the lives of such children, or which, because of its condition has become a fire hazard. Also, § 6-159(h) includes, but is not limited to: (1) Is in an impaired structural condition that makes it unsafe to a person or property; (2) Is afire hazard, (3) Is a hazard to the public health; (4) Is a public nuisance; (5) is dangerous to a person or property because of a violation of a statute or ordinance concerning building condition or maintenance; ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571-2417 e PLE COPY (6) Is vacant and not maintained in a manner that would allow human habitation, occupancy or use under the requirements of any statute or ordinance; (15) Is or has any portion thereof that is, manifestly unsafe for the purpose for which it is being used; (18) Has been so damaged by fire, wind, earthquake or flood or has become so dilapidated or deteriorated so as to become (1) an attractive nuisance to children, or (2) freely accessible to persons for the purpose of committing unlawful acts, (19) Has been constructed, exists or is maintained in violation of any specific requirement or prohibition applicable to such building or structure provided by any law of the State of Indiana or any City ordinance or building regulation relating to the condition, location or structure of buildings; (24) Is abandoned for a period in excess of six (6) months, so as to constitute an attractive nuisance or hazard to the public. This building and any other structures on the property need to be demolished, and any pools or ponds need to be filled according to City requirements. Please begin the necessary permitting process by June 13, 2008. Also, the height of the grass/weeds on the lot is in violation of City of Carmel Code § 6-88 and Indiana Code § 36-1-3-6 (b)(1), which states: (c) Requirement to cut. All owners of real property ("property') located within the City shall cut and remove weeds and other rank vegetation growing thereon that exceeds an average height of six inches, and shall keep their property clear of debris. Please be advised, this violation needs to be corrected by June 12, 2008, or, the requirement to cut will be brought into compliance by the City of Carmel. You, as property owner(s) will be liable and billed for the cost of correcting the violation(s) and all administrative costs.
