The withdrawal is necessary due to the fact that it does not appear that these circumstances can be changed anytime soon. As a part of Petitioner's request to withdraw, since the circumstances arose due to no fault of Petitioner, Petitioner would respectfully request a refund of all filing fees that it has paid to the City of Carmel in conjunction with the Primary Plat Approval Petition. If you would like, we would be happy to make this request to the Plan Commission in person. I assume that you heard from Joe already that his clients are requesting that the proposal be tabled for now. I don't think that the agreemerit was inteilded to apply to minor plats. However, the NOAX group (including Carol) may take the position that the City has violated the annexation ordinance if the Plan Commission approves this minor plat. Bottom line for the Plan Commission: The Commission would not want to take any action that might cause the City's annexation agreement with the southwest Clay group to become unraveled. Therefore, the Commission should table this matter indefinitely, possibly until after the 2011 municipal ejection.
