Carmel, Indiana 46033 RE: CITY CODE VIOLATION — CONDITION OF FENCE Dear Sir / Ma'am: This letter is being provided to inform you that an inquiry was made to the Department of Community Services regarding a possible City Code Violation at 604 Mohawk Ct., in the City of Carmel, a property listed under your ownership. An inspection revealed that the concern appears to be valid and that the property is in violation of the Carmel City Code, Chapter 6, Section 79, Part f, which states as a public safety nuisance: (fl All buildings or structures so old, dilapidated or out of repair as to be dangerous, unsafe, unsanitary or otherwise unfit for human use, or shall be an invitation to children and endanger the lives of such children, or which, because of its condition has become afire hazard. As per the Carmel/Clay Zoning Ordinance, Chapter 3, fences are defined as a structure. The current condition of the fence in the rear yard of this property (and any other areas) is a public nuisance as per the above cited City Code. Basically, I would just like you to repair/replace all fence panels that are deteriorated and being propped up by neighbor's efforts to keep them from falling. This is not a requirement to replace the entire fence. Once again, please just replace/repair just those panels that are affected. Please bring this property into compliance by July 25, 2008. Failure to resolve the violation by the specified deadline will result in further enforcement action by the City of Carmel. Refusal to correct the violations can result in the issuance of daily citations and an appearance in Carmel City Court.
