Dear Angie:
Please allow this letterto be considered a request by 1800 106th Street Partners, LLC (the
"Petitioner") to withdraw its Petition for Primary Plat Approval, due to' outside circumstances
that were only recently disclosed to Petitioner. The withdrawal is necessary due to the fact that it
does not appear that these circumstances can be changed anytime soon. As a part of Petitioner's
request to withdraw, since the circumstances arose due to no fault of Petitioner, Petitioner would
respectfully request a refund of all filing fees that it has paid to the City of Carmel in conjunction
with the Primary Plat Approval Petition. If you would like, we would be happy to make this
request to the Plan Commission in person. Thank you for understanding Petitioner's position
and, if there is anything else you need as pan of the withdrawal request, please do not hesitate to
contact me.

Angie - J've discussed this matter at length with both Carol'Schleif and Joe Calderon. I assume that you heard from Joe
already that his clients are requesting that the proposal be tabled for now.
I don't think that the agreemerit was inteilded to apply to minor plats. However, the NOAX group (including Carol) may
take the position that the City has violated the annexation ordinance if the Plan Commission approves this minor plat.
Bottom line for the Plan Commission: The Commission would not want to take any action that might cause the City's
annexation agreement with the southwest Clay group to become unraveled. Therefore, the Commission should table this
matter indefinitely, possibly until after the 2011 municipal ejection.

restriction imposed as part of the annexation settlement agreement. Please read item i of the attached ordinance.

I left him a message that since they were basically just dividing the one lot into two, we would hold 26.01 to be sufficient in
that the existing vegetation would suffice since they didn't appear to be doing any large scale construction activity.

1. An Application for Project Review must be completed and the appropriate review fees
paid prior to any approvals from this office. The application is available on the County
Website.
2. Provide a 50' half Right-of-Way from the centerline of 1 061h Street per the Hamilton
County Thoroughfare Plan dated 4/26/07.
