Also, It is necessary for you to comply with the City of Carmel's Zoning Ordinance §25.01.01 (C.) Section 8, b. relating to Private Swimming Pool safety, which states: b. Safety. For purposes for safety, the following shall apply: I. Walls or Fencingi. Walls or fencing deemed to Ibe impenetrable by the enforcing authority, that its not less than five (5) feet high completely surrounding the swimming pool and the deck area with exception of self -closing and latching gates and doors, both capable of being locked; ii. Other Means. Other means not less than five (5) feet high and deemed impenetrable by the enforcing authority at the time of construction and completely surrounding the pool and deck area when the pool is not used; and iii. Combination. A combination of Subsections (i) through (fi) that completely surrounds the pool and deck with the exception of self -closing and latching gates and doors which are capable of being 'locked:; or iv. Pool Cover. A safety pool cover may be used provided that: (a) there is a continuous connection between the cover and the deck, so as to prohibit access to the pool when the cover is completely drawn over the pool; (b) it is mechanically operated by key or key and switch such that the cover cannot be drawn upon or retracted without the use of a key; (c) it is capable of supporting a four hundred (400) pound imposed load upon a completely drawn cover; (d) it is installed with a track, rollers, rails or guides; (e) it bears an identification tag indicating the name of the manufacturer, name of the installer, installation date, and applicable safety standards, if any. (f) that it is in compliance with the Indiana swimming pool code, 2d Edition, effective date September 13, 1989, as amended. At one point it was sold to a group of "interesting" dudes planning to remodel and sell it. It seems as though, that deal went south as we have not seen any beat up construction trucks there for about 6 months. Of course, the "interesting" laborers spent hours repainting, reflooring, recarpeting and even managed to replace 30 year old formica countertops with lovely granite set on top of grossly painted 30 year old cabinetry. After quite a bit of research by neighbors, it is still a mystery who owns this dump and what is going to be done with this health risk to our neighborhood full of children. The City of Carmel refuses to do anything about this dilapidated structure and Hamilton County has been no help either. In addition, this home has a back yard with a (cess) pool that is a breeding ground for mosquitos and a death trap to any curious child or wandering animal. Not only is there a pool filled with sludge and the remains of who know what from the septic system but during times of hard rains, the neighbors to the south are flood d with unpleasant, disgusting, TOXIC septic juice!! We are fed up with this dangerous and rank thing that used to be someone's home! It is time to clean up this s hole (for lack of a more descriptive term) before any one gets hurt or deathly ill! At least the very least, we need to know who to SUE when something (god forbid) tragic occurs! 5/16/2008 IF Page 2 of 2 HELP OUR NEIGHBORHOOD GET SOMETHING DONE ABOUT THIS DECREPIT EYESORE! What are all of our visitors to the 2009 USGA Senior Championship going to think when the see this ramshackled thing? I enforce the township zoning ordinances and Carmel City Code where applicable. The Carmel City Codes that I have the authority to enforce include property maintenance and the condition of structures and property, but only within Carmel city limits. The township zoning ordinances that I have the authority to enforce limit me to development, permit requirements and the uses of property. We will look into the condition of the property of 10905 Crooked Stick Lane as it relates to grass, trash and fencing around the swimming pool. That is the extent of my authority until annexation officially takes place and this area becomes a part of the City of Carmel. The following information is from the Hamilton County Assessor's Office and lists the last recorded ownership of the property in question. I have also included the last known telephone number of the owner. We will be in touch with him (via certified mail) for any violations that I can enforce upon this property. We will sue Mr. Coe if compliance cannot be achieved voluntarily. 1 am sorry that I cannot do more at this time for you and your neighborhood.
